Probable cause affidavit: SUBMITTED BY: MENDIGUTIA, RICARDO 0529 (AR08105525) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WAL-MART, TO WIT: NAILENE NAIL POLISH ($5.88), BANGLE ($6.00), HORSE CPT BODY PIERCING ($7.00), HOT SILVER BODY PIERCING ($10.00), FOUR KIT EYE SHADOW ($5.16), COV THREE KIT ($4.58), ONE TANK TABLET ($3.12), NAIL KIT ($5.67), FEMALE EYELASHES ($3.43), TWO SHMG NAIL POLISH ($8.16), NICOLE OPI NAIL POLISH ($6.64), SHMN CLEAR NAIL POLISH ($3.74) AND NAIL POLISH ($2.97) CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE WAL-MART, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015(8)(A), 812.014(1), AND 812.014(3)(A). ON 100208 AT APPROXIMATELY 1425 HOURS, I RESPONDED TO 2461 EAST GULF TO LAKE HIGHWAY (SUPER WAL-MART), IN REFERENCE TO SHOPLIFTERS. UPON ARRIVAL, I MADE CONTACT WITH LOSS PREVENTION OFFICER, MR TIMOTHY MCINTOSH. MR MCINTOSH ADVISED THAT HE WAS WALKING THE FLOOR BY JEWELRY WHEN HE NOTICED THE DEFENDANT, MS RONDA BERNALDO, AND CO-DEFENDANT, MS CHERYL WOOD, SELECTING A LARGE AMOUNT OF JEWELRY. MR MCINTOSH THEN BEGAN TO CONDUCT SURVEILLANCE ON THE DEFENDANTS AS THEY HEADED TOWARDS THE PURSE AISLE. ONCE IN THE PURSE AISLE, THE DEFENDANT BEGAN TO TAKE THE TAGS OFF OF THE JEWELRY AND PUT BRACELETS ON HER ARM. THE DEFENDANT THEN HANDED THE TAGS TO THE CO-DEFENDANT, WHO THEN PLACED THE PRICE TAGS BACK ON THE SHELF. THE DEFENDANT THEN PLACED ITEMS INSIDE HER PURSE, THEN WALKED AROUND THE GROCERY SECTION, BEFORE GOING TO THE SELF CHECK-OUT ON THE GROCERY SIDE AND PAYING FOR THE REST OF THE ITEMS THAT WERE IN THE GROCERY CART. THE DEFENDANT THEN EXITED THROUGH THE GENERAL MERCHANDISE, PASSING ALL THE REGISTERS WITHOUT MAKING AN ATTEMPT TO PAY FOR THE ITEMS IN THE PURSE. AT THAT TIME, MR MCINTOSH APPROACHED THE DEFENDANTS AS THEY WALKED OUTSIDE THE STORE. THE DEFENDANTS WERE THEN ESCORTED BACK TO THE SECURITY OFFICE, WHERE THIS AGENCY WAS THEN CONTACTED. THIS DEPUTY ASKED THE DEFENDANT IF SHE HAD ANY MONEY IN HER PURSE AND SHE HAD APPROXIMATELY $10.00 IN HER PURSE. WHEN I ASKED HER WHY SHE REMOVED THE PROPERTY WITHOUT PAYING, SHE ADVISED BECAUSE SHE IS "STUPID" AND SHE MADE A MISTAKE. THE CO-DEFENDANT STATED SHE DID NOT DO ANYTHING AND DID NOT UNDERSTAND WHY SHE WAS BEING ARRESTED. WHEN I ADVISED THE CO-DEFENDANT SHE WAS OBSERVED TAKING THE TAGS FROM THE DEFENDANT AND PUTTING THEM BACK ON THE SHELF, SHE ADVISED SHE ONLY DID THAT TWO TIMES AND DID NOT UNDERSTAND WHY SHE WAS BEING ARRESTED. THE DEFENDANT SHOWED NO SIGNS OF REMORSE. SHE WAS PLAYING WITH A BABY THAT WAS IN THE OFFICE AND LAUGHING WITH STORE SECURITY PERSONNEL. THE CO-DEFENDANT WAS VISIBLY UPSET AND CRYING, BUT KEPT COMPLAINING SHE DID NOT UNDERSTAND WHY SHE WAS BEING ARRESTED BECAUSE SHE HAD NOT DONE ANYTHING. BOTH DEFENDANTS WERE PLACED UNDER ARREST AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. MR MCINTOSH PROVIDED A WRITTEN STATEMENT. A PROPERTY RECEIPT WAS FILLED OUT AND THE MERCHANDISE WAS TURNED BACK OVER TO WAL-MART. MR MCINTOSH WAS PROVIDED WITH A COPY OF THE PROPERTY RECEIPT. BOTH DEFENDANTS' BONDS WERE SET AT $500.00 PER THE BOND SCHEDULE. *NOT-EXEMPT*
