SUBMITTED BY: DOYLE, CHAD 0438 (AR13-4091) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS/HER NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193 DID DRIVE A MOTOR VEHICLE UPON A HIGHWAY IN THE STATE OF FLORIDA WITHOUT HAVING A VALID DRIVER'S LICENSE AUTHORIZING HIM TO DO SO, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 322.03(1) ON 011013, I RESPONDED TO THE INTERSECTION OF BEVERLY HILLS BOULEVARD AND NORTH TYLER STREET, IN REFERENCE TO A VEHICLE CRASH WHICH HAD ALREADY OCCURRED. UPON MY ARRIVAL, I OBSERVED BOTH VEHICLES ON THE SOUTHWEST CORNER OF THE INTERSECTION. VEHICLE ONE, WHICH WAS IDENTIFIED LATER AS THE DEFENDANTâS WAS A 2008, GOLD IN COLOR CHEVROLET HHR, BEARING FLORIDA LICENSE PLATE NUMBER 515WFZ, WAS ON THE LEFT SIDE OF VEHICLE TWO, WHICH WAS A MARKED CITRUS COUNTY SHERIFF'S OFFICE PATROL VEHICLE. THE FRONT RIGHT CORNER OF THE DEFENDANTâS VEHICLE HAD STRUCK THE FRONT LEFT CORNER OF THE FRONT LEFT CORNER OF THE CITRUS COUNTY SHERIFF'S OFFICE PATROL VEHICLE. I THEN MADE CONTACT WITH DRIVER ONE, THE DEFENDANT, MS ANDREA ROSE BOLDEN, TO ASCERTAIN WHAT HAD OCCURRED AT THE CRASH. AS I SPOKE WITH THE DEFENDANT, I COULD IMMEDIATELY DETECT A STRONG ODOR OF AN ALCOHOLIC BEVERAGE TO BE EMITTING FROM HER PERSON, AND OBSERVED HER EYES TO BE BLOODSHOT, AND HER CLOTHING IN DISARRAY. WHILE GATHERING THE DEFENDANTâS INFORMATION AND RUNNING HER INFORMATION THROUGH TELETYPE AND D.A.V.I.D., IT WAS REVEALED THAT THE DEFENDANT HAD NO VALID FLORIDA DRIVER'S LICENSE. I THEN INFORMED THE DEFENDANT THAT I WAS NOW BEGINNING TO CONDUCT A CRIMINAL TRAFFIC CRASH INVESTIGATION, IN REFERENCE TO SUSPICION OF DRIVING UNDER THE INFLUENCE AND DRIVING WITH OUT A VALID DRIVER'S LICENSE. I THEN READ THE DEFENDANT HER MIRANDA WARNING, VIA A PRE PRINTED TEXT, AND ASKED HER IF SHE UNDERSTOOD HER RIGHTS AND WANTED TO CONTINUE SPEAKING WITH ME. THE DEFENDANT ADVISED THAT SHE UNDERSTOOD HER RIGHTS, AND WISHED TO CONTINUE SPEAKING WITH ME AT THIS TIME. I ASKED THE DEFENDANT TO EXPLAIN WHAT HAD HAPPENED. SHE STATED THAT SHE HAD BEEN TRAVELING WESTBOUND ON TYLER STREET IN HER VEHICLE, AND HAD STOPPED AT THE STOP SIGN AT THE INTERSECTION OF BEVERLY HILLS BOULEVARD. SHE ADVISED THAT SHE HAD LOOKED FOR ONCOMING TRAFFIC BUT HAD NOT SEEN ANYTHING COMING. THE DEFENDANT ADVISED THAT SHE HAD THEN PULLED OUT INTO THE MEDIAN BREAK IN THE ROAD, ATTEMPTING TO MAKE A LEFT HAND TURN, AT WHICH TIME SHE STRUCK A CITRUS COUNTY SHERIFF'S OFFICE PATROL VEHICLE. SHE ADVISED THAT AFTER IMPACT, BOTH VEHICLES CONTINUED TRAVELING UNTIL THEY PULLED OFF OF THE SIDE OF THE ROAD. THE DEFENDANT DID STATE SPONTANEOUSLY THAT SHE KNEW HER FLORIDA DRIVER'S LICENSE WAS NOT VALID. SHE ALSO ADVISED THAT SHE HAD BEEN DRINKING TODAY, AND THAT SHE HAD CONSUMED AT LEAST TWO BEERS. I THEN CONFIRMED THAT THE DEFENDANT HAD NO VALID DRIVER'S LICENSE, AND ALSO FOUND THAT SHE HAD AN OUT OF COUNTY WARRANT FROM LEE COUNTY, FLORIDA, IN REFERENCE TO DRIVING WITHOUT A VALID DRIVER'S LICENSE. THE DEFENDANTâS VEHICLE WAS TOWED BY SCALLYâS TOWING. I THEN ADVISED THE DEFENDANT THAT SHE WAS BEING PLACED UNDER ARREST, FOR DRIVING UNDER THE INFLUENCE AND FOR OPERATING A VEHICLE WITH A VALID DRIVER'S LICENSE. SHE WAS HANDCUFFED, DOUBLE LOCKED BEHIND HER BACK, AND SECURED IN THE REAR OF MY PATROL VEHICLE. I THEN READ THE DEFENDANT HER IMPLIED CONSENT, TO WHICH SHE ADVISED THAT SHE WOULD REFUSE TO SUBMIT TO THE REQUIRED TEST OF HER BREATH. I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL, SHE WAS RELEASED TO DETENTION FACILITY STAFF, AND TURNED OVER TO THE BREATHALYZER OPERATOR OF THE FACILITY. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF DUI AND ONE COUNT OF DRIVING WITHOUT A VALID DRIVER'S LICENSE, WITH HER BOND SET AT A TOTAL OF $650.00. THE DEFENDANT WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION, BEARING NUMBER 8237ROZ5, FOR VIOLATION OF THE RIGHT OF WAY, WITH A CIVIL FINE OF $166.00, PAYABLE IN THIRTY DAYS TO THE CITRUS COUNTY CLERK OF COURTS. SHE WAS ALSO ISSUED FLORIDA UNIFORM TRAFFIC CITATION, BEARING NUMBER 8422ROZ4, FOR DRIVING WITHOUT A VALID FLORIDA, WITH A MANDATORY COURT DATE OF 011313, AT 1300 HOURS, AT THE CITRUS COUNTY COURTHOUSE. SHE WAS ALSO ISSUED FLORIDA DUI UNIFORM TRAFFIC CITATION, BEARING NUMBER 7198XGA1, FOR DUI, WITH A MANDATORY COURT DATE OF 013113 AT 1300 HOURS, AT THE CITRUS COUNTY COURTHOUSE. |
