SUBMITTED BY: BLISS, RYAN 1894 (AR10117470) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN UNOCCUPIED DWELLING THEREOF, TO-WIT: THE DEFENDANT DID ENTER THE RESIDENCE LOCATED AT 2788 NORTH PRESTWICK WAY IN LECANTO, WITHOUT THE CONSENT OF THE VICTIM, IN VIOLATION OF FLORIDA STATUTE 810.02((3)(B). DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: THE DEFENDANT DID TAKE ASSORTED COINS AND JEWELRY, (B), OF THE VALUE OF $300.00 OR MORE BUT LESS THAN $5,000.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, AND THE PROPERTY WAS TAKEN FROM A DWELLING OR FROM THE UNENCLOSED CURTILAGE OF A DWELLING, IN VIOLATION OF FLORIDA STATUTES 812.014(2)(C)(1). DID HAVE IN HIS POSSESSION TOOLS USED TO COMMIT THE OFFENSE OF BURGLARY, IN VIOLATION OF FLORIDA STATE STATUTE, 810.06. DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: THE DEFENDANT DID HAVE IN HIS POSSESSION ONE PRESCRIPTION BELONGING TO ANOTHER, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID VIOLATE HIS PROBATION WITH AN ORIGINAL CHARGE OF BURGLARY OF AN UNOCCUPIED DWELLING, IN VIOLATION OF FLORIDA STATE STATUTE, 948.06. ON 101910 AT 0235 HOURS, THE DEFENDANT, DWAYNE WHITTENTON AND CO-DEFENDANT JASON WHITTENTON HAD BEEN THE SUBJECTS OF A MULTI JURISDICTIONAL INVESTIGATION INVOLVING A BURGLARY RING. SAID BURGLARY RING TARGETED THE RESIDENCES OF HOMEOWNERS WHO HAD LEFT THEIR RESPECTIVE COUNTIES OR THE STATE OF FLORIDA TO ATTEND FUNERAL SERVICES OF FAMILY MEMBERS. DEFENDANT DWAYNE WHITTENTON WAS PLACED UNDER SURVEILLANCE, WHERE HE WAS OBSERVED TO BE LEAVING FROM VOLUSIA COUNTY AND TRAVELING TO CITRUS COUNTY. DEFENDANT WHITTENTON PARKED HIS SILVER KIA RIO ON A DARK SIDE STREET IDENTIFIED AS CLYDESDALE STREET IN LECANTO. DEFENDANT DWAYNE WHITTENTON AND DEFENDANT JASON WHITTENTON THEN EXITED THE VEHICLE AND ENTERED INTO THE RESIDENTIAL COMMUNITY KNOWN AS BLACK DIAMOND. DEFENDANT DWAYNE WHITTENTON AND CO-DEFENDANT JASON WHITTENTON THEN EXITED THIS AREA IN THE VEHICLE AFTER APPROXIMATELY ONE OR ONE AND ONE HALF HOURS. SHORTLY AFTER, CITRUS COUNTY SHERIFF'S OFFICER CHARLES SCHANEL CONDUCTED A TRAFFIC STOP ON DEFENDANT DWAYNE WHITTENTON FOR TRAVELING AT A HIGH RATE OF SPEED. A CITRUS COUNTY SHERIFF'S OFFICE CANINE WAS THEN BROUGHT TO THE SCENE, AT WHICH TIME THE CANINE ALERTED ON THE VEHICLE. A SEARCH OF THE VEHICLE REVEALED A GREEN LEAFY SUBSTANCE ON THE VEHICLE'S FLOORBOARD. A SEARCH OF THE VEHICLE REVEALED AN OFF WHITE IN COLOR PILLOWCASE CONTAINING NUMEROUS PIECES OF COINS AND JEWELRY. ATTEMPTS WERE THEN MADE TO LEARN WHO THE OWNER OF THE JEWELRY AND COINS WAS, AT WHICH TIME DEFENDANT DWAYNE WHITTENTON AND CO-DEFENDANT JASON WHITTENTON REFUSED TO ANSWER ANY QUESTIONS. DURING THE SEARCH OF THE ITEMS CONTAINED IN THE PILLOWCASE, A PRESCRIPTION PILL BOTTLE CONTAINING HYDROCODONE PILLS BEARING THE NAME OF MS SHIRLEY WILLIAMS WAS FOUND. AN OFFLINE SEARCH REVEALED THE ADDRESS OF SHIRLEY WILLIAMS TO BE 2773 PRESTWICK WAY IN LECANTO, FLORIDA. A SEARCH OF SHIRLEY WILLIAMS RESIDENCE FAILED TO REVEAL ANY ENTRY OR EXIT POINTS. AS THE SEARCH OF THE PILLOWCASE CONTINUED, A WALLET CONTAINING A MILITARY IDENTIFICATION CARD BELONGING TO MR STEVEN ROGER JOHNSON WAS DISCOVERED. AN OFFLINE SEARCH REVEALED STEVEN JOHNSON'S ADDRESS TO BE 2788 PRESTWICK WAY IN LECANTO, FLORIDA. A SEARCH OF THAT ADDRESS REVEALED THE POINT OF ENTRY TO BE FORCED ENTRY THROUGH THE FRONT DOOR. A SEARCH OF THE RESIDENCE REVEALED IT TO BE RANSACKED WITH PROPERTY STREWN ALL ABOUT THE FLOOR. THE DEFENDANT'S WERE PLACED UNDER ARREST HANDCUFFED AND DOUBLE LOCKED BEHIND THEIR BACKS, AND PLACED IN THE REAR OF DEPUTY CANFIELD'S PATROL VEHICLE. DEPUTY CANFIELD THEN TRANSPORTED THE DEFENDANTS TO THE CITRUS COUNTY DETENTION CENTER FOR BOOKING AND PROCESSING WHERE DEFENDANT JASON WHITTENTON WAS CHARGED WITH ONE COUNTY OF BURGLARY TO AN UNOCCUPIED DWELLING, ONE COUNT OF POSSESSION OF BURGLARY TOOLS, ONE COUNT OF POSSESSION OF A CONTROLLED SUBSTANCE; ONE COUNT OF GRAND THEFT (MORE THAN $300.00 BUT LESS THAN $5,000.00) AND ONE COUNT OF VIOLATION OF PROBATION (ORIGINAL CHARGE OF BURGLARY TO AN UNOCCUPIED DWELLING) WITH NO BOND, WITH A TOTAL BOND OF $11,000.00 IN ACCORDANCE WITH THE BOND SCHEDULE. PROPERTY WAS COLLECTED, DOCUMENTED AND ENTERED INTO EVIDENCE AT THE CITRUS COUNTY SHERIFF'S OFFICE EMERGENCY OPERATIONS CENTER.
