| Probable cause affidavit: | SUBMITTED BY: WILLIAMS, JUSTIN 0730 (AR13-6360) (13-89962) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, WALMART SUPERCENTER, TO WIT: TWO APPLE I-PADS, SAID PROPERTY BEING OF A VALUE OF $1,198.00 BY ALTERING THE BAR CODE, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTES 812.014(2)(C)(1); DID UNLAWFULLY AND KNOWINGLY, while committing or after committing theft of property, resist the reasonable effort of a merchant OR merchantâs employee, to recover the property WHICH THE merchant OR merchantâs employee had probable cause to believe the individual had concealed or removed from its place of display or elsewhere, IN VIOLATION OF FLORIDA STATE STATUTE 812.015(6). ON 070513 AT APPROXIMATELY 2249 HOURS, THIS AGENCY RECEIVED A COMPLAINT FROM WALMART IN REFERENCE TO A SUBJECT SHOPLIFTING. ON 070613 WHILE FOLLOWING UP ON THIS INVESTIGation, i was able to determine the SUSPECT to be the DEFENDANT, mr jermaine thompson. on 070713 at APPROXIMATELY 1720 HOURS, mr jermaine thompson agreed to meet with me at the CITRUS COUNTY SHERIFF'S OFFICE (CCSO) OPERATIONS CENTER. upon making contact with the DEFENDANT, the DEFENDANT was read his miranda rights and agreed to waive his rights and speak with me. the DEFENDANT advised me that he was at the walmart in inverness at the time of the theft. the DEFENDANT advised that he drove to walmart in the rental VEHICLE that his mother, ms joyce bellamy was renting. this VEHICLE was a silver buick bearing FLORIDA tag s597ub. this was the tag NUMBER provided to me by the COMPLAINANT, mr joseph compostella. the DEFENDANT further advised that he was the only one in the VEHICLE that night and that no one else was with him at the store. the DEFENDANT advised that he obtained two apple i-pads from the electronics section, which were brought to the front cash register NUMBER 15 by a store clerk from the electronics section. the DEFENDANT advised while at the cash register PRIOR to the cashier scanning the i-pads, he requested to see the i-pads to which the cashier complied. the DEFENDANT advised that he returned the apple i-pads, which were then scanned by the cashier. the DEFENDANT provided me with the receipt from the purchase, which does not show the proper value for the purchase of the i-pads. the total amount paid by the DEFENDANT was $100.37. the DEFENDANT advised that he then took the receipt along with the i-pads and other items purchased and exited the store. the DEFENDANT advised that the COMPLAINANt attempted to approach him at which time, the DEFENDANT began to run from the COMPLAINANT, who is also the LOSS PREVENTION officer. the DEFENDANT advised he then got into his VEHICLE and left the scene. it should be noted that the receipt obtained by the DEFENDANT did not clearly represent the total value of the i-pads and that a reasonable and prudent person would recognize this fact. i also made contact with both the COMPLAINANT and an additional WITNESS, mr lawrence redding, both of who advised that they observed the DEFENDANT switching the upc code on the apple i-pads with a DIFFERENT one. both the COMPLAINANT and WITNESS also POSITIVELY identified the DEFENDANT as the SUBJECT they WITNESSed switching the upc codes on 070513. the DEFENDANT was then placed under arrest, handcuffed (DOUBLE LOCKED) and secured in the rear seat of my patrol VEHICLE and transported to the CITRUS COUNTY DETENTION FACILITY (CCDF) for booking and processing. the DEFENDANTâs total bond was set at $2,500.00 per the bond schedule. |
