SUBMITTED BY: REID, JUSTIN 0706 (2012-2529AR) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF THE VICTIM, KWIK SAVE FOOD MART (VICTIM), TO WIT: FIVE PACKAGES OF CIGARETTES, CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.015. ON 082912 AT APPROXIMATELY 1940 HOURS, I WAS DISPATCHED TO 7696 WEST HOMOSASSA TRAIL IN HOMOSASSA, WHICH IS THE KWIK SAVE FOOD MART, IN REFERENCE TO A RETAIL PETIT THEFT, WHICH HAD JUST OCCURRED. UPON MY ARRIVAL, I MADE CONTACT WITH the COMPLAINANT, MS RACHEAL SPEARING, WHO IS A CLERK AT the KWIK SAVE FOOD MART. SHE SAID the DEFENDANT AND the DEFENDANTâS BOYFRIEND WALKED INTO the STORE TOGETHER and APPROACHED THE FRONT COUNTER. SHE SAID the DEFENDANTâS BOYFRIEND ASKED HER IF THEY HAD A CERTAIN TYPE OF ALCOHOLIC BEVERAGE. SHE SAID SHE THEN WALKED THE SUBJECT TO THE BEER COOLER TO HELP HIM FIND the BEVERAGE HE WAS LOOKING FOR. SHE SAID SHE WALKED BACK TOWARDS the COUNTER AND THE SUBJECT and the DEFENDANT BOTH WALKED OUT OF THE STORE WITHOUT PAYING FOR ANYTHING. THE COMPLAINANT WAS THEN TOLD BY THE WITNESS, MR CORY AYERS, THAT THE DEFENDANT HAD REACHED UP OVER THE COUNTER AND GRABBED SEVERAL PACKS OF CIGARETTES and PLACED THEM INSIDE HER PURSE WHILE SHE WAS WITH the DEFENDANTâS BOYFRIEND AT the BEER COOLER. THE COMPLAINANT LOOKED UP AT the OVERHEAD CONTAINER THAT CONTAINED the CIGARETTES and NOTICED THAT APPROXIMATELY FIVE PACKS OF DTC FULL FLAVORED CIGARETTES VALUED AT $3.59 A PIECE WERE MISSING FROM THEIR ORIGINAL SPOT. THE COMPLAINANT ADVISED THAT THE FOOD MART DOES HAVE VIDEO SURVEILLANCE FOOTAGE, BUT SHE DID NOT HAVE THE AUTHORITY TO ACCESS THE VIDEO. SHE ADVISED WHEN the MANAGER ARRIVES IN the MORNING SHE WILL BE ABLE TO OBTAIN A COPY OF THE VIDEO SURVEILLANCE AND WILL CONTACT THE SHERIFFâS OFFICE AND WILL PROVIDE A COPY FOR THIS CASE. I THEN MADE CONTACT WITH THE WITNESS, MR CORY AYERS. HE SAID HE WENT INTO the KWIK SAVE STORE TO BUY A LOAF OF BREAD and WAS STANDING AT THE FRONT COUNTER. HE SAID THE DEFENDANT WALKED IN with HER BOYFRIEND and the DEFENDANTâS BOYFRIEND ASKED ABOUT A CERTAIN ALCOHOLIC BEVERAGE and that WAS WHEN the CLERK WENT TO SHOW THE MALE SUBJECT WHERE the BEVERAGE WAS. HE SAID WHEN the CLERK WAS AT the BEER COOLER the DEFENDANT REACHED BEHIND the COUNTER AND GRABBED APPROXIMATELY FIVE PACKS OF CIGARETTES FROM the OVERHEAD COUNTER ABOVE the COUNTER. HE SAID THE DEFENDANT THEN LEFT THE STORE WITH HER BOYFRIEND IN A MAROON IN COLOR CHEVROLET PICKUP TRUCK with A SILVER STRIPE DOWN the SIDE. I THEN MADE CONTACT WITH the COMPLAINANT ONCE AGAIN, WHO ADVISED THAt The DEFENDANTâS NAME WAS GINA MARTIN AND SHE KNEW THIS BECAUSE SHE WAS A REGULAR AT the STORE. WITH THIS INFORMATION, I WAS ABLE TO OBTAIN AN ADDRESS FOR THE DEFENDANT. when i arrived at the address i observed a maroon and silver chevrolet pickup truck that matched the description that the witness had provided for me. I THEN MADE CONTACT WITH the DEFENDANT AT HER HOME ADDRESS. THE DEFENDANT STATED THAT SHE WAS AT the STORE and TOOK SEVERAL PACKS OF CIGARETTES WITHOUT PAYING FOR THEM. THE DEFENDANT STATED THAT she WOULD BE WILLING TO PAY FOR THE CIGARETTES TOMORROW. THE DEFENDANT WAS WILLING TO FILL OUT AND SIGN A SWORN, WRITTEN STATEMENT, WHICH WAS LATER TURNED IN TO RECORDS. the COMPLAINANT and THE WITNESS ALSO FILLED OUT AND SIGNED A SWORN, WRITTEN STATEMENT, WHICH WERE LATER TURNED IN TO RECORDS. the DEFENDANT WAS THEN PLACED UNDER ARREST FOR RETAIL PETIT THEFT. SHE WAS HANDCUFFED DOUBLE LOCKED BEHIND HER BACK AND PLACED IN the REAR OF MY PATROL VEHICLE. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY JAIL FOR BOOKING and PROCESSING. HER BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. |
