Probable cause affidavit: |
SUBMITTED BY: HRYC, CHRISTOPHER 0701 (AR14-8591) ON 010414, I RESPONDED AS BACK UP FOR DEPUTY AGUILERA, AT THE CRYSTAL RIVER RACE TRAC, WHICH IS LOCATED AT 1001 NE 5TH STREET, CRYSTAL RIVER. UPON MY ARRIVAL ON SCENE, I MADE CONTACT WITH DEPUTY AGUILERA, WHO WAS SPEAKING WITH THE DRIVER, LATER IDENTIFIED AS THE DEFENDANT, MS ALICIA THEIS. DEPUTY AGUILERA ASKED THE DEFENDANT WHERE SHE WAS COMING FROM AND WHERE SHE WAS HEADED TO; TO WHICH SHE STATED THAT SHE WAS COMING FROM THE TOWN OF HERNANDO, AND WAS GOING TO THE CRYSTAL RIVER WALGREENS. AS I STOOD BY ON THE PASSENGERâS SIDE OF THE VEHICLE, I OBSERVED NUMEROUS SMALL PIECES OF GOLD BRILLO PAD, OFTEN REFERRED TO AS âCHORE BOYâ, THROUGHOUT THE VEHICLE. I THEN ASKED THE DEFENDANT IF SHE HAD EVER BEEN ARRESTED, AND SHE STATED THAT SHE HAD BEEN ARRESTED IN THE PAST, FOR POSSESSION OF CRACK COCAINE. DEPUTY AGUILERA THEN ASKED THE DEFENDANT FOR PERMISSION TO SEARCH HER VEHICLE, WHICH THE DEFENDANT AGREED TO. I THEN CONDUCTED AN INTERIOR SEARCH OF THE DEFENDANTâS VEHICLE. WHILE I DID SO, I OBSERVED MORE âCHORE BOYâ PIECES LITTERED THROUGHOUT THE VEHICLE IN THE FRONT AND BACKSEAT AREA. UPON REACHING THE CENTER CONSOLE, I WAS ABLE TO REMOVE THE PLASTIC LINING OF THIS COMPARTMENT; UNDERNEATH WHICH I FOUND TWO PIPES. ONE PIPE WAS A GLASS PIPE THAT I RECOGNIZED, THROUGH MY TRAINING AND EXPERIENCE, TO BE A PIPE OFTEN USED FOR SMOKING CRACK COCAINE, REFERRED TO AS A âSTEMâ. THE SECOND PIP WAS A METAL PIECE OF A BALLPOINT PEN THAT HAD BEEN DISASSEMBLED, AND AT THE END OF THE PEN WAS A PIECE OF THE âCHORE BOYâ. I UTILIZED AN AGENCY ISSUED FIELD TEST KIT ON EACH PIPE, WHICH BOTH YIELDED POSITIVE REACTIONS FOR THE PRESENCE OF CRACK COCAINE. THE PIPES WERE COLLECTED AND LATER TURNED IN TO EVIDENCE DIVISION. I CONFRONTED THE DEFENDANT ABOUT THE CRACK PIPES. SHE ADVISED THAT SHE HAS NOT USED CRACK IN 25 DAYS, BUT THAT THEY WERE PROBABLY HERS, AND SHE HAD JUST FORGOTTEN TO THROW THEM AWAY. THE DEFENDANT WAS THEN ISSUED A NOTICE TO APPEAR (NTA) CITATION, BEARING CITATION NUMBER 20296, FOR POSSESSION OF DRUG PARAPHERNALIA; WITH A MANDATORY COURT APPEARANCE OF 013014, AT 1300 HOURS AT THE CITRUS COUNTY COURTHOUSE. THIS CITATION WAS EXPLAINED TO THE DEFENDANT, WHO ADVISED THAT SHE UNDERSTOOD, AND SIGNED THE CITATION. THE DEFENDANT WAS PROVIDED WITH A COPY OF THE CITATION, AND THEN RELEASED ON HER OWN RECOGNIZANCE. |
