SUBMITTED BY: CUTLIP, JOSHUA 0721 (AR11123472) THE DEFENDANT DID, KNOWING her DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2) ON 110611 AT APPROXIMATELY 2358 HOURS WHILE ON ROUTE PATROL IN THE AREA OF SOUTH FLORIDA AVENUE AND EDEN DRIVE IN INVERNESS, I OBSERVED A BLUE 1991 OLDSMOBILE BEARING FLORIDA TAG 458-LKV, REGISTERED TO AN ANNA CATHERINE LUTES, TO HAVE AN INOPERABLE TAG LIGHT. I POSITIONED MY PATROL VEHICLE BEHIND THE OLDSMOBILE, ACTIVATED MY OVERHEAD LIGHTS AND CONDUCTED A TRAFFIC STOP ON THE VEHICLE AT THE KANGAROO GAS STATION LOCATED AT 745 SOUTH FLORIDA AVENUE IN INVERNESS. UPON RUNNING THE TAG IN NCIC/FCIC, IT WAS REVEALED THAT THE STATUS OF THE DEFENDANT'S DRIVER'S LICENSE WAS SUSPENDED AS OF 090711 FOR FINANCIAL RESPONSIBILITY. THE NCIC/FCIC RESPONSE ALSO REVEALED AUTHORITIES WERE TO SEIZE THE TAG IF THE DRIVER WAS THE OWNER OR CO-OWNER OF THE VEHICLE. THE NCIC/FCIC RESPONSE SHOWED THE TAG WAS REGISTERED TO A 1997 TAN FORD PICKUP TRUCK AND NOT THE 1991 BLUE OLDSMOBILE. I THEN Approached the vehicle and made contact with the driver, later identified as the defendant, ms anna catherine lutes. this was confirmed via her florida driver's license. i informed the defendant of the reason for the traffic stop and requested her driver's license, the vehicLe registrATION AND PROOF OF INSURANCE. THE DEFENDANT PROVIDED HER FLORIDA DRIVER'S LICENSE BUT DID NOT PROVIDE THE VEHICLE REGISTRATION OR PROOF OF INSURANCE DUE TO THE FACT THAT SHE HAD NOT REGISTERED THE VEHICLE AND DID NOT HAVE INSURANCE AT THIS TIME. I VERIFIED THE STATUS OF THE DEFENDANT'S DRIVER'S LICENSE IN THE D.A.V.I.D. SYSTEM WHICH CONFIRMED THAT HER DRIVER'S LICENSE WAS CURRENTLY SUSPENDED. THE D.A.V.I.D. SYSTEM ALSO SHOWED THAT NOTICE WAS GIVEN ON 080811 FOR THE FINANCIAL RESPONSIBILITY SUSPENSION. A RECORDS CHECK SHOWED THAT THE DEFENDANT HAD BEEN PREVIOUSLY ISSUED A CITATION, ON 100411, FOR DRIVING WHILE LICENSE SUSPENDED. I ASKED THE DEFENDANT IF SHE HAD KNOWLEDGE THAT HER LICENSE WAS SUSPENDED. AT FIRST, SHE DENIED KNOWING BUT LATER ADMITTED TO KNOWING THAT HER DRIVER'S LICENSE WAS SUSPENDED. I ASKED THE DEFENDANT ABOUT THE TAG NOT BEING REGISTERED TO THE 1991 OLDSMOBILE. THE DEFENDANT FREELY STATED, WITHOUT COERCION, THAT SHE KNOWINGLY TOOK THE TAG OFF OF HER 1997 TAN FORD PICKUP AND ATTACHED IT TO THE 1991 BLUE OLDSMOBILE WITHOUT HAVING FIRST PROPERLY REGISTERED THE VEHICLE. THE DEFENDANT WAS THEN PLACED UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED, KNOWINGLY. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK, SEARCHED INCIDENT TO ARREST, SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. PRIOR TO LEAVING THE SCENE, THE DEFENDANT'S VEHICLE WAS SECURED AND LEFT ON SCENE, PER THE DEFENDANT'S REQUEST. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT WAS BOOKED AND HELD ON A BOND OF $500.00, IN ACCORDANCE WITH THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED A FLORIDA UNIFORM TRAFFIC CITATION, CITATION NUMBER 5444-GQFX, FOR DRIVING WHILE LICENSE SUSPENDED, KNOWINGLY, WITH A MANDATORY COURT APPEARANCE DATE ON 120111 AT 1300 HOURS AT THE CITRUS COUNTY COURTHOUSE. THE DEFENDANT WAS ALSO ISSUED A FLORIDA UNIFORM TRAFFIC CITATION, CITATION NUMBER 5442-GQF9, FOR ATTACHED TAG NOT ASSIGNED, WITH THE SAME MANDATORY COURT APPEARANCE DATE AND CITATION NUMBER 5443-GQFX, FOR NO PROOF OF INSURANCE. THE DEFENDANT'S BELONGINGS AND THE CITATIONS WERE TURNED OVER TO DETENTION FACILITY STAFF. THE DEFENDANT'S TAG WAS SEIZED AND LATER TURNED IN TO RECORDS, PER THE ORDER IN NCIC/FCIC.
