SUBMITTED BY: STOKES, ERIC 0736 (AR1200189) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO WIT: MS RANDI LIVENGOOD, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: $1,200.00 WORTH OF COPPER WIRE, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTE 812.014(2)(C)(1). On 030212, I was dispatched to 7355 sOUTH Rudolph pOINT in homosassa in reference to a Grand theft. When I Arrived, I made contact with the victim, who told me that on todayâs date, at an earlier time, both suspects had come to her RESIDENCE to inquire about the large amount of RECYCLABLE metal that was in the backyard. She said that she advised the suspects that they could not have the copper, and the suSpects left. She said that toniGHT while she was at her Motherâs RESIDENCE, WHICH is located just south of her residence, she saw a vehicle traveling south down rudolph POINT, and drive just past her RESIDENCE, and then back up and pull into her driveway. She said she saw the trunk open, and a man was walking back and forth from her backyard to the vehicle. she then said that she and her mother got into a truck and drove up to her RESIDENCE. She told me she saw both suspects in the vehicle and the trunk was slightly opened, so she walked over to it and saw her RECYCLABLE metal, that was previously in her backyard, inside. The victim told me that the copper was worth approximately $1,200.00. I then spoke to the witness who told me that on todayâs date he was at the victimâs motherâs RESIDENCE with the victim and he saw a vehicle Traveling south on rudolph POINT, and drive just past the victimâs residence, and then back into the driveway. He told me that he saw the passenger of the vehicle, LATER IDENTIFIED AS DEFENDANT MR ALAN POMPOSELLO, get out of the VEHICLE and begin to load the victimâs RECYCLABLE metals in the trunk of the VEHICLE. he said he then got into his vehicle and drove to the victimâs residence. He told me that when he arrived at the residence, he saw the victimâs RECYCLABLE metal in the trunk. The witness said the copper was worth approximately $1,200.00. I then spoke to the driver of the vehicle, IDENTIFIED AS DEFENDANT MR ROBERT BASS, who told me that he was taking the passenger, MR ALAN POMPOSELLO, home, and the passenger had told him that he wanted to stop by the victimâs RESIDENCE on rudolph POINT to see something. he said that when they arrived, the passenger got out of the vehicle and began loading the RECYCLABLE metal into the trunk of the vehicle. I then spoke to the passenger of the vehicle, who said that he and the driver had stopped by the victimâs residence, earlier today, and the driver got out to talk to the victim. he said he did nOt know why they had stopped at the victimâs residence. He then said that the driver was taking him home, and drove to the passengerâs RESIDENCE and began loading the RECYCLABLE metal in the vehicle. The passenger then advised me that he was nOt driving so he was nOt guilty. I observed the vehicle to be backed into the driveway of the residence, and the copper was unloaded from the trunk, and sitting directly behind it. Both suspects were placed under arrest and then placed into the rear seat of my patrol vehicle to be transported to the CITRUS COUNTY DETENTION FACILITY. While on the way to the DETENTION FACILITY, the passenger stated that it was nOt a felony, because I was going by how much the victim said the metal was worth. I obtained written statements from the victim, witness and driver. they will be turned in to records Robert told me that the vehicle was PAID for and that he was the registered owner, at which time, the Vehicle was SEIZED and was driven to THE CITRUS COUNTY SHERIFFâS OFFICE (CCSO) impound by Deputy Hughes, who advised me that the low coolant light was on. A Forfeiture notice was given to DEFENDANT ROBERT BASS and a copy was turned in to records All NECESSARY paperwork was completed and turned in to records. |
