Probable cause affidavit: | SUBMITTED BY: SMITH, BRADLEY 0477 (AR07003774) DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: XANAX AND SUBOXONE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 070407 AT APPROXIMATELY 0900 HOURS, WHILE CONDUCTING STATIONARY RADAR ENFORCEMENT ON EAST GULF TO LAKE HIGHWAY IN INVERNESS, I OBSERVED A RED VEHICLE APPROACHING FROM THE EAST ON THE AFOREMENTIONED ROADWAY. I ESTIMATED THE SPEED OF THAT VEHICLE TO BE ABOVE THE POSTED SPEED LIMIT OF 60 MILES PER HOUR (MPH). AT THAT TIME, I INITIATED MY RADAR UNIT AND HEARD A CLEAR DOPPLER TONE AND OBSERVED A READING OF 73 MPH. AT THAT TIME, I CONDUCTED A TRAFFIC STOP ON THE VEHICLE NEAR THE INTERSECTION OF EAST GULF TO LAKE HIGHWAY AND SOUTH CHAMBERS WAY. I APPROACHED THE VEHICLE AND MADE CONTACT WITH THE DRIVER/DEFENDANT, MR MATTHEW CIARA. I ASKED HIM FOR HIS DRIVER'S LICENSE, REGISTRATION AND PROOF OF INSURANCE. THE DEFENDANT PROVIDED ME WITH THE REQUESTED DOCUMENTATION AND HE ADVISED THAT THE VEHICLE BELONGED TO HIS FRIEND. AT THAT TIME, I RETURNED TO MY PATROL VEHICLE, RAN THE VEHICLE AS WELL AS THE DEFENDANT THROUGH FCIC/NCIC. I ALSO CONFIRMED THAT THE DEFENDANT WAS ALLOWED TO BE IN POSSESSION OF THE VEHICLE. I ISSUED THE DEFENDANT WARNING NUMBER 194284B FOR UNLAWFUL SPEED 73 MPH IN A 60 MPH ZONE. CANINE DEPUTY BRUNK ARRIVED ON SCENE. HE MADE CONTACT WITH THE DEFENDANT AND ADVISED THAT HE WOULD BE WALKING CANINE AJAX AROUND THE VEHICLE TO CONDUCT AN EXTERIOR SNIFF. UPON COMPLETION OF THE EXTERIOR SNIFF WITH CANINE AJAX, DEPUTY BRUNK ADVISED ME THAT CANINE AJAX ALERTED TO THE ODOR OF NARCOTICS COMING FROM THE VEHICLE. AT THAT TIME, DEPUTY BRUNK MADE CONTACT WITH THE DEFENDANT AND ASKED HIM TO EXIT THE VEHICLE. DEPUTY BRUNK ALSO MADE CONTACT WITH THE PASSENGER OF THE VEHICLE AND ASKED HIM TO EXIT. AT THAT TIME, I STOOD BY WITH THE DEFENDANT AND PASSENGER WHILE DEPUTY BRUNK SEARCHED THE INTERIOR OF THE VEHICLE. I THEN MADE CONTACT WITH THE DEFENDANT AND ASKED HIM IF HE HAD ANY DRUGS, KNIVES OR GUNS ON HIS PERSON, TO WHICH HE STATED NO. I ASKED THE DEFENDANT IF HE WOULD EMPTY HIS POCKETS ON THE HOOD OF MY PATROL VEHICLE, TO WHICH HE DID. DURING THAT TIME, I OBSERVED THE DEFENDANT TO BE VERY NERVOUS AND HIS HANDS TO BE VISIBLY SHAKING. I ASKED THE DEFENDANT WHY HE WAS SHAKING, TO WHICH HE STATED THAT HE HAD SOME XANAX AND SUBOXONE. THE DEFENDANT THEN REACHED IN TO HIS LEFT FRONT PANTS POCKET AND RETRIEVED A PLASTIC CIGARETTE WRAPPER CONTAINING ONE AND A HALF PEACH COLORED PILLS. HE THEN REACHED IN HIS RIGHT FRONT COIN POCKET AND RETRIEVED A PLASTIC CIGARETTE WRAPPER CONTAINING FOUR SMALL BLUE PILLS. THE PEACH PILLS WERE SIX SIDED WITH THE INSCRIPTION N8 ON ONE SIDE AND A SWORD ON THE OTHER SIDE. THE BLUE PILLS WERE CIRCULAR IN SHAPE WITH THE LETTER R ON ONE SIDE AND THE NUMBER 031 ABOVE A LINE ON THE OTHER SIDE. I USED THE 2006 EDITION OF THE DRUG IDENTIFICATION BIBLE TO IDENTIFY THE PEACH TABLETS AS SUBOXONE, A SCHEDULE III NARCOTIC. THE SMALL BLUE PILLS WERE IDENTIFIED AS XANAX, A SCHEDULE IV NARCOTIC. I ASKED THE DEFENDANT IF HE HAD A PRESCRIPTION FOR THE NARCOTICS, TO WHICH HE STATED NO. HE ALSO STATED THAT HE PURCHASED THEM OFF THE STREET. AT THAT TIME, THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND PLACED IN THE REAR SEAT OF MY PATROL VEHICLE. THE VEHICLE WAS TURNED OVER TO THE PASSENGER PER THE DEFENDANT'S REQUEST. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HIS BOND WAS SET AT $10,000.00 PER THE BOND SCHEDULE. THE NARCOTICS WERE LATER TURNED IN TO EVIDENCE. *NOT-EXEMPT* |
