Probable cause affidavit: SUBMITTED BY: SCHAFFER, HEATH 0652 (AR14-9635) IT IS UNLAWFUL FOR ANY PERSON TO ACQUIRE OR OBTAIN OR ATTEMPT TO ACQUIRE OR OBTAIN POSSESSION OF A CONTROLLED SUBSTANCE BY MISREPRESENTATION, FRAUD, FORGERY, DECEPTION OR SUBTERFUGE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(7)(A)9. ON 032514, DEPUTY REEVES AND I WERE ADVISED THAT OUR AGENCY HAD BEEN CONTACTED ABOUT A PRESCRIPTION FRAUD THAT WAS BEING COMMITTED BY THE DEFENDANT, MR ADAM THORTON. WE WERE ADVISED THAT CONTACT HAD ALREADY BEEN MADE WITH DOCTOR CORBETT ABOUT THIS MATTER AND HE ADVISED THAT HE DID NOT SIGN THE FRAUDULENT PRESCRIPTIONS THAT WERE BEING FAXED BY THE DEFENDANT. WE THEN RESPONDED TO THE WINN DIXIE PHARMACY LOCATED AT 3729 SOUTH SUNCOAST BOULEVARD IN HOMOSASSA, WHERE THE PRESCRIPTIONS WERE BEING PASSED AND FILLED FOR HYDROCODONE 5-325 MILLIGRAMS. CONTACT WAS MADE THE PHARMACIST, WHO ADVISED THAT THEY WERE NOTIFIED BY DOCTOR CORBETT’S OFFICE AND THEY SUSPECTED THAT THE DEFENDANT WAS PASSING FRAUDULENT PRESCRIPTIONS AT THEIR PHARMACY. THEY ALSO ADVISED THAT THE PERSON THAT THEY SUSPECTED WAS AN EMPLOYEE OF THEIR DOCTOR’S OFFICE AND WORKED IN THE RECEPTION AREA. AFTER NOTIFICATION OF THE FRAUD, THE PHARMACIST ADVISED THAT THEY RECEIVED A FAXED IN PRESCRIPTION FOR THE DEFENDANT, AT WHICH TIME THEY CONTACTED THIS AGENCY. THE PHARMACIST ALSO PROVIDED US WITH A COPY OF A PRIOR PRESCRIPTION FOR MS SARAH MESSINA THAT WAS CALLED IN BY THE DEFENDANT, WHICH THE PHARMACIST THOUGHT TO BE SUSPICIOUS. THE PHARMACIST FILLED OUT A SWORN WRITTEN STATEMENT ABOUT THEIR INVOLVEMENT THAT WAS COLLECTED AND WILL LATER BE TURNED IN TO RECORDS. DEPUTY REEVES AND I THEN RESPONDED TO DOCTOR CORBETT’S OFFICE LOCATE4D AT 521 SOUTHEAST FORT ISLAND TRAIL IN CRYSTAL RIVER, TO MAKE CONTACT WITH THE DEFENDANT. THE DEFENDANT WAS THEN ASKED TO STEP OUTSIDE WITH US SO THAT WE COULD SPEAK TO HIM. I THEN READ THE DEFENDANT HIS MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD AND ASKED IF HE UNDERSTOOD HIS RIGHTS, TO WHICH HE REPLIED THAT HE UNDERSTOOD EACH OF THEM AND HE WOULD SPEAK TO US. A DIGITALLY RECORDED INTERVIEW WAS CONDUCTED AND HE WAS QUESTIONED ABOUT THE FRAUDULENT PRESCRIPTION. AFTER FIRST DENYING THE ALLEGATIONS OF FRAUD, HE LATER ADMITTED TO FAXING IN A PRESCRIPTION OF HYDROCODONE 5-325 MILLIGRAMS, TO THE WINN DIXIE AND HAVING DOCTOR CORBETT SIGN THE PRESCRIPTION WITHOUT THE DOCTOR KNOWING THAT IT WAS FOR HIM. THE DEFENDANT ADVISED THAT HE CONCEALED THE PRESCRIPTION IN WITH SEVERAL OTHER PATIENTS’ PRESCRIPTIONS TO OBTAIN THE DOCTOR’S SIGNATURE. THE DEFENDANT WAS THEN QUESTIONED ABOUT THE PRESCRIPTION THAT WAS CALLED INTO THE SAME PHARMACY FOR MS MESSINA FOR THE SAME TYPE OF MEDICATION. HE ADVISED THAT MS MESSINA WAS HIS GIRLFRIEND AND HAD BEEN FOR APPROXIMATELY ONE YEAR. HE FURTHER ADVISED THAT HE USED HER NAME AND INFORMATION TO OBTAIN A FRAUDULENT PRESCRIPTION. HE ADVISED THAT MS MESSINA WAS NEVER A PATIENT AT DOCTOR CORBETT’S OFFICE AND WAS NEVER PRESCRIBED THAT MEDICATION. AT THIS SAME TIME, THE DEFENDANT ADVISED THAT HE ALSO CALLED IN A PRESCRIPTION FOR MS MESSINA FOR AZITHROMYCIN 250 MILLIGRAMS, WHICH IS AN ANTIBIOTIC THAT HE GAVE TO MS MESSINA FOR A COLD THAT SHE HAD. AFTER SPEAKING TO THE OFFICE STAFF, THEY PROVIDED OFFICE RECORDS SHOWING THE TRANSACTIONS THAT THE DEFENDANT ENTERED, RECORDING EACH TIME THE DEFENDANT CALLED OR FAXED IN A PRESCRIPTION. IN THE RECORDS IT SHOWS THAT ON 021814, THE DEFENDANT FAXED IN A PRESCRIPTION FOR HYDROCODONE 5-325 MILLIGRAMS FOR A MR GARY THORTON, WHO IS THE DEFENDANT’S FATHER. IT WAS ADVISED THAT GARY WAS NEVER PRESCRIBED THAT MEDICATION BY DOCTOR CORBETT. THE DEFENDANT WAS QUESTIONED ABOUT THIS INCIDENT AND HE ADVISED THAT HE ADDED THAT MEDICATION TO HIS FATHER’S CHART AND THEN FAXED IN THE PRESCRIPTION, WHICH HE LATER WENT TO WINN DIXIE TO PURCHASE FOR HIMSELF. THE DEFENDANT AND DOCTOR CORBETT FILLED OUT SWORN WRITTEN STATEMENTS THAT WERE COLLECTED AND WILL LATER BE TURNED IN TO RECORDS. THE DEFENDANT WAS THEN ASKED IF WE COULD SEARCH HIS VEHICLE WHICH WAS IN THE PARKING LOT OF THE DOCTOR’S OFFICE PLAZA, AND HE ADVISED THAT WE COULD. INSIDE OF THE DEFENDANT’S VEHICLE WE LOCATED A PRESCRIPTION RECEIPT FOR MS MESSINA FOR THE HYDROCODONE AND AZITHROMYCIN. THE DEFENDANT WAS THEN PLACED UNDER ARREST, HANDCUFFED, (DOUBLE LOCKED), BEHIND HIS BACK, SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT WAS CHARGED WITH THREE COUNTS OF OBTAINING A CONTROLLED SUBSTANCE BY FRAUD, WITH A BOND OF $5,000.00 PER COUNT FOR A TOTAL BOND SET AT$15,000.00, PER THE BOND SCHEDULE.
