SUBMITTED BY: FELIX, REYSON 1284 (AR17-23042) DID, KNOWING HIS DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE, 322.34(2)(A). ON 031717, I WAS PERFORMING MOVING RADAR TRAFFIC ENFORCEMENT WHILE DRIVING NORTHBOUND ON ROOSEVELT BOULEVARD. AT THAT TIME, I OBSERVED A WHITE IN COLOR DODGE NEON FOUR DOOR VEHICLE BEARING FLORIDA PLATE, 7150PE. I OBSERVED SAID VEHICLE TO BE DRIVING SOUTHEAST ON ROOSEVELT BOULEVARD IN WHAT APPEARED TO BE IN EXCESS OF THE POSTED SPEED LIMIT. I THEN ACTIVATED MY AGENCY ISSUED PYTHON TWO RADAR. AT THAT TIME, I WAS PROVIDED WITH A HIGH DOPPLER TONE SHOWING A CONSISTENT SPEED OF 36 MILES IN A 25 MILES PER HOUR ZONE FOR THE TARGET VEHICLE. I CONDUCTED A TURN AROUND AND ACTIVATED MY OVERHEAD EMERGENCY LIGHTS AND SIRENS TO CONDUCT A TRAFFIC STOP. AT THAT TIME, THE VEHICLE CAME TO REST AT ROOSEVELT BOULEVARD AND JUNIPER WAY. I APPROACHED THE VEHICLE WHERE I MADE CONTACT WITH THE DRIVER, LATER IDENTIFIED AS THE DEFENDANT, MR MICHAEL ACEVEDO. I THEN ADVISED THE DEFENDANT OF THE REASON FOR THE STOP AND REQUESTED HIS DRIVERâS LICENSE, REGISTRATION AND PROOF OF INSURANCE. THE DEFENDANT THEN ADVISED ME THAT HE DID NOT HAVE HIS DRIVERâS LICENSE WITH HIM AT THAT TIME. HE FURTHER STATED HE WAS JUST DRIVING AROUND THE CORNER FOR HIS DOG WHO WAS LOOSE, AND FORGOT HIS DRIVERâS LICENSE. I ASKED THE DEFENDANT IF HE HAD A VALID DRIVERâS LICENSE FOR THE STATE OF FLORIDA, TO WHICH HE REPLIED NO. I THEN ASKED HIM IF HE HAD A VALID DRIVERâS LICENSE FOR ANY OTHER STATE, TO WHICH HE STATED HE HAS A PENNSYLVANIA DRIVERâS LICENSE. I ASKED THE DEFENDANT IF THE PENNSYLVANIA DRIVERâS LICENSE WAS VALID, TO WHICH HE RESPONDED IT SHOULD BE, HOWEVER, HE WAS NOT SURE. I RAN THE DEFENDANTâS NAME AND DATE OF BIRTH THROUGH THE CITRUS COUNTY TELETYPE DIVISION. THIS REVEALED HIS PENNSYLVANIA DRIVERâS LICENSE WAS SUSPENDED. I AGAIN MADE CONTACT WITH THE DEFENDANT AND INSTRUCTED HIM TO EXIT HIS VEHICLE. I ADVISED HIM THAT HIS PENNSYLVANIA DRIVERâS LICENSE WAS SUSPENDED, AND HE WAS BEING PLACED UNDER ARREST FOR ONE COUNT OF DRIVING WHILE LICENSE SUSPENDED/REVOKED (KNOWINGLY). THE DEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK, AND SEATED IN THE REAR OF MY PATROL VEHICLE FOR TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL, THE DEFENDANT WAS TURNED OVER TO DETENTION STAFF FOR BOOKING AND PROCESSING. WHILE AT THE DETENTION FACILITY, I DISCOVERED THE DEFENDANT WAS ON FELONY PROBATION. I MADE CONTACT WITH THE DEFENDANTâS PAROLE OFFICER, MS HALEY MESSENGER. OFFICER HALEY ADVISED ME THAT ONE WEEK AGO SHE DISCOVERED THE DEFENDANT WAS DRIVING AROUND; HOWEVER, SHE DID NOT HAVE ANY PROOF. SHE ADVISED THAT SHE THEN ADVISED THE DEFENDANT TO STOP DRIVING DUE TO NOT HAVING A VALID DRIVERâS LICENSE. OFFICER MESSENGER FURTHER ADVISED SHE SPOKE WITH THE DEFENDANT THIS MORNING, AT WHICH TIME SHE AGAIN ADVISED HIM NOT TO DRIVE DUE TO HIM NOT HAVING A VALID DRIVERâS LICENSE. THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION, A7YPYFE, FOR SPEEDING. HE WAS ALSO ISSUED UNIFORM TRAFFIC CITATION, A7YPYGE, FOR DRIVING WHILE LICENSE SUSPENDED/REVOKED (KNOWINGLY) WITH A MANDATORY COURT DATE OF 033017 AT 1300 HOURS AT THE CITRUS COUNTY COURTHOUSE. THE DEFENDANTâS BOND WAS SET AT $500.00, FOR THE LISTED CHARGE OF DRIVING WHILE LICENSE SUSPENDED/REVOKED. |
