| Probable cause affidavit: | Unlawfully obtain the property of another, namely a wood chipper, with the intent to deprive the other of said property; to wit: On 10/01/15, the victim reported that the defendant stole a wood chipper from her shed while was cleaning her back yard and shed. She saw that he had removed the wood chipper and she asked why. He told her that he wanted to use it at his grandfatherâs house. She told him no and to return it to the shed. While she was on the phone, he came in and asked for some water, which she gave him. He left the house and a few minutes later, she heard a truck start. She went outside and was told by two witnesses that the defendant put her wood chipper in her Nissan truck and drove away. On 10/06/15, I spoke to both witnesses and they both stated they had heard the victim tell the defendant to return the wood chipper to the shed and they later saw him load it into the victimâs truck and drive away. On 10/06/15, I made contact with the defendant at the County Jail, where he was held on unrelated charges. A sworn recorded statement was obtained, where he denied taking anything from the victim. He was charged with one count of Grand Theft and held in lieu of $2000 bond. |
