SUBMITTED BY: CLARK, CORRY 0711 (AR13-6200) DID, KNOWING THAT HE DID NOT HAVE A VALID DRIVER'S LICENSE, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE, IN VIOLATION OF FLORIDA STATE STATUTE 322.03(1). ON 062313, AT APPROXIMATELY 1904 HOURS, I OBSERVED A BLUE CHEVROLET PICKUP TRUCK TRAVELING WESTBOUND ON TURNER CAMP ROAD. AS THE VEHICLE PASSED, I OBSERVED BOTH DRIVER AND PASSENGER SIDE WINDOWS WERE DOWN. I OBSERVED A WHITE MALE DRIVER, LATER IDENTIFIED AS THE DEFENDANT, MR PATRICK ROBERTS, DID NOT HAVE A SHIRT ON WHICH ALLOWED ME TO CLEARLY IDENTIFY THAT THE DEFENDANT WAS NOT WEARING A SEATBELT. AT THAT TIME, I GOT BEHIND THE VEHICLE AND I OBSERVED THE PASSENGER SIDE TAILLIGHT TO NOT BE WORKING. I ALSO OBSERVED THE LICENSE PLATE DECAL STICKER TO BE DISPLAYING AN EXPIRATION DATE OF 04-2013. I RAN THE FLORIDA LICENSE PLATE 099NYV AND VERIFIED THAT THE LICENSE PLATE HAD EXPIRED ON 040213, AT WHICH TIME I CONDUCTED A TRAFFIC STOP. I THEN MADE CONTACT WITH THE DEFENDANT, WHO STILL DID NOT HAVE SEATBELT ON AND APPEARED TO BE VERY NERVOUS. I ASKED THE DEFENDANT IF HE KNEW WHY HE WAS BEING PULLED OVER AND HE REPLIED BECAUSE THE TAILLIGHT WAS OUT. I ASKED IF HE KNEW OF ANOTHER REASON WHY HE WAS PULLED OVER AND HE ADMITTED TO NOT HAVING A SEATBELT ON IT. UPON ASKING FOR HIS DRIVER'S LICENSE, THE DEFENDANT ADVISED THAT HE DID NOT HAVE IT. I THEN ASKED IF HE DID NOT HAVE IT ON HIM OR IF HE DID NOT HAVE A LICENSE, AT WHICH TIME HE ADVISED THAT HE HAD NEVER APPLIED FOR A DRIVER'S LICENSE. HE THEN PROVIDED ME WITH THE VEHICLE REGISTRATION, ALONG WITH A CITATION WHICH HAD ALREADY BEEN ISSUED FOR THE EXPIRED LICENSE PLATE. I THEN RAN THE DEFENDANTâS INFORMATION THROUGH âDAVIDâ AND DID NOT LOCATE ANY INFORMATION ON THE DEFENDANT EVER HAVING A DRIVER'S LICENSE. THE DEFENDANT WAS THEN ASKED TO EXIT THE VEHICLE. I THEN READ THE DEFENDANT MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD AND ASKED IF HE UNDERSTOOD HIS RIGHTS, TO WHICH HE REPLIED THAT HE DID. I THEN ASKED HIM IF HE WISHED TO SPEAK WITH ME AT THIS TIME, TO WHICH HE ADVISED THAT HE WOULD. THE DEFENDANT THEN ADMITTED THAT HE HAD RECEIVED NOTICE BY A DEPUTY APPROXIMATELY ONE MONTH AGO AND WAS WARNED NOT TO DRIVE, DUE TO NOT HAVING A DRIVER'S LICENSE. I ASKED THE DEFENDANT IF HE REALIZED THAT HE WAS COMMITTING A CRIMINAL VIOLATION BY DRIVING WITHOUT A LICENSE AND THAT OPERATING A MOTOR VEHICLE WAS A PRIVILEGE, WHERE HE ADMITTED THAT HE KNEW HE WAS NOT SUPPOSED TO DRIVE AND THAT HE COULD GET IN TROUBLE. HE ALSO STATED THAT HE KNEW HE WOULD EVENTUALLY GET CAUGHT. HE ADVISED THAT THIS WAS THE FIRST TIME DRIVING SINCE HAVING CONTACT WITH THAT DEPUTY. I ASKED WHY HE HAD NOT APPLIED FOR A DRIVER'S LICENSE OR IDENTIFICATION CARD AND HE ADVISED THAT HE WAS LAZY. THE DEFENDANT WAS PLACED UNDER ARREST FOR DRIVING WITH NO FLORIDA DRIVER'S LICENSE. HE WAS HANDCUFFED, (DOUBLE LOCKED), BEHIND THEIR BACK, SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING, WHERE THE DEFENDANT'S BOND WAS SET AT $150.00, PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED CRIMINAL UNIFORM TRAFFIC CITATION 6725GQFX FOR DRIVING WITHOUT VALID DRIVER'S LICENSE, WITH A MANDATORY COURT DATE OF 071813 AT 1300 HOURS, AT THE CITRUS COUNTY COURTHOUSE. DEPUTY CULBERTSON REMAINED ON SCENE WITH THE VEHICLE AND ARRANGEMENTS WERE MADE with THE OWNER OF THE VEHICLE TO RESPOND AND PICK THE VEHICLE UP FROM THE SCENE. |
