Probable cause affidavit: SUBMITTED BY: SETTLES, KATHERINE 0113 (AR1520) THE DEFENDANT, MS PATRICIA E VEALY, DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, WALGREENS, TO WIT: A 30 COUNT OVER the COUNTER BOTTLE OF MUCINEX , SAID PROPERTY BEING OF A VALUE OF $27.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTES 812.014(1) and 812.014(3)(a). ON 060812 I RESPONDED TO THE WALGREENS AT 4029 S SUNCOAST BOULEVARD IN HOMOSASSA, IN REFERENCE TO A RETAIL THEFT WHICH HAD ALREADY OCCURRED. UPON MY ARRIVAL I MET WITH the MANAGER, MR ZACHARY FORBES, WHO ADVISED THAT WHILE GOING UP AND DOWN the AISLES, NEAR the PHARMACY, HE NOTICED AN EMPTY BOX OF MUCINEX. HE ADVISED THAT IT HAD NOT BEEN EMPTY ON HIS PASS BEFORE. HE ADVISED THAT HE REVIEWED THE SECURITY VIDEOTAPE FOOTAGE, WHICH SHOWED A FEMALE, LATER IDENTIFIED AS the DEFENDANT, REMOVING the BOX OF MUCINEX from THE SHELF, OPENING IT UP, PLACING the CONTENTS IN A BAG SHE WAS CARRYING, AND THEN PLACED the BOX BACK ON THE SHELF. THE DEFENDANT THEN WALKED DOWN the AISLE AFTER LEAVING the AISLE BRIEFLY, SHE RETURNED BACK TO the BOX TO REMOVE THE PAPER INSTRUCTIONS WHICH SHE ALSO PLACED IN HER BAG. SHE THEN EXITED the STORE, PASSING ALL FINAL POINTS OF SALE, THE COMPLAINANT PROVIDED THIS OFFICER WITH THE DEFENDANT’S IDENTIFICATION, STATING THAT SHE HAS HER PRESCRIPTIONS FILLED THERE FREQUENTLY, AND WAS KNOWN TO THE STAFF AND HIMSELF. MR FORBES PROVIDED A SWORN WRITTEN STATEMENT AS WELL AS A COPY OF THE FOOTAGE ON A DVD, ALONG WITH THE EMPTY MUCINEX BOX. I THEN RESPONDED TO 5714 WEST TICE COURT, WHERE I made CONTACT WITH THE DEFENDANT. AFTER READING HER MIRANDA, SHE ADVISED THAT SHE DID WISH TO SPEAK WITH ME. SHE ASKED WHAT I WAS THERE FOR, AND I ASKED HER IF SHE HAD BEEN AT the WALGREENS IN HOMOSASSA EARLIER THAT DAY, TO WHICH SHE THEN STATED, “YEAH, THIS MUST BE ABOUT ME STEALING THE MUCINEX.” SHE ADVISED THAT SHE HAD GOTTEN CONFUSED IN THE STORE, AND DID NOT THINK SHE HAD ENOUGH MONEY TO PAY FOR the MUCINEX. AT THAT TIME, HER FAMILY MEMBER INFORMED ME THAT THE DEFENDANT HAD HAD A STROKE A FEW WEEKS BEFORE. THE FAMILY MEMBER THEN ASKED THE DEFENDANT WHY SHE DID NOT COME OUT TO THE VEHICLE WHERE THEY WERE WAITING, AND GET MONEY FROM THEM TO COVER THE MUCINEX. SHE STATED AGAIN THAT SHE HAD BEEN CONFUSED AND UNSURE OF WHAT TO DO. I ASKED HER IF SHE STILL HAD THE PILLS FORM THE MUCINEX BOX AND SHE THEN ASKED HER FAMILY MEMBER TO GET HER PILL BOTTLE FROM THE KITCHEN CABINET. SHE HAD PLACED THE REMAINING 27 PILLS IN THE KITCHEN CABINET, MISSING ONLY ONE, WHICH SHE HAD TAKEN EARLIER. THE PILLS WERE TAKEN INTO EVIDENCE, AND THE DEFENDANT SIGNED A PROPERTY RECEIPT FOR THE MEDICATION. THE DEFENDANT WAS ISSUED A NOTICE TO APPEAR (NTA), NUMBER 17187, WITH A COURT DATE OF 062812 AT 1300 HOURS.
