Probable cause affidavit: | SUBMITTED BY: 0452/MARK FARMER DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: , IN VIOLATION OF FLORIDA STATE STATUTE 893.145 IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) On January 4, 2008 I was dispatched to the EconoLodge motel located at 2575 NW HWY 19 in Crystal River. The manager advised that a white male subject had rented room #126, but left the premises and 2 black males and 2 white females had entered the room. Due to the fact that the manager of the establishment felt they were being defrauded, the manager requested that all the subjects be trespassed off the property. Contact was then made with 2 black males and 2 white females located in room #126. 0453/Deputy Marshall responded to the scene as back up and made contact with Jessica Myers. Miss Myers advised she drove the subjects to the motel in her mother's mini van bearing Florida tag 466KGU. The Subjects were asked to vacate the room and gathered near the vehicle. Miss Myers then spoke to Deputy Marshall and advised there was nothing illegal in the vehicle and gave consent for the vehicle to be searched. Contact was then made with the defendant who was sitting in the rear passenger seat of the vehicle with a white, plastic Wal-Mart bag between her legs. 0453/Deputy Marshall looked inside the bag and discovered a pack of 305 cigarettes. Inside the pack of cigarettes was a glass tube commonly referred to as a "crack pipe" containing residue and copper wadding. At that time the defendant was mirandized from a pre-printed card and when asked if she understood her rights answered "I do". The defendant spoke to 0453/Deputy Marshall advising the pipe was hers and that her fingerprints would be on the pipe. The defendant reiterated to this deputy that the pipe was hers and that she smoked crack daily. The defendant was advised she was being arrested for drug paraphernalia, was hand-cuffed, double locked and secured in the rear of my patrol vehicle. The crack pipe was packaged and turned into evidence. The defendant was issued a trespass warning from the EconoLodge motel and advised not to return. No further police action taken at this time. *NOT-EXEMPT* |
