SUBMITTED BY: LAUGHLIN, JEREMY 0617 (AR15-15080) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: APPROXIMATELY 0.1 GRAMS METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: SMALL BAGGIES CONTAINING METHAMPHETAMINE RESIDUE, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). ON 052015, I WAS IN HERNANDO CONDUCTING TRAFFIC ENFORCEMENT, WHEN I OBSERVED A BLACK PONTIAC, SPORTS UTILITY VEHICLE, BEARING FLORIDA LICENSE PLATE CQHF97, TRAVELING SOUTH ON HIGHWAY 41. AS THE VEHICLE PASSED MY LOCATION, I OBSERVED THE FRONT WINDOW TO BE SMASHED, ALONG WITH THE PASSENGER REAR WINDOW. THE VEHICLE APPEARED TO BE TRAVELING AT A HIGH RATE OF SPEED IN A POSTED SPEED LIMIT OF 35 MILES PER HOUR. I PACED THE VEHICLE TRAVELING SOUTH ON HIGHWAY 41, WHERE IT WAS TRAVELING APPROXIMATELY 57 MILES PER HOUR IN A 45 MILE PER HOUR ZONE PRIOR TO ENTERING THE 50 MILE PER HOUR SPEED ZONE. I THEN CONDUCTED A TRAFFIC STOP ON THE SAID VEHICLE AT THE DOLLAR GENERAL ON HIGHWAY 41. I MADE CONTACT WITH THE DRIVER AND PASSENGER, LATER IDENTIFIED AS THE DEFENDANT, MR ANDY KEPPEN, AND ADVISED THEM OF THE TRAFFIC INFRACTIONS. I THEN ASKED FOR THE DRIVER AND THE DEFENDANTâS INFORMATION. AT THAT TIME, I REQUESTED A K-9 UNIT TO RESPOND TO MY LOCATION. UPON K-9 DEPUTY RITLIâS ARRIVAL AT THE TRAFFIC STOP, AN EXTERIOR SNIFF OF THE VEHICLE WAS CONDUCTED WITH A POSITIVE ALERT. AT THAT TIME, THE DRIVER AND THE DEFENDANT WERE REMOVED FROM THE VEHICLE. K-9 DEPUTY RITLI THEN CONDUCTED A SEARCH OF THE VEHICLE. UPON DOING SO, HE LOCATED IN THE PASSENGER COMPARTMENT A BOX OF MENâS COLOGNE WHICH CONTAINED SEVERAL PLASTIC BAGGIES. TWO OF THE BAGGIES CONTAINED A CRYSTAL LIKE SUBSTANCE THAT APPEARED TO BE METHAMPHETAMINE. THE CRYSTAL SUBSTANCE WAS TESTED WITH A POSITIVE TEST FOR METHAMPHETAMINE. DURING THE SEARCH, DEPUTY SUDLOW ALSO LOCATED A FEMALEâS PURSE IN THE DRIVER COMPARTMENT OF THE VEHICLE WHICH CONTAINED A LOADED SYRINGE, AN EMPTY SYRINGE, AND A SMALL PLASTIC BAGGIE CONTAINING RESIDUE. THE SUBSTANCE IN THE SYRINGE WAS TESTED WITH A POSITIVE TEST FOR METHAMPHETAMINE. A FURTHER SEARCH OF THE VEHICLE YIELDED NEGATIVE RESULTS FOR ANY FURTHER CONTRABAND. AT THAT TIME, THE DRIVER AND THE DEFENDANT WERE PLACED UNDER ARREST. ALL CONTRABAND WAS COLLECTED AND SUBMITTED TO EVIDENCE. THE DRIVER WAS ISSUED WRITTEN WARNING, WARNING NUMBER 346337B, FOR UNLAWFUL SPEED. THE DRIVER WAS ALSO ISSUED WRITTEN WARNING, WARNING NUMBER 346338B, FOR FAILURE TO UPDATE DRIVER'S LICENSE INFORMATION AND ADDRESS. THE VEHICLE WAS LEFT ON SCENE PER THE OWNERâS REQUEST. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING AND RELEASED ON HIS OWN RECOGNIZANCE. |
