SUBMITTED BY: CONLEY, STEPHEN 0290 (AR11121633) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: JEWELRY, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: APPROXIMATELY $699.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)C(1) ON 061911, IT WAS REPORTED TO THE CITRUS COUNTY SHERIFF'S OFFICE THAT A GRAND THEFT OF JEWELRY OCCURRED AT 7742 SOUTH FOUR OAKS DRIVE IN FLORAL CITY, FLORIDA. THE TIME FRAME OF THE INCIDENT WAS ONGOING FROM AT LEAST 01/2011 TO 06/17/11. DURING THE INVESTIGATION IT WAS LEARNED THAT THE DEFENDANT, MS AMANDA BYRD, PAWNED THE STOLEN ITEMS AT FAMILY PAWN IN BUSHNELL, FLORIDA. CONTACT WAS MADE WITH DETECTIVE WILSON OF THE SUMTER COUNTY SHERIFF'S OFFICE WHO MADE CONTACT WITH THE VICTIM, WHERE SHE POSITIVELY IDENTIFIED THE STOLEN JEWELRY AS HERS. THE DEFENDANT WAS LIVING AT THE INCIDENT ADDRESS AT THE TIME OF THE THEFT AND HAD ACCESS TO THE RESIDENCE AND THE PROPERTY THAT WAS STOLEN. ON 070811, DEFENDANT BYRD MET WITH ME AT THE CITRUS COUNTY SHERIFF'S OPERATION'S CENTER IN INVERNESS, FLORIDA. AT THAT TIME I CONDUCTED A DIGITALLY RECORDED INTERVIEW WITH DEFENDANT BYRD. PRIOR TO ANY QUESTIONING DEFENDANT BYRD WAS READ MIRANDA FROM A PREPRINTED TEXT, TO WHICH SHE UNDERSTOOD AND AGREED TO CONTINUE SPEAKING WITH ME. DURING THE INTERVIEW I SHOWED DEFENDANT BYRD A PHOTO COPY OF HER PAWN HISTORY AT FAMILY PAWN. AT THAT TIME SHE IDENTIFIED A 10 CARAT ENGAGEMENT RING, A 10 CARAT WEDDING SET, SCRAP GOLD, AND A CHERUB RING, WHICH SHE HAD PAWNED AS BEING STOLEN FROM THE VICTIM. SHE STATED SHE STOLE THESE ITEMS FROM A JEWELRY BOX FROM UNDERNEATH THE VICTIM'S BED. UPON SPEAKING WITH THE VICTIM THE ITEMS IDENTIFIED AS BEING STOLEN BY DEFENDANT BYRD, WERE VALUED AT APPROXIMATELY $699.00, AND BROKEN DOWN AS FOLLOWS: 10 CARAT ENGAGEMENT RING AT $200.00 10 CARAT WEDDING SET AT $140.00 SCRAP GOLD WHICH VICTIM DESCRIBED AS SEVERAL SETS OF EARRINGS AT $259.00 CHERUB RING AT $100.00 DURING THE TIME OF THE THEFTS, DEFENDANT BYRD STATED SHE WAS ADDICTED TO PRESCRIPTION MEDICATION AND THAT PROMPTED HER ILLEGAL ACTIVITY. AT THE CONCLUSION OF THE INTERVIEW, DEFENDANT BYRD WAS ARRESTED, HANDCUFFED, AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DIGITAL RECORDING WAS LATER DOWNLOADED TO THE CITRUS COUNTY SHERIFF'S OFFICE SERVER. THE DEFENDANT WAS RELEASED ON HER OWN RECOGNIZANCE REGARDING THIS CHARGE. *NOT-EXEMPT* |
