SUBMITTED BY: HUGHES, JAMES 0500 (AR16-19649) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN STRUCTURE OR CURTILAGE THEREOF, TO-WIT: THE CITGO GAS STATION LOCATED AT 5890 WEST GULF TO LAKE HWY IN CRYSTAL RIVER, IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF VICTIM, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO-WIT: GRAND THEFT, IN VIOLATION OF FLORIDA STATUTE 810.02(4)(A), AND DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: $5,000.00 IN CASH AND APPROXIMATELY $500.00 IN CIGARETTES, OF THE VALUE OF FIVE THOUSAND DOLLARS ($5000.00) OR MORE, BUT LESS THAN TEN THOUSAND DOLLARS ($10,000.00),WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTE 812.014(2)C(2), AND WHOEVER HAS IN HIS OR HER POSSESSION ANY TOOL, MACHINE OR IMPLEMENT WITH INTENT TO USE THE SAME OR ALLOW THE SAME TO BE USED TO COMMIT ANY BURGLARY OR TRESPASS, SHALL BE GUILTY OF A FELONY OF THE THIRD DEGREE, TO WIT: YELLOW SLEDGE HAMMER, RED BOLT CUTTERS AND TWO PRY TOOLS, IN VIOLATION OF FLORIDA STATE STATUTE 810.06. ON 052916, AT APPROXIMATELY 0330 HOURS, AN ALARM WAS RECEIVED AT THE CITGO GAS STATION LOCATED AT 5980 WEST GULF TO LAKE HIGHWAY IN LECANTO. WITNESSES OBSERVED A WHITE IN COLOR SUPER DUTY TRUCK WHICH WAS RELAYED TO THE RESPONDING DEPUTY. THE RESPONDING DEPUTY HAD PUT OUT A BOLO VIA RADIO TO SURROUNDING DEPUTIES. DEPUTY SANCHEZ (1242) ADVISED THAT WHILE HE WAS BOLOING THE AREA OF HOMOSASSA TRAIL AND WEST GULF TO LAKE HIGHWAY HE HAD OBSERVED A VEHICLE MATCHING THAT DESCRIPTION BEHIND the GAS STATION LOCATED AT THAT INTERSECTION. HE ADVISED THAT HE HAD TURNED HIS MARKED AGENCY ISSUED PATROL VEHICLE AROUND TO GET BEHIND the VEHICLE. HE ADVISED AT THAT TIME HE OBSERVED the TRUCK EXIT FROM THE REAR OF the GAS STATION AND PULL OUT ONTO WEST GULF TO LAKE HIGHWAY AND HEAD EAST. HE ADVISED AT THAT TIME the VEHICLE APPEARED TO INCREASE IN SPEED EXCEEDING the POSTED SPEED LIMIT. HE ADVISED AT THAT TIME HE HAD ACTIVATED HIS EMERGENCY LIGHTS AND SIREN, AT WHICH TIME the VEHICLE CONTINUED TO INCREASE IN SPEED WHILE STILL HEADING EASTBOUND ON WEST GULF TO LAKE HWY. DEPUTY SANCHEZ (1242) ADVISED THAT THE VEHICLE CONTINUED FOR APPROXIMATELY 7.3 MILES UNTIL THE VEHICLE TURNED NORTH ON SOUTH ALLMAN TERRACE AND PULLED INTO A VACANT WOODED LOT. HE ADVISED THAT HE OBSERVED THREE BLACK MALES EXIT THE VEHICLE. HE ADVISED THAT HE HAD FOLLOWED the DRIVER (MR JASON OWENS) OF THE VEHICLE INTO the WOODED AREA, AT WHICH TIME HE WAS LATER APPREHENDED. DEPUTY SANCHEZ ADVISED A SHORT TIME LATER other DEPUTIES HAD RESPONDED and APPREHENDED the other TWO SUBJECTS. DEPUTY SANCHEZ ADVISED UPON TALKING TO THE SUBJECT HE APPREHENDED HE WAS ABLE TO DETERMINE THAT HIS NAME WAS JASON OWENS. THE OTHER TWO SUBJECTS THAT WERE APPREHENDED, THERE NAMES WERE ALBERT ANTONIO WILLIAMS AND AARON LAMAR WILLIAMS. DEPUTY SANCHEZ ADVISED HE OBSERVED THE IGNITION TO THE VEHICLE TO BE LAYING ON the FLOOR, AS WELL AS A LOT OF the LOWER DASH COMPONENTS TO the TRUCK. THERE WERE NO KEYS IN THE VEHICLE. LOCATED IN the VEHICLE WERE NUMEROUS BURGLARY TOOLS, SUCH AS A SLEDGE HAMMER, TwO SEPARATE PRY BARS, and A PAIR OF BOLT CUTTERS. DEPUTY SANCHEZ ADVISED UPON RUNNING JASON OWENS' NAME THROUGH NCIC/FCIC IT WAS REVEALED HE DID NOT HAVE A VALID DRIVER'S LICENSE. ALL THREE SUBJECTS WERE TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. I ARRIVED AT 5980 WEST GULF TO LAKE HIGHWAY WHERE I MADE CONTACT WITH DEPUTY BANKS (1426). UPON ARRIVAL, SHE ADVISED THAT she HAD SPOKEN TO A WITNESS WHO OBSERVED A WHITE FORD TRUCK PULL UP TO the FRONT OF THE GAS STATION. SHE ADVISED THAT THE WITNESS OBSERVED THREE INDIVIDUALS EXIT the TRUCK AND ENTER the STORE. SHE ADVISED A SHORT TIME LATER THE ALARM HAD GONE OFF AND the THREE SUBJECTS EXITED THE STORE LEAVING IN THE WHITE FORD TRUCK HEADING EASTBOUND ON WEST GULF TO LAKE HIGHWAY I OBSERVED PART OF A PADLOCK TO BE LYING ON the GROUND THAT APPEARED TO HAVE BEEN CUT OFF OF THE FRONT DOOR. I DID OBSERVE the FRONT DOOR LOCK TO still BE in the LOCKED POSITION, BUT APPEARED THAT IT HAD BEEN PRIED OPEN. I OBSERVED THE AREA BEHIND THE COUNTER WHERE the CASH REGISTER TO BE LOCATED TO HAVE BEEN RUMMAGED THROUGH. IT APPEARED the CIGARETTES HAD ALSO BEEN RUMMAGED THROUGH.. UPON OBSERVING the VIDEO I OBSERVED A WHITE FORD TRUCK PULL UP TO THE FRONT OF THE STORE, THREE SUBJECTS EXITED the TRUCK and ENTERED the STORE AND THEN A SHORT TIME LATER AFTER BEING BEHIND the COUNTER ALL THREE SUBJECTS LEFT the STORE AND ENTERED the TRUCK. I DID OBSERVE the TRUCK TO HEAD EASTBOUND ON WEST GULF TO LAKE HIGHWAY. I THEN RESPONDED TO THE LOCATION OF THE TRUCK WHERE I OBSERVED NUMEROUS BURGLARY TOOLS ON THE FRONT SEAT and the BACK SEAT OF the VEHICLE, AS WELL AS the other PORTION OF the LOCK THAT APPEARED TO HAVE BEEN FROM THE GAS STATION BURGLARY. THE REGISTERED OWNER OF the TRUCK WAS CONTACTED and ADVISED HE HAD NOT GIVEN PERMISSION FOR ANYBODY TO TAKE THE VEHICLE. WHILE AT the JAIL, I ATTEMPTED AN INTERVIEW, AT WHICH TIME ALL THREE DEFENDANTS ADVISED THEY DID not WISH TO SPEAK WITH ME. DEFENDANT ALBERT ANTONIO WILLIAMS WAS CHARGED with ONE COUNT BURGLARY TO A STRUCTURE WITH BOND SET AT $5,000.00, ONE COUNT GRAND THEFT WITH BOND SET AT $2,000.00, AND ONE COUNT POSSESSION OF BURGLARY TOOLS WITH BOND SET AT $5,000.00. THE DEFENDANT'S TOTAL BOND WAS SET AT $12,000.00, PER THE BOND SCHEDULE. |
