Probable cause affidavit: SUBMITTED BY: SUNDBERG, KURT 1268 (AR15-16063) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: APPROXIMATELY .5 GRAMS OF METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 081615 AT APPROXIMATELY 0732 HOURS, I OBSERVED A 1997 CHEVROLET, FOUR DOOR VEHICLE, GRAY IN COLOR, BEARING FLORIDA LICENSE PLATE NUMBER DRXN91, FAIL TO COME TO A COMPLETE STOP BEFORE COMING to the ROADWAY, AT THE STOP SIGN LOCATED AT SOUTH MASON CREEK ROAD AND WEST YULEE DRIVE. I THEN ACTIVATED MY OVERHEAD LIGHTS AND CONDUCTED A TRAFFIC STOP ON SAID VEHICLE, IN THE AREA OF WEST YULEE DRIVE AND WEST CENTRAL STREET. I THEN EXITED MY PATROL VEHICLE, WHERE I MADE A DRIVER'S SIDE APPROACH ON SAID VEHICLE, WHERE I MADE CONTACT WITH THE DRIVER/DEFENDANT, MS ANGELA PHILLIPS. ALSO PRESENT IN THE VEHICLE, WAS MR ROBERT HENRY ENGELS. I ADVISED THE DEFENDANT OF THE REASON FOR THE STOP. I REQUESTED HER DRIVER'S LICENSE, VEHICLE REGISTRATION AND INSURANCE. SHE WAS ABLE TO GIVE ME HER INSURANCE AND REGISTRATION, BUT WAS UNABLE TO LOCATE HER DRIVER'S LICENSE. WHILE SPEAKING WITH THE DEFENDANT, SHE APPEARED TO BE VERY NERVOUS. I OBSERVED HER HANDS TO BE SHAKING AND FOR HER TO HAVE A STUTTERED speech. AT THAT TIME, I RETURNED TO MY PATROL VEHICLE. I THEN RAN BOTH THE DEFENDANT AND THE PASSENGER IN THE VEHICLE THROUGH TELETYPE, TO WHERE I WAS ADVISED THAT THE DEFENDANT'S DRIVER'S LICENSE HAD AN "FR SUSPENSION" ON 082712, THAT HER DRIVER'S LICENSE EXPIRED ON 022413, AND THAT HER DRIVER'S LICENSE WAS CURRENTLY NOT VALID. I WAS ALSO ADVISED THAT MR ENGELS DRIVER'S LICENSE WAS NOT VALID. AT THAT TIME, I HAD THE DEFENDANT STEP OUT OF HER VEHICLE AND MEET ME AT THE FRONT OF MY PATROL VEHICLE. I THEN ADVISED HER OF HER DRIVER'S LICENSE BEING, NOT VALID AND EXPIRED, TO which SHE ADVISED ME THAT SHE DID NOT KNOW. WHILE SPEAKING WITH THE DEFENDANT SHE STILL APPEARED TO BE NERVOUS. I ASKED HER IF THERE WAS ANYTHING ILLEGAL INSIDE OF THE VEHICLE, TO WHICH SHE ADVISED ME NO. I ASKED HER FOR CONSENT TO SEARCH THE VEHICLE, TO WHICH SHE ADVISED that I COULD. I THEN ASKED HER IF SHE HAD ANYTHING ILLEGAL ON HER PERSON, TO WHICH SHE ADVISED NO AND IMMEDIATELY BEGAN PULLING OUT HER POCKETS. I THEN MADE CONTACT WITH MR ENGELS, WHERE HE WAS ASKED TO STEP OUT OF THE VEHICLE. I ADVISED MR ENGELS THAT THE DEFENDANT HAD GIVEN PERMISSION TO SEARCH HER VEHICLE. I ASKED HIM IF THERE WAS ANYTHING ILLEGAL INSIDE THE VEHICLE, TO which HE ADVISED NO. I ASKED HIM IF I COULD PAT HIM DOWN, TO WHICH HE ADVISED YES. I THEN PATTED HIM DOWN, THIS MET WITH NEGATIVE RESULTS IN FINDING ANY ILLEGAL CONTRABAND. MR ENGELS WAS ASKED TO STEP TO THE FRONT OF MY PATROL VEHICLE WITH THE DEFENDANT, WHICH HE DID. A HAND SEARCH WAS THEN CONDUCTED OF THE VEHICLE. WHILE SEARCHING THE VEHICLE, I LOCATED A CLEAR GLASS MARIJUANA SMOKING PIPE, UNDER THE CENTER CONSOLE ARMREST OF THE VEHICLE. I THEN LOCATED A BLUE BAG. INSIDE THIS BAG I FOUND MULTIPLE CLEAR PLASTIC BAGGIES THAT APPEARED TO BE NEW. IN THE FRONT OUTSIDE POCKET OF THIS BAG, I WAS ABLE TO LOCATE A BLACK IN COLOR EYEGLASS CASE. UPON OPENING THIS CASE, I OBSERVED MULTIPLE SMALL PLASTIC BAGGIES. I ALSO OBSERVED $21.00 IN CASH (ONE $20.00 BILL AND ONE $1.00 BILL) AND AN ADDITIONAL CLEAR PLASTIC BAGGIE CONTAINING A SMALL CRYSTAL LIKE SUBSTANCE, FROM WHAT I KNOW THROUGH MY TRAINING AND EXPERIENCE TO BE METHAMPHETAMINE. AT THAT TIME, I ASKED THE DEFENDANT IF THE BLUE BAG WAS HERS, TO WHICH SHE ADVISED YES. I THEN HAD THE DEFENDANT STEP with ME to the REAR OF MY PATROL VEHICLE. I THEN SHOWED HER THE ILLEGAL NARCOTICS THAT I HAD FOUND. SHE ADVISED ME THAT THE BLACK EYEGLASS CASE WAS NOT HERS AND THAT IT WAS A FRIEND'S. SHE ADVISED ME THAT SHE HAD PICKED IT UP LAST NIGHT, WHILE OUT WITH HER friends AND FORGOT TO GIVE IT BACK. SHE WAS THEN ASKED IF SHE KNEW WHAT THE SUBSTANCE WAS, TO WHICH SHE FIRST DENIED KNOWING AND LATER ADVISED that IT WAS METHAMPHETAMINE. THE DEFENDANT WAS ADVISED THAT SHE WAS BEING DETAINED AND PLACED IN THE REAR OF MY PATROL VEHICLE. SHE WAS THEN HANDCUFFED (DOUBLE LOCKED) BEHIND THE BACK AND PLACED IN MY PATROL VEHICLE. I THEN MADE CONTACT WITH MR ENGELS. HE WAS ADVISED OF WHAT I HAD FOUND. HE WAS ASKED IF THE DEFENDANT USED ANY ILLEGAL DRUGS, TO which HE ADVISED THAT HE KNEW THAT SHE USED PILLS, BUT HE DID NOT KNOW WHAT ELSE SHE MIGHT USE. THE CRYSTAL LIKE SUBSTANCE WAS THEN TESTED USING A FIELD TEST KIT, WHICH YIELDED A POSITIVE RESULT FOR METHAMPHETAMINE. I AGAIN MADE CONTACT WITH THE DEFENDANT. SHE WAS ADVISED THAT SHE WAS BEING PLACED UNDER ARREST. SHE WAS ASKED WHAT SHE WANTED ME TO DO WITH THE VEHICLE, WHICH SHE REQUESTED TO HAVE MR ENGELS CALL SOMEBODY AND HAVE THEM PICK IT UP. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. WHILE AT THE CITRUS COUNTY DETENTION FACILITY THE METHAMPHETAMINE WAS WEIGHED, WHERE IT WEIGHED APPROXIMATELY .5 GRAMS. ALSO THE DEFENDANT WAS ISSUED WRITTEN WARNING NUMBER 401627B, FOR RUNNING THE STOP SIGN. THE MONEY THAT WAS FOUND INSIDE THE EYEGLASS CASE ($21.00) WAS TURNED IN TO HER PROPERTY AT THE CITRUS COUNTY DETENTION FACILITY. THE METHAMPHETAMINE, GLASS PIPE AND EYEGLASS CASE CONTAINING MULTIPLE CLEAR BAGGIES, WHERE LATER TURNED OVER TO CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE. THE DEFENDANT'S BOND WAS SET AT $2,000.00, PER THE BOND SCHEDULE.
