Probable cause affidavit: SUBMITTED BY: BEETOW, CHARLES 0295 (AR09112477) DID UNLAWFULLY AND KNOWINGLY, while committing or after committing theft of property, resist the reasonable effort of a merchant OR merchant's employee, to recover the property WHICH THE merchant OR merchant's employee had probable cause to believe the individual had concealed or removed from its place of display or elsewhere, IN VIOLATION OF FLORIDA STATE STATUTE 812.015(6). DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, WAL-MART , TO WIT: FOUR PLAY STATION GAMES, SAID PROPERTY BEING OF A VALUE OF $254.24 WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTES 812.014(1) and 812.014(3)(a). on 122009, at APPROXIMATELY 1505, hours i was DISPATCHED to wal-mart super center in inverness, in REFERENCE to an altercation between THE DEFENDANT, MR ALEX SOSNICKI, and loss preveNtion officers . while En route, DISPATCH did advise they had received multiple calls in REFERENCE to this altercatIOn and the DEFENDANT was possibly armed with a knife fleeing the scene. moments prior to my arrival DISPATCH advised the DEFENDANT was apprehended in Aisle 13 in the parking lot. at that time contact was made with loss preveNtion who were surrounded by numerous on lookers. also with loss prevention was the DEFENDANT. at that time the DEFENDANT was placed in double locked handcuffs in front and secured in the rear of my patrol VEHICLE UNTIL i could determine what was going on. while placing the DEFENDANT in the rear of the VEHICLE he stated "i'M sorry; it'S christmas time and things are hard". i then made contact with loss prevention officers and management in the loss prevention office. i did ask the PRIMARY loss preveNtion officer what had happened and he stated he had observed the DEFENDANT walking through the store with play STATION GAMES in HIS hand. at one point the DEFENDANT had gone in to the MEN'S bathroom while the DEFENDANT was in the bathroom loss prevention alerted other management and loss PREVENTION officers about the DEFENDANT possibly concealing the property on his persons. several other loss preveNtion officerS moNitored the DEFENDANT either by eye sight and or video SURVEILLANCE. as the DEFENDANT walked to the front of the store where he briefly spoke with a cashier he then left THE cash registers and passed the ANTI shop lifting alarm and went towards the exit door. at that time several of the LOSS PREVENTION OFFICERS detained the DEFENDANT advising him that he believed haD STOLEN PROPERTY IN HIS POSSESSION AND HE NEEDED TO GO with theM IN TO THE LOSS PREVENTION OFFICE. THEY ADVISED THAT HE BECAME ARGUMENTATIVE AND TRIED WALKING AROUND THEM TO LEAVE THE STORE. WHEN THEY ADVISED HIM HE COULD NOT LEAVE AND PROVIDED HIM WITH THE BASIS OF THEIR INVESTIGATION AND DUE TO THE OTHER of the WAL-MART EMPLOYEES APPROACHING HIM HE REACHED IN TO HIS PANTS AND REMOVED SEVERAL PLAY STATION GAMES. AFTER REMOVING THEM FROM HIS POCKETS HE WAS THEN ASKED TO GO INTO THE LOSS PREVENTION ROOM TO WHICH HE BEGAN FIGHTING WITH LOSS PREVENTION TRYING TO GET OUT OF THE STORE. APPROXIMATELY FOUR TO SIX STORE EMPLOYEES ASSISTED WITH DETAINING THE DEFENDANT IN THE VESTIBULE AREA DUE TO THE DEFENDANT HIDING. AT ONE POINT ONE of the STORE EMPLOYEES OBSERVED A FIXED BLADE KNIFE WHICH WAS ON THE WAIST OF THE DEFENDANT. UPON HIS OBSERVATION HE HOLLERED KNIFE TO THE OTHER EMPLOYEES TO WHICH THE DEFENDANT BEGAN TO REACH FOR. BETWEEN THE STORE EMPLOYEES THEY WERE ABLE TO KEEP THE DEFENDANT'S HAND AWAY FROM THE KNIFE AND REMOVE IT FROM HIS WAIST BAND. AFTER A BRIEF MOMENT THE DEFENDANT CALMED DOWN, AND HE THEN VOLUNTARILY WAKED IN TO THE LOSS PREVENTION OFFICE. THEY ASKED THE DEFENDANT FOR HIS IDENTIFICATION, TO WHICH HE ADVISED HE HAD . THE DEFENDANT WROTE DOWN A FALSE NAME AND INFORMATION AND KEPT ASKING ABOUT WHAT WAS GOING TO HAPPEN TO HIM LEGALLY AND IF LAW ENFORCEMENT WAS GOING TO BE INVOLVED. LOSS PREVENTION STATED THE CITRUS COUNTY SHERIFF'S OFFICE WOULD BE CALLED IN REFERENCE TO THIS INCIDENT AND IT WOULD BE UP TO THE CITRUS COUNTY SHERIFF'S OFFICE IF HE WERE GOING TO BE GOING TO JAIL OR ISSUED A CITATION. AT THAT TIME THE DEFENDANT RAN OUT THE DOOR THROUGH THE VESTIBULE, OUT THE SLIDING DOORS AND IN TO THE PARKING LOT. WHILE RUNNING THROUGH THE VESTIBULE HE DID COLLIDE WITH A 10 YEAR OLD GIRL CAUSING A MINOR INJURY. WHILE THE DEFENDANT WAS RUNNING THROUGH THE PARKING LOT, THE DEFENDANT LOST HIS BALANCE AND TRIPPED OVER A CURB. THE DEFENDANT WAS THEN DETAINED BY LOSS PREVENTION UNTIL WE ARRIVED. AFTER GAINING THEIR INFORMATION THE AMOUNT OF THE PROPERTY TOTALED $254.24. I PROVIDED LOSS PREVENTION WITH AN AGENCY CASE CARD BEARING MY NAME AND THIS CASE NUMBER. AFTER GAINING ALL PARTIES INFORMATION ALONG with the WITNESSES THE DEFENDANT WAS INFORMED HE WAS BEING PLACED UNDER ARREST FOR RETAIL PETIT THEFT AND RESISTING A MERCHANT. THE DEFENDANT WAS TAKEN TO THE CITRUS COUNTY DETENTION FACILITY where he was booked PROCESSed and held at $750.00 per bond schedule. *NOT-EXEMPT*
