SUBMITTED BY: MULLINS, MARVIN 0419 (AR13-6221) (13-84992) DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY MULLINS, WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: REFUSED COMMANDS TO GET BACK IN HER VEHICLE AS WELL AS REFUSED TO PROVIDE HER DRIVER'S LICENSE, VEHICLE REGISTRATION AND PROOF OF INSURANCE WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. ON 062513 AT APPROXIMATELY 2320 HOURS, I WAS PARKED IN MY PATROL VEHICLE IN FRONT OF 1740 NORTH US HIGHWAY 41 IN INVERNESS CONDUCTING TRAFFIC ENFORCEMENT AND RUNNING STATIONARY RADAR. AT APPROXIMATELY 2322 HOURS, I OBSERVED THE DEFENDANTâS VEHICLE DRIVING NORTHBOUND PASSING IN FRONT OF 1660 NORTH US HIGHWAY 41, TRAVELING AT A HIGH RATE OF SPEED. I ESTIMATED THE VEHICLE TO BE TRAVELING AT APPROXIMATELY 55 MILES PER HOUR (MPH). I THEN TURNED ON MY FRONT ANTENNA, WHICH PRODUCED A HIGH PITCH DOPPLER TONE AS WELL AS A DIGITAL READING OF 58 MPH. I TURNED OFF MY FRONT ANTENNA AND TURNED IT ON AGAIN AND RECEIVED ANOTHER HIGH PITCH DOPPLER TONE AND A DIGITAL READING OF 58 MPH. THE SPEED LIMIT IN THIS AREA IS 35 MPH. I THEN TURNED ONTO NORTH US HIGHWAY 41 BEHIND THE DEFENDANTâS VEHICLE. THE DEFENDANT IMMEDIATELY TURNED INTO THE PARKING LOT OF 1809 NORTH US HIGHWAY 41. BEFORE THE DEFENDANTâS VEHICLE CAME TO REST, I INITIATED MY OVERHEAD EMERGENCY LIGHTS TO CONDUCT A TRAFFIC STOP. AS SOON AS THE DEFENDANTâS VEHICLE AND MY PATROL VEHICLE CAME TO REST, THE DRIVERâS DOOR OF THE DEFENDANTâS VEHICLE SWUNG WIDE OPEN AND WITH HER LEFT FOOT, SHE STEPPED OUT OF HER VEHICLE AND IMMEDIATELY TURNED AND FACED ME. I OPENED MY DRIVERâS DOOR AND ORDERED THE DEFENDANT, MS ALEXIS WILLIAMS, TO SIT BACK IN HER VEHICLE. THE DEFENDANT APPEARED TO BE IN AN AGGRESSIVE STANCE AND REFUSED TO SIT BACK DOWN IN HER VEHICLE. DUE TO THE DEFENDANTâS WINDOWS BEING DARK AND TINTED, I COULD NOT SEE IF THERE WAS ANYONE ELSE INSIDE THE VEHICLE ALONG WITH HER AGGRESSIVE DEMEANOR. I THEN ORDERED THE DEFENDANT A SECOND TIME TO SIT BACK DOWN INSIDE HER VEHICLE AND SHE REPLIED DO NOT TALK TO ME THAT WAY. I BEGAN TO APPROACH THE DEFENDANT AND RAISED MY VOICE AND TOLD THE DEFENDANT TO SIT DOWN IN HER VEHICLE FOR HER SAFETY AND MY SAFETY. THE DEFENDANT THEN STATED SHE WAS NOT GOING TO AND SHE WANTED MY SUPERVISOR. I THEN CONTINUED MY APPROACH TO THE DEFENDANT AND WHEN I WAS WITHIN JUST A FEW FEET OF HER, SHE SAT BACK DOWN IN HER VEHICLE AND SLAMMED HER DOOR. I THEN ASKED HER FOR HER DRIVER'S LICENSE, VEHICLE REGISTRATION AND PROOF OF INSURANCE, AT WHICH TIME, SHE STATED âNOâ AND SHE BEGAN TO DIAL A NUMBER ON HER CELLULAR TELEPHONE. I THEN TOLD THE DEFENDANT AGAIN TO PRODUCE HER DRIVER'S LICENSE, VEHICLE REGISTRATION AND PROOF OF INSURANCE AND SHE AGAIN STATED âNOâ. I THEN TOLD THE DEFENDANT TO STEP OUT OF HER VEHICLE, BECAUSE SHE WAS BEING PLACED UNDER ARREST AND SHE STATED THAT SHE WAS NOT GETTING OUT. I THEN OPENED HER DRIVERâS DOOR FROM THE OUTSIDE AND GRABBED HER LEFT WRIST WITH MY LEFT HAND AND PULLED HER FROM THE VEHICLE. WITH DEPUTY HUNTERâS ASSISTANCE, WHO HAD JUST ARRIVED ON SCENE, I WAS ABLE TO PLACE HER LEFT HAND BEHIND HER BACK AND LEANED THE FRONT SIDE OF HER BODY AGAINST HER VEHICLE. DEPUTY HUNTER ATTEMPTED TO PLACE HER RIGHT HAND BEHIND HER BACK; HOWEVER, SHE PULLED HER RIGHT HAND AWAY AND TRIED TO PULL HER LEFT HAND AWAY. WE WERE THEN FINALLY ABLE TO GET BOTH HER HANDS BEHIND HER BACK AND I PLACED HER IN HANDCUFFS (DOUBLE LOCKED). I THEN PLACED HER IN THE REAR SEAT OF MY PATROL VEHICLE. I ADVISED THE DEFENDANT THAT I WAS PLACING HER UNDER ARREST FOR RESISTING AN OFFICER WITHOUT VIOLENCE. PER THE DEFENDANTâS REQUEST, I LEFT HER VEHICLE IN THE PARKING LOT OF PERSEVERANCE TATTOO AND THE VEHICLE WAS LOCKED AND SECURED. I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY (CCDF) FOR BOOKING AND PROCESSING, WHERE HER BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION (UTC) NUMBER 4313-GZP-X FOR AN EXPIRED COLORADO TAG WITH AN EXPIRATION OF 06/2012, WITH A FINE OF $113.00 PAYABLE WITHIN 30 DAYS TO THE CITRUS COUNTY CLERK OF COURTS OFFICE. THE DEFENDANT WAS ALSO ISSUED WARNING NUMBER 370431B FOR UNLAWFUL SPEED OF 58 MPH IN 35 MPH ZONE. |
