Probable cause affidavit: SUBMITTED BY: LAKATIS, KENNETH 0585 (AR09111161) UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION CONTROLLED SUBSTANCES, TO WIT: SIX HYDROCODONE 500 MILLIGRAM PILLS, NINE CARISOPRODOL 350 MILLIGRAM PILLS, NINE ALPRAZOLAM 1 MILLIGRAM PILL AND ONE OXYCODONE 30 MILLIGRAM PILL, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 092509 AT APPROXIMATELY 1935 HOURS, I ARRIVED AS BACKUP FOR CANINE DEPUTY TACKETT WHO HAD PULLED OVER A WHITE NISSAN PICKUP TRUCK AT THE INTERSECTION OF WEST BALLOON LANE AND CRYSTAL STREET IN CRYSTAL RIVER IN REFERENCE TO AN EXPIRED TAG. PRIOR TO APPROACHING THE VEHICLE, CANINE DEPUTY TACKETT ADVISED THAT THE DRIVER OF THE VEHICLE, MR A J WATSON, SEEMED EXTREMELY NERVOUS AND JITTERY. I APPROACHED THE VEHICLE AND MADE CONTACT WITH THE DRIVER, MR WATSON, AND ASKED HIM WHY HE WAS SO NERVOUS. HE ADVISED HE WAS NERVOUS because HE HAD NOT BEEN PULLED OVER IN SEVERAL YEARS. AS I CONTINUED TO CONVERSE WITH MR WATSON, I ASKED IF THERE WERE ANY ILLEGAL WEAPONS OR NARCOTICS IN HIS VEHICLE, TO WHICH HE STATED NO. HOWEVER, HE CONTINUED TO BE NERVOUS AND JITTERY. MR WATSON WAS ALSO VERY ANIMATED, USING HIS HANDS, ASKING SEVERAL TIMES IF HE COULD LEAVE. I MADE CONTACT WITH CANINE DEPUTY TACKETT AND ADVISED HIM I BELIEVED MR WATSON MIGHT BE CONCEALING something IN THE VEHICLE. AT THAT TIME, MR WATSON WAS ADVISED TO ROLL UP HIS WINDOW AND SHUT THE VEHICLE OFF SO CANINE DEPUTY TACKETT COULD DEPLOY HIS CANINE AROUND THE VEHICLE FOR THE POSSIBLE PRESENCE OF NARCOTICS. AS CANINE DEPUTY TACKETT WALKED HIS CANINE AROUND THE VEHICLE, HIS CANINE DID ALERT TO THE POSSIBLE PRESENCE OF NARCOTICS ON THE PASSENGER SIDE. CANINE DEPUTY TACKETT SECURED HIS CANINE AND MR WATSON WAS ASKED TO STEP OUT OF HIS VEHICLE. ONCE OUTSIDE THE VEHICLE, I ADVISED MR WATSON THAT THE CANINE HAD ALERTED AND ASKED IF THERE WERE ANY ILLEGAL NARCOTICS IN THE VEHICLE, TO WHICH HE AGAIN STATED NO. WHILE SPEAKING WITH MR WATSON AND, IN AN ATTEMPT TO GIVE HIM AMPLE OPPORTUNITY TO DISCLOSE IF THERE WERE ILLEGAL NARCOTICS IN THE VEHICLE, HE BECAME MORE NERVOUS AND DID NOT WANT TO STAND STILL. BELIEVING THAT MR WATSON WOULD ATTEMPT TO FLEE OR ATTEMPT TO DESTROY POSSIBLE EVIDENCE, I SECURED HIM IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK AND ADVISED HIM HE WAS BEING DETAINED UNTIL A SEARCH OF HIS VEHICLE COULD BE CONDUCTED. AS I DID A CURSORY SEARCH OF HIS POCKETS, A SMALL WHITE PILL FELL OUT ON TO THE GROUND. THIS PILL WAS LATER IDENTIFIED AS CARISOPRODOL. I PICKED UP THE PILL AND AGAIN ASKED MR WATSON IF THERE WAS ANYTHING ILLEGAL IN THE VEHICLE. HE CONTINUED TO DENY THERE WAS ANYTHING ILLEGAL EITHER IN HIS VEHICLE OR ON HIS PERSON. CANINE DEPUTY TACKETT AND I THEN CONDUCTED A SEARCH OF THE VEHICLE, AT WHICH TIME I DISCOVERED SIX BLUE PILLS WRAPPED IN A PLASTIC BAG, TIED IN A KNOT, WHICH WERE LATER IDENTIFIED AS HYDROCODONE. CANINE DEPUTY TACKETT DISCOVERED TEN BLUE PILLS WHICH WERE LATER IDENTIFIED AS ALPROZOLAM AS WELL AS OXYCODONE MIXED IN A BOTTLE OF ALEVE. WHEN WE DUMPED THE CONTENTS OF THE BOTTLE OUT, WE DISCOVERED EIGHT MORE CARISOPRODOL PILLS. AT THAT TIME, MR WATSON WAS PLACED UNDER ARREST FOR POSSESSION OF CONTROLLED SUBSTANCES. HE WAS READ HIS MIRANDA WARNINGS VIA AGENCY ISSUED CARD, TO WHICH HE STATED HE UNDERSTOOD HIS RIGHTS AND AGREED TO SPEAK WITH ME. I ASKED HIM IF HE HAD ANY PRESCRIPTIONS FOR THE NARCOTICS LOCATED IN HIS VEHICLE, TO WHICH HE ADVISED NO; HOWEVER, CLAIMED THAT HE HAD SHOULDER SURGERY AND DID HAVE A PRESCRIPTION FOR SOME OF THE NARCOTICS APPROXIMATELY SIX MONTHS AGO. THE DEFENDANT WAS SECURED IN THE REAR SEAT OF DEPUTY FERGUSON'S PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. I ARRIVED SHORTLY AFTER AND CHARGED THE DEFENDANT WITH FOUR COUNTS OF POSSESSION OF CONTROLLED SUBSTANCES. HIS BOND WAS SET AT A TOTAL OF $8,000.00, PER THE BOND SCHEDULE. *NOT-EXEMPT*
