Probable cause affidavit: SUBMITTED BY: ENTREKIN, GREGORY 1245 (AR14-11161) (14-95569) DID UNLAWFULLY AND FELONIOUSLY SELL, MANUFACTURE OR DELIVER OR POSSESS WITH INTENT TO SELL, MANUFACTURE OR DELIVER OR CAUSE TO BE SOLD, MANUFACTURED OR DELIVERED TO ANOTHER PERSON, A CONTROLLED SUBSTANCE, TO-WIT: 22 HYDROMORPHONE/HYDROCHLORIDE, 8 MILLIGRAM (MG) PILLS AND 24 MORPHINE SULFATE, 100MG PILLS, IN VIOLATION OF FLORIDA STATUTES 893.135, AND 893.13(1)(A)(C) AND 893.03(D)(E), AND \tdid, knowing HIS driver's license or driving privilege had been cancelled, suspended or revoked AS A HABITUAL TRAFFIC OFFENDER, drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute 322.34(5) DID OPERATE A VEHICLE IN THE STATE OF FLORIDA AND, HAVING KNOWLEDGE THAT HE HAD BEEN DIRECTED TO STOP SUCH VEHICLE BY A DULY AUTHORIZED LAW ENFORCEMENT OFFICER, DID WILLFULLY REFUSE OR FAIL TO STOP SUCH VEHICLE IN COMPLIANCE WITH SUCH DIRECTIVE, IN VIOLATION OF FLORIDA STATE STATUTE 316.1935(5). ON 071214, WHILE REFUELING MY AGENCY ISSUED PATROL VEHICLE AT THE CIRCLE K AT THE INTERSECTION OF WEST CARDINAL STREET AND SOUTH SUNCOAST BOULEVARD, I OBSERVED MR AARON SMITH, LATER IDENTIFIED AS THE DEFENDANT, WHO I AM FAMILIAR WITH DUE TO PRIOR INCIDENTS, EXIT THE STORE AND APPROACH A SILVER IN COLOR CHEVROLET CAVALIER, BEARING FLORIDA LICENSE PLATE 375XTD, NEAR THE VACUUM STATION. AT THAT TIME, THE DEFENDANT ENTERED THE DRIVER SEAT OF THE VEHICLE AND RELOCATED the VEHICLE TO A PARKING SPOT IN FRONT OF THE STORE. AT that TIME, the DEFENDANT ENTERED the STORE ONCE AGAIN. I AM FAMILIAR WITH the DEFENDANT NOT HAVING A VALID DRIVER'S LICENSE AND WHILE HE WAS INSIDE OF THE STORE I VERIFIED that HIS DRIVING STATUS WAS STILL SUSPENDED THROUGH NCIC/FCIC AND THE DRIVER AND VEHICLE INFORMATION DATABASE. BOTH CHECKS CONFIRMED THAT the DEFENDANT'S DRIVING PRIVILEGES WERE STILL SUSPENDED. THE DEFENDANT THEN EXITED THE STORE AND GOT INTO THE DRIVER SEAT OF THE VEHICLE AND BEGAN OPERATING the VEHICLE. THE DEFENDANT EXITED THE GAS STATION PARKING LOT ONTO SUNCOAST BOULEVARD. AT THAT TIME, I CONDUCTED A TRAFFIC STOP ON the AFOREMENTIONED VEHICLE, WHICH WAS OPERATED BY THE DEFENDANT. the DEFENDANT'S VEHICLE CAME TO A STOP AT THE INTERSECTION OF SOUTH OAKRIDGE DRIVE AND SOUTH SUNCOAST BOULEVARD IN the PARKING LOT OF SUNNY DAYS PLAZA. AS THIS DEPUTY APPROACHED the DEFENDANT'S VEHICLE, THE DEFENDANT THEN FLED THE SCENE AT A HIGH RATE OF SPEED. I THEN NOTIFIED DISPATCH THAT THE DEFENDANT FLED FROM MY TRAFFIC STOP AND THAT I WAS INITIATING A VEHICLE PURSUIT. MY OVERHEAD EMERGENCY LIGHTS AND SIRENS WERE ACTIVATED AS I FOLLOWED BEHIND THE DEFENDANT'S VEHICLE. AS I WAS PURSUING THE VEHICLE, THE DEFENDANT WAS CUTTING IN AND OUT OF TRAFFIC WITH NO REGARD FOR OTHER DRIVERS' SAFETY. THE DEFENDANT FLED NORTH ON SOUTH SUNCOAST BOULEVARD AND QUICKLY MADE AN ABRUPT RIGHT HAND TURN ONTO WEST GREEN ACRES STREET WHERE THE DEFENDANT PASSED A VEHICLE TRAVELING EASTBOUND IN A NON-PASSING ZONE. THE DEFENDANT THEN CUT IN FRONT OF A VEHICLE TURNING NORTH ON SOUTH LEGEND DRIVE. AFTER TRAVELING ON SOUTH LEGEND DRIVE, the VEHICLE CAME TO A STOP JUST BEFORE THE INTERSECTION OF SOUTH ARROWHEAD DRIVE. AT THAT TIME, THIS DEPUTY, ALONG WITH DEPUTY B HESSE, APPROACHED the VEHICLE AND BEGAN GIVING COMMANDS TO the DEFENDANT TO EXIT the VEHICLE. AS THE DEFENDANT EXITED THE VEHICLE, HE WAS SECURED IN HANDCUFFS BY DEPUTY B HESSE, AS I MAINTAINED COVER ON THE VEHICLE. I THEN BEGAN GIVING COMMANDS TO the FRONT SEAT PASSENGER, IDENTIFIED AS DEFENDANT, MS PATRICIA HALL, TO EXIT THE VEHICLE, AT WHICH TIME SHE WAS SECURED IN HANDCUFFS BY THIS DEPUTY. AT THAT TIME, DEPUTY SEFFERN JR, DEPUTY VIGGIANO AND SERGEANT FASS ARRIVED ON SCENE. DEPUTY VIGGIANO DEPLOYED HIS CANINE CO-PARTNER CONAN TO CONDUCT AN EXTERIOR SNIFF OF THE VEHICLE FOR NARCOTICS. DEPUTY VIGGIANO AND HIS CO-PARTNER BEGAN AT the CENTER OF THE REAR BUMPER AND PROCEEDED IN A COUNTERCLOCKWISE ROTATION. CANINE CONAN ALERTED ON the FRONT PASSENGER SIDE DOOR AND THE FRONT DRIVER SIDE DOOR. AT THAT TIME, DEPUTY SEFFERN JR AND DEPUTY VIGGIANO BEGAN A SEARCH OF THE VEHICLE. HOWEVER, NO NARCOTICS WERE LOCATED OTHER THAN MULTIPLE HYPODERMIC NEEDLES THAT DID NOT APPEAR TO HAVE BEEN USED. DEFENDANT SMITH HAD SIX INDIVIDUAL BUNDLES OF MONEY INSIDE OF HIS WALLET THAT THROUGH MY TRAINING AND EXPERIENCE I could IDENTIFY AS BEING BUNDLED FROM INDIVIDUAL NARCOTIC TRANSACTIONS. ONE BUNDLE CONTAINED $200.00, THE SECOND BUNDLE CONTAINED $86.00, THE THIRD BUNDLE CONTAINED $500.00, THE FOURTH BUNDLE CONTAINED $1,000.00, THE FIFTH BUNDLE CONTAINED $350.00 AND THE SIXTH BUNDLE CONTAINED $256.00. DEFENDANT SMITH AND DEFENDANT HALL WERE SEPARATED AND READ THEIR MIRANDA WARNINGS VIA A PREPRINTED AGENCY ISSUED MIRANDA CARD. UPON READING THE DEFENDANTS' THEIR RIGHTS, THEY BOTH ACKNOWLEDGED THAT THEY UNDERSTOOD THEIR RIGHTS AND WISHED TO SPEAK WITH US. DEPUTY B HESSE INTERVIEWED DEFENDANT HALL ABOUT HER INVOLVEMENT IN THE VEHICLE PURSUIT. DEFENDANT HALL ADVISED THAT WHILE AT the CIRCLE K GAS STATION, SHE AND DEFENDANT SMITH NOTICED A DEPUTY SHERIFF WATCHING THEM AND BELIEVED THEY WERE going TO BE STOPPED UPON LEAVING THE GAS STATION. SHE ADVISED THAT THEY WERE BOTH USING NARCOTICS AND DEFENDANT SMITH HAD SOME PRESCRIPTION NARCOTICS IN HIS POSSESSION. SHE STATED PRIOR TO LEAVING THE GAS STATION, DEFENDANT SMITH TOLD HER TO CONCEAL THE PILLS IN HER VAGINA IN CASE THEY GOT STOPPED. SHE STATED THAT SHE THEN STUFFED A SMALL BOTTLE CONTAINING THE NARCOTICS INSIDE OF HER VAGINA. SERGEANT FASS WAS NOTIFIED OF THIS INFORMATION LEARNED FROM DEFENDANT HALL, AT WHICH TIME SERGEANT FASS REQUESTED DEPUTY VENTIMIGLIA TO RESPOND TO the SCENE TO SEARCH DEFENDANT HALL. UPON DEPUTY VENTIMIGLIA'S ARRIVAL ON SCENE, SHE MADE CONTACT WITH THE DEFENDANT. DEFENDANT HALL CONFIRMED THAT SHE DID HAVE A BOTTLE CONTAINING NARCOTICS INSIDE OF HER VAGINA AND SHE would REMOVE IT FROM HER VAGINA FOR DEPUTY VENTIMIGLIA. AT THAT TIME, THE DEFENDANT REMOVED A SMALL WHITE PLASTIC TUBE FROM INSIDE OF HER VAGINA WITHOUT EXPOSING HERSELF OR REMOVING ANY CLOTHING. SHE THEN HANDED IT TO DEPUTY VENTIMIGLIA WHO THEN TURNED IT OVER TO DEPUTY SEFFERN JR. DEFENDANT HALL THEN COMPLETED A SWORN WRITTEN STATEMENT ATTESTING TO WHAT HAD OCCURRED AND WHY SHE CONCEAL THE NARCOTICS INSIDE HER VAGINA. THE PLASTIC TUBE RECOVERED FROM the DEFENDANT'S HALLS VAGINA CONTAINED 22 – 8MG HYDROMORPHONE/HYDROCHLORIDE PILLS THAT WERE WHITE THREE SIDE PILLS WITH THE SCORE "TP8". IT ALSO CONTAINED 24 – 100MG MORPHINE SULFATE PILLS THAT WERE ROUND AND GRAY WITH THE SCORE "ABG100". THE NARCOTICS WERE WEIGHED AND TOTALED 7.3 GRAMS. AT that TIME, DEFENDANT SMITH AND DEFENDANT HALL WERE SECURED TOGETHER IN THE REAR SEAT OF DEPUTY SEFFERN JR'S PATROL VEHICLE. DEPUTY SEFFERN JR'S VEHICLE HAD A DIGITAL RECORDER INSIDE TO RECORD THE CONVERSATION BETWEEN THE DEFENDANTS. UPON SECURING BOTH DEFENDANTS TOGETHER, DEFENDANT SMITH AT ONE POINT ASKED DEFENDANT HALL TO REMOVE THE NARCOTICS FROM INSIDE OF HER VAGINA. UPON DEFENDANT SMITH LEARNING THAT WE HAD RECOVERED THE NARCOTICS FROM DEFENDANT HALL'S VAGINA, HE STATED "OH MY GOD, ARE YOU FUCKING SERIOUS?" DEFENDANT HALL THEN BEGAN SPEAKING OF BEING CHARGED WITH TRAFFICKING IN THE NARCOTICS, AT WHICH TIME DEFENDANT SMITH STATED "THERE ARE TWO TYPES OF PILL" AND DEFENDANT HALL STATED "YES AND THEY HAVE TO BE WEIGHED SEPARATELY". A COPY OF THE DIGITALLY RECORDED CONVERSATION WAS SUBMITTED INTO EVIDENCE AND SENT TO the STATE ATTORNEY'S OFFICE. DEFENDANT SMITH HAS NO JOB AND could NOT PROVE WHERE HIS CURRENCY CAME FROM. DEFENDANT SMITH HAS AN EXTENSIVE NARCOTICS HISTORY AND HAS A PREVIOUS CASE PENDING WHERE HE REQUESTED A FEMALE SUBJECT TO CONCEAL HIS NARCOTICS INSIDE OF HER VAGINA. IT HAS ALSO BEEN DOCUMENTED THAT HE IS INVOLVED WITH SEVERAL DOCTOR SPONSORING NARCOTIC RINGS, WHICH IS CONSISTENT WITH THE AMOUNT OF CURRENCY AND NARCOTICS THAT WERE IN HIS AND DEFENDANT HALL'S POSSESSION. NEITHER DEFENDANT HAS A PRESCRIPTION FOR the SUBSTANCES. the AMOUNT OF PILLS THAT THEY POSSESSED IS NOT A COMMON AMOUNT FOR A USER OF THE NARCOTICS TO POSSESS WITHOUT A PRESCRIPTION. THE AMOUNT POSSESSED IS AN AMOUNT THAT A SUBJECT SELLING THE NARCOTICS WOULD POSSESS, ALONG WITH the AMOUNT OF CURRENCY AT THE SAME TIME. A CITRUS COUNTY SHERIFF'S OFFICE SEIZURE DOCUMENT WAS COMPLETED FOR THE SEIZURE OF THE U S CURRENCY POSSESSED BY DEFENDANT SMITH, WHICH WAS LATER SUBMITTED TO THE SHERIFF'S OFFICE ADMINISTRATION DEPARTMENT. DEFENDANT SMITH'S VEHICLE WAS TOWED FROM THE SCENE BY DAVE'S AUTO BODY TOWING. AT that TIME BOTH DEFENDANTS WERE TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL AT THE DETENTION FACILITY, DEFENDANT SMITH WAS CHARGED WITH ONE COUNT OF DRIVING WHILE LICENSE SUSPENDED/REVOKED HABITUAL, ONE COUNT OF FLEEING AND ELUDING LAW ENFORCEMENT, AND ONE COUNT OF TRAFFICKING IN MORPHINE, OPIUM, OXYCODONE, HYDROCODONE, HYDROMORPHONE, SALT, OR ITS DERIVATIVES ("ILLEGAL DRUGS", MORE THAN 4 GRAMS), WITH A TOTAL BOND OF $37,000.00.
