Probable cause affidavit: SUBMITTED BY: DOYLE, CHAD 0438 (AR09107049) UNLAWFULLY AND KNOWINGLY ALTER, DESTROY, CONCEAL, OR REMOVE ANY RECORD, DOCUMENT, OR THING, TO WIT: STOLEN STORE MERCHANDISE WITH THE PURPOSE TO IMPAIR ITS VERITY OR AVAILABILITY IN ANY PROCEEDING OR INVESTIGATION KNOWING FULL WELL THAT A CRIMINAL TRIAL OR PROCEEDING OR AN INVESTIGATION BY A DULY CONSTITUTED PROSECUTING AUTHORITY, LAW ENFORCEMENT AGENCY OR GRAND JURY OF THE STATE IS PENDING OR IS ABOUT TO BE INSTITUTED, IN VIOLATION OF FLORIDA STATE STATUTE 918.13(1)(A), AND DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF CVS PHARMACY, TO WIT: STORE MERCHANDISE WITH A TOTAL VALUE OF $32.34, BY CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.014(3)(A). ON 010609, I RESPONDED TO THE CVS PHARMACY IN HOMOSASSA SPRINGS IN REFERENCE TO A SHOPLIFTING IN PROGRESS. UPON MY ARRIVAL, I MADE CONTACT WITH THE STORE MANAGER WHO ADVISED HE HAD WITNESSED A CO-DEFENDANT CONCEALING MERCHANDISE UNDERNEATH HER CLOTHING FROM THE STORE. THE STORE MANAGER ADVISED THAT A WITNESS HAD WATCHED THE CO-DEFENDANT THEN REMOVE THE ITEMS FROM UNDERNEATH HER CLOTHING AND PLACE THEM OUTSIDE ON THE SOUTH SIDE OF THE STORE IN A BUSH. I SPOKE TO THE WITNESS WHO STATED HE THEN SAW THE CO-DEFENDANT RETURN INSIDE THE STORE, AT WHICH TIME, HE WITNESSED THE DEFENDANT WALK UP TO WHERE THE ITEMS HAD BEEN PLACED. THE WITNESS ADVISED THAT THE DEFENDANT THEN PICKED THE ITEMS UP OFF THE GROUND AND WALKED TO THE REAR OF THE STORE PARKING LOT AND CONCEAL THEM UNDERNEATH ANOTHER BUSH. THE WITNESS ADVISED THAT THE DEFENDANT THEN RETURNED INSIDE THE STORE. THE WITNESS STATED HE ALSO RETURNED TO INSIDE THE STORE AND THEN SHOWED THE STORE MANAGER WHERE THE ITEMS WERE LOCATED OUTSIDE. AFTER SPEAKING WITH THE WITNESS AND MANAGER, I QUESTIONED THE CO-DEFENDANT AND AFTER RECEIVING A VERBAL STATEMENT FROM HER, I MADE CONTACT WITH THE DEFENDANT. THE DEFENDANT WAS READ HIS MIRANDA WARNINGS FROM A PREPRINTED TEXT. THE DEFENDANT STATED HE UNDERSTOOD HIS RIGHTS AND AGREED TO SPEAK WITH ME. I ASKED THE DEFENDANT IF HE HAD STOLEN ANY MERCHANDISE FROM THE STORE, AND HE STATED NO. I ASKED THE DEFENDANT IF HE HAD ANY KNOWLEDGE OF THE CO-DEFENDANT STEALING ANYTHING, AND HE STATED HE HAD HEARD THE STORE MANAGER TALKING TO THE CO-DEFENDANT ABOUT THE ITEMS IN QUESTION. THE DEFENDANT FURTHER STATED THAT WHILE THEY WERE DOING THIS, HE OVERHEARD THE LOCATION WHERE THE ITEMS HAD BEEN PUT, SO HE THEN WENT OUTSIDE AND PICKED UP THE ITEMS AND MOVED THEM TO THE REAR OF THE STORE PARKING LOT. I ASKED HIM WHY HE HAD DONE THIS, AND HE STATED HE HAD HEARD THE MANAGER MAKING ACCUSATIONS TO HIS FRIEND (CO-DEFENDANT) THAT SHE HAD TAKEN THE ITEMS, THEREFORE, HE HAD MOVED THE ITEMS SO SHE WOULD NOT GET IN TROUBLE. I WAS PROVIDED WITH A LIST OF THE STOLEN/RECOVERED ITEMS WHICH ARE AS FOLLOWS: A SKIN CARE PRODUCT VALUED AT $5.00, A BOOK VALUED AT $7.99, FIXODENT VALUED AT $6.19, PACKAGE OF HAIR BARRETTES VALUED AT $3.49, AQUA FRESH TOOTHPASTE VALUED AT $3.69, AND A DAILY PILL BOX VALUED AT $4.99, TOTAL VALUE BEING $32.34. I INFORMED THE DEFENDANT HE WAS BEING PLACED UNDER ARREST FOR TAMPERING WITH EVIDENCE AND FOR RETAIL PETIT THEFT DUE TO THE FACT HE WAS AN ACCOMPLICE. THE DEFENDANT WAS THEN HANDCUFFED BEHIND HIS BACK (DOUBLE LOCKED), ESCORTED TO MY PATROL VEHICLE AND PLACED IN THE REAR SEAT. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS BOOKED AND PROCESSED. TOTAL BOND WAS $2,500.00 PER THE BOND SCHEDULE. *NOT-EXEMPT*
