Probable cause affidavit: | SUBMITTED BY: HORTON, TIMOTHY 0614 (AR09109020) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO WIT: US CURRENCY, SAID PROPERTY BEING OF A VALUE OF $200.00 WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTES 812.014(1) and 812.014(3)(a). ON 051109 AT 1538 HOURS THIS DEPUTY RESPONDED TO CRYSTAL RIVER MALL LOCATED AT SEARS STORE 2555, LOCATED AT 1801 NORTHWEST HIGHWAY 19 IN REFERENCE TO A THEFT COMPLAINT WHICH INVOLVED A STORE EMPLOYEE. UPON ARRIVAL, THIS DEPUTY CONTACTED THE LOSS PREVENTION OFFICER WHO STATED THE DEFENDANT HAD TAKEN MONEY ON TWO SEPARATE OCCASIONS FROM the CASH REGISTER THAT SHE WAS ASSIGNED TO. THE COMPLAINANT ADVISED that ON 051109 THE DEFENDANT WAS OBSERVED REMOVING A $100.00 BILL FROM HER REGISTER, STARTING TO LOOK AROUND, ACTING SUSPICIOUS, AND THEN PLACING THE $100.00 BILL IN HER FRONT PANTS POCKET. THIS WAS OBSERVED FROM A SECURITY SURVEILLANCE CAMERA. THE COMPLAINANT STATED that THE DEFENDANT HAS BEEN UNDER INVESTIGATION SINCE APRIL OF 2009 DUE TO MONEY SHORTAGES OUT OF HER REGISTER. THIS DEPUTY WAS ADVISED AFTER THE COMPLAINANT OBSERVED THE DEFENDANT PLACING THE $100.00 IN HER PANTS POCKET, HE IMMEDIATELY MADE CONTACT with the DEFENDANT IN REGARDS TO THE DEFENDANT TAKING THE MONEY. AT THAT TIME THE DEFENDANT WAS TAKEN TO THE LOSS PREVENTION OFFICE, WHERE THE SHERIFF'S OFFICE WAS NOTIFIED. THE DEFENDANT WAS READ HER MIRANDA WARNINGS, AT WHICH TIME SHE STATED SHE UNDERSTOOD THEM AND FREELY VOLUNTEERED TO SPEAK WITH ME. THE DEFENDANT AT THAT TIME ADMITTED TO REMOVING THE $100.00 BILL FROM THE REGISTER AND PLACING THE MONEY INSIDE HER PANTS POCKET. WHEN THIS DEPUTY ASKED THE DEFENDANT WHY SHE TOOK THE MONEY, THE DEFENDANT STATED THAT SHE WAS IN A LOT OF DEBT AND HAD TO PAY BILLS. THE DEFENDANT ALSO ADMITTED TO THIS DEPUTY THAT IN THE MONTH OF APRIL OF THIS YEAR, SHE ALSO TOOK $100.00 FROM HER REGISTER, WHICH WAS NOT VERIFIED UNTIL TODAY'S DATE. THE COMPLAINANT PROVIDED A SWORN WRITTEN STATEMENT AS TO WHAT HE HAD OBSERVED. THE COMPLAINANT ALSO PROVIDED A PROMISSORY NOTE AND A WRITTEN STATEMENT FROM the DEFENDANT, ADMITTING TO TAKING THE MONEY. THE COMPLAINANT THEN STATED THAT THEY DID WISH TO FILE CHARGES ON THE DEFENDANT FOR THE CHARGE OF PETIT THEFT, AT WHICH TIME THE DEFENDANT WAS PLACED UNDER ARREST. THE DEFENDANT WAS HANDCUFFED BEHIND HER BACK, DOUBLE LOCKED AND TRANSPORTED TO CITRUS COUNTY DETENTION FACILITY FOR BOOKING. THE DEFENDANT'S BOND WAS SET AT $250.00, PER THE BOND SCHEDULE. *NOT-EXEMPT* |
