SUBMITTED BY: WEST, ROY 0421 (AR07100356) UNLAWFULLY ENDANGER THE SAFETY OF ANOTHER OR THEIR PROPERTY WHILE INTOXICATED OR DID WHILE INTOXICATED OR DRINKING AN ALCOHOLIC BEVERAGE IN A PUBLIC PLACE CAUSE A PUBLIC DISTURBANCE, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 856.011. ON 111607 WHILE TRAVELING ON NORTH CITRUS AVENUE AFTER LEAVING A CALL LOOKING FOR A FEMALE WHO WAS THREATENING SUICIDE, I DID OBSERVE THE DEFENDANT WALKING IN AND ON THE ROADWAY, IN THE DARK. I TURNED AROUND ON CITRUS AVENUE AND MADE CONTACT WITH THE DEFENDANT, MS MEGAN STUKEY. I ASKED HER TO STEP OUT OF THE ROADWAY AND ON TO THE SIDE OF THE ROAD. I ASKED FOR HER IDENTIFICATION AND EXPLAINED TO HER THE PREVIOUS CALL. IT WAS APPARENT THAT THE DEFENDANT WAS INTOXICATED AND WAS HAVING A DIFFICULT TIME RUMMAGING THROUGH HER PURSE. HOWEVER, SHE WAS ABLE TO PRODUCE HER DRIVER'S LICENSE WHICH CONFIRMING HER IDENTITY THAT SHE WAS NOT THE FEMALE SUBJECT WE WERE SEARCHING FOR. I RETURNED HER IDENTIFICATION TO THE DEFENDANT. ALL DURING THIS TIME THE DEFENDANT WAS VERBALLY ABUSIVE AND LOUD, STATING THINGS LIKE "FUCK YOU, COCK SUCKING PIG, I HOPE YOU BALLS FALL OFF." SHE EXPLAINED THAT ALL SHE WANTED WAS A RIDE HOME AND THAT HER FRIENDS HAD DUMPED HER AT THE BAR. WHILE SPEAKING WITH HER, MY SUPERVISOR, SERGEANT (SGT) PALMINTERI ALONG WITH CORPORAL BONURA ARRIVED ON SCENE. SGT PALMINTERI HAD ALSO COME FROM THE SCENE OF LOOKING FOR THE SUICIDAL FEMALE. I EXPLAINED TO SGT PALMINTERI THAT THE DEFENDANT WAS NOT THE PERSON WE WERE LOOKING FOR AND I WOULD PROBABLY JUST GIVE HER A RIDE HOME DUE TO HER LEVEL OF INTOXICATION. I RETURNED TO THE DEFENDANT AND EXPLAINED TO HER THAT I WOULD GIVE HER A RIDE BUT WOULD NEED TO SEE INSIDE OF HER PURSE BEFORE ALLOWING IN MY PATROL VEHICLE. AT THAT TIME, THE DEFENDANT STARTED THROWING ITEMS ON THE HOOD OF MY PATROL VEHICLE WHILE YELLING MORE OBSCENITIES. I STOPPED HER AND TOLD HER THAT IF SHE JUST PUT EVERYTHING BACK INSIDE OF HER PURSE, I WOULD HOLD HER PURSE ON MY DASH. AGAIN, THE DEFENDANT WOULD NOT COOPERATE OR BE QUIET AND AFTER REPEATED REQUESTS, I TOLD HER SHE COULD CONTINUE ON HER WAY WHICH SHE ALSO REFUSED TO DO. WHILE TRYING TO GET THE DEFENDANT TO CALM DOWN, I CALLED ON THE RADIO AND ADVISED SGT PALMINTERI OF THE SITUATION, AT WHICH TIME SGT PALMINTERI AND CORPORAL BONURA RETURNED TO MY LOCATION. AFTER REPEATED ATTEMPTS TO CONVERSE QUIETLY WITH THE DEFENDANT, SHE REFUSED TO COOPERATE NOR WOULD SHE WALK AWAY. I ADVISED THE DEFENDANT THAT IF SHE DID NOT CALM DOWN, I WOULD ARREST HER FOR PUBLIC INTOXICATION, TO WHICH SHE RESPONDED "FUCK YOU, ARREST ME, I'M NOT MOVING.!" I ADVISED HER TO TURN AROUND AND PLACE HER HANDS BEHIND HER BACK, AT WHICH TIME SHE WAS SECURED IN HANDCUFFS WHICH WERE DOUBLE LOCKED. IN ATTEMPTING TO SECURE THE DEFENDANT IN THE REAR SEAT OF MY PATROL VEHICLE, THE DEFENDANT RESISTED BY PULLING AND PUSHING AWAY. I HAD TO PHYSICALLY PUSH HER AGAINST THE REAR OF MY PATROL VEHICLE SO THAT CORPORAL BONURA COULD OPEN THE REAR DOOR OF MY PATROL VEHICLE. IN GETTING INTO THE VEHICLE, THE DEFENDANT DID LAID DOWN ON THE SEAT, KICKING OUT AT ME AND STRIKING ME ONCE IN THE LEG. I ADVISED HER TO KEEP HER FEET INSIDE OF THE VEHICLE. THE DEFENDANT WAS SEAT BELTED IN. PRIOR TO LEAVING THE SCENE, THE DEFENDANT BEGAN KICKING AT THE WINDOWS OF MY PATROL VEHICLE. I ADVISED HER THAT IF SHE KICKED THE WINDOWS AGAIN, I WOULD SECURE HER FEET. I PROCEEDED TO LEAVE THE SCENE, AT WHICH POINT THE DEFENDANT AGAIN STARTING KICKING THE WINDOWS. I STOPPED MY PATROL VEHICLE ON THE OPPOSITE SIDE OF THE ROADWAY AND ADVISED CORPORAL BONURA OF THE SITUATION. CORPORAL BONURA RETURNED TO MY LOCATION. I THEN SECURED THE DEFENDANT'S LEGS WITH A HOBBLE STRAP. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WITHOUT ANY FURTHER INCIDENT. UPON ARRIVAL, SHE WAS TURNED OVER TO THE STAFF FOR FURTHER PROCESSING. THE DEFENDANT'S BOND WAS SET AT $150.00, PER THE BOND SCHEDULE. *NOT-EXEMPT* |
