SUBMITTED BY: TITUS, JOSHUA 1243 (AR17-22336) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HER NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE, 316.193. ON 012117, I WAS CONDUCTING TRAFFIC ENFORCEMENT IN THE AREA OF ROOSEVELT BOULEVARD AND SOUTH WASHINGTON STREET. AT THAT TIME, I OBSERVED A DARK GREEN IN COLOR BRONCO THAT WAS TRAVELING NORTHBOUND ON SOUTH WASHINGTON STREET. SAID VEHICLE WAS TRAVELING ON THE WRONG SIDE OF THE ROADWAY, AND WAS WEAVING IN AND OUT OF LANES. AT THAT TIME, I GOT BEHIND SAID VEHICLE BEARING FLORIDA TAG, 6834TA, TO CONDUCT A TRAFFIC STOP, AND INITIATED MY OVERHEAD LIGHTS APPROXIMATELY 500 FEET AWAY FROM THE STOP SIGN. THE VEHICLE CONTINUED TRAVELING NORTHBOUND ON SOUTH WASHINGTON AVENUE AND DID NOT MAKE ANY ATTEMPTS TO PULL OVER. THE DRIVER ALSO MADE NO ATTEMPTS TO UTILIZE HAND SIGNALS INDICATING SHE INTENDED TO PULL OVER. THE DRIVER OF THE VEHICLE THEN APPROACHED THE STOP SIGN WHERE THE VEHICLE DID NOT COME TO A COMPLETE STOP. THE VEHICLE THEN TURNED LEFT ONTO ROOSEVELT BOULEVARD, AT WHICH TIME I BEGAN HITTING MY SIREN IN AN ATTEMPT TO GET THE DRIVER TO PULL OVER. THE DRIVER HAD THE DRIVERâS SIDE WINDOW DOWN. AT THAT TIME, AN UNKNOWN CITIZEN CUT THE SUBJECT OFF, AND BEGAN POINTING AND YELLING AT THE DRIVER IN AN ATTEMPT TO ALERT THE DRIVER THAT I WAS ATTEMPTING TO PULL THEM OVER. THE DRIVER IGNORED THE CITIZEN AND ALSO CONTINUED TO IGNORE MY EFFORTS TO CONDUCT A TRAFFIC STOP. THE VEHICLE THEN TURNED INTO AN UNKNOWN ADDRESS AT THE CORNER OF WASHINGTON AND ROOSEVELT, WHERE I PULLED IN BEHIND THE VEHICLE AND PUT MY PATROL VEHICLE IN PARK. I APPROACHED THE DRIVERâS SIDE OF THE VEHICLE WHERE I OBSERVED THE FEMALE DRIVER TO OPEN THE DRIVERâS SIDE DOOR AND BEGIN TO EXIT THE VEHICLE. I GAVE THE FEMALE DRIVER VERBAL COMMANDS TO SHUT THE DOOR AND REMAIN INSIDE HER VEHICLE. THE FEMALE DID NOT LISTEN TO ANY OF THE COMMANDS THAT I GAVE HER, AND BEGAN WALKING TO THE SIDE OF RESIDENCE AT THAT LOCATION. AT THAT TIME, I GRABBED THE FEMALEâS LEFT WRIST, PERFORMED AN ESCORT AND GAVE HER A VERBAL COMMAND TO STAY AT MY LOCATION AND NOT TO LEAVE. THE FEMALE DRIVER THEN BEGAN ACTIVELY RESISTING BY PULLING AWAY AND SPINNING AROUND IN AN ATTEMPT TO BREAK MY GRIP. WHILE MAINTAINING CONTROL OF THE DRIVER, I PLACED HER AGAINST THE DRIVERâS DOOR WHERE SHE CONTINUED IN HER ATTEMPTS TO GET FREE. I THEN REQUESTED BACK UP TO RESPOND TO MY LOCATION, WHERE DEPUTY TULLY (1342) ARRIVED SHORTLY AFTER. UPON HIS ARRIVAL, WE WERE ABLE TO DETAIN THE DRIVER, AT WHICH TIME SHE WAS HANDCUFFED BEHIND HER BACK (DOUBLE LOCKED) WHILE SPEAKING WITH THE FEMALE SUBJECT, I COULD SMELL THE STRONG ODOR OF ALCOHOL EMITTING FROM HER PERSON. WHEN ASKED IF SHE HAD BEEN DRINKING, SHE WOULD NOT ANSWER. I THEN ASKED HER TO SUBMIT TO FIELD SOBRIETY TESTS, TO WHICH SHE AGAIN REFUSED TO ANSWER. AT THAT TIME, THE DRIVER WAS PLACED IN THE REAR SEAT OF DEPUTY TULLYâS PATROL VEHICLE WHILE I RAN HER INFORMATION THROUGH THE ââDAVIDââ SYSTEM. THIS REVEALED THAT THE DRIVERâS LICENSE HAD BEEN SUSPENDED/REVOKED SINCE 2012. AT THAT TIME, IT WAS DETERMINED THAT THE ADDRESS THE DRIVER PULLED INTO WAS HER BOYFRIENDâS RESIDENCE, WHO IS THE OWNER OF THE BRONCO VEHICLE SHE WAS DRIVING. DEPUTY TULLY THEN TRANSPORTED THE FEMALE DRIVER, IDENTIFIED THROUGH THE ââDAVIDââ SYSTEM AS MS NICOLE WELLMAN/DEFENDANT, TO THE CITRUS COUNTY DETENTION FACILITY. THE BRONCO VEHICLE WAS LEFT IN THE POSSESSION OF ITS OWNER. UPON ARRIVAL, THE DEFENDANT WAS TURNED OVER TO DETENTION STAFF FOR BOOKING AND PROCESSING. A ââDUIââ PACKET WAS COMPLETED AND SUBMITTED TO RECORDS FOR INCLUSION IN THIS CASE. THE DEFENDANT REFUSED TO SUBMIT TO THE APPROVED TEST OF HER BREATH. THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION, 019-XTJ(2) FOR DRIVING WHILE UNDER THE INFLUENCE. THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION, A7YPQXE, FOR DRIVING ON THE WRONG SIDE OF THE ROADWAY. THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION, A7YPQYE, FOR DRIVING WHILE LICENSE SUSPENDED. THE DEFENDANTâS BOND WAS SET AT $2,000.00, FOR THE CHARGE OF DUI. THE DEFENDANTâS BOND WAS SET AT $500.00, FOR THE CHARGE OF DWLS. THE DEFENDANTâS BOND WAS SET AT $1,000.00, FOR THE CHARGE OF RESIST WITHOUT VIOLENCE, FOR A TOTAL BOND OF $3,500.00. |
