SUBMITTED BY: CULBERTSON, CHRISTOPHER 0439 (AR13-4070) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF BEALLâS DEPARTMENT STORE , TO WIT: MISCELLANEOUS JEWELRY AND SUNGLASSES, TOTALING $113.99, CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.014(3)(A). ON 010913, I RESPONDED TO THE BEALLâS DEPT STORE, WHICH IS LOCATED AT 2851 EAST GULF TO LAKE HIGHWAY, INVERNESS, IN REFERENCE TO A RETAIL PETIT THEFT WHICH HAD ALREADY OCCURRED. UPON MY ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT, MR CHAD WHITLER, WHO WORKS AS A LOSS PREVENTION OFFICER FOR BEALLâS. THE COMPLAINANT ADVISED THAT AT APPROXIMATELY 1817 HOURS, ON TODAYâS DATE, HE HAD OBSERVED VIA CLOSED CIRCUIT TELEVISION SURVEILLANCE OF THE FLOOR A WHITE FEMALE, WHO WAS LATER IDENTIFIED AS THE DEFENDANT, MS ANNA MARIE MCGOUCH, TO BE CONCEALING MERCHANDISE IN HER PURSE. THE COMPLAINANT FURTHER STATED THAT HE HAD OBSERVED HER TO SELECT A PAIR OF EARRINGS, THREE BRACELETS, AND TWO PAIRS OF SUNGLASSES, AND THEN PLACED THEM IN HER PURSE. HE STATED THAT SHE THEN PASSED ALL FINAL POINTS OF SALE, WITHOUT ATTEMPTING TO PAY FOR ANY OF THE ITEMS. THE COMPLAINANT ADVISED THAT HE THEN CONFRONTED THE DEFENDANT, AND ESCORTED HER BACK TO THE LOSS PREVENTION OFFICER. ONCE INSIDE OF THE STORE, THE COMPLAINANT ADVISED THAT HE LOCATED THE STOLEN MERCHANDISE FROM THE DEFENDANTâS PURSE, AND CONTACTED THE CITRUS COUNTY SHERIFF'S OFFICE. I THEN MADE CONTACT WITH THE DEFENDANT, AND READ THE DEFENDANT HER MIRANDA WARNING VIA A PRE PRINTED, AGENCY ISSUED CARD. THE DEFENDANT ADVISED THAT SHE DID UNDERSTAND HER RIGHTS, AND THAT SHE WOULD SPEAK WITH ME AT THIS TIME. HOWEVER, UPON QUESTIONING THE DEFENDANT, SHE REPEATEDLY KEPT ASKING IF I WOULD JUST WRITE HER A CITATION, AND NOT TAKE HER TO JAIL. AT THIS TIME, I OBTAINED A COPY OF THE SURVEILLANCE VIDEO OF THE INCIDENT, AS WELL AS PICTURES OF THE MERCHANDISE, AND A SALES RECEIPT, TOTALING THE VALUE OF THE STOLEN MERCHANDISE AT $113.99. THESE ITEMS WILL BE TURNED IN TO CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE DIVISION. THE COMPLAINANT ALSO PROVIDED A SWORN WRITTEN STATEMENT, WHICH WAS COLLECTED AND LATER TURNED IN TO CITRUS COUNTY SHERIFF'S OFFICE RECORDS DIVISION. I THEN ADVISED THE DEFENDANT THAN SHE WAS BEING PLACED UNDER ARREST, FOR RETAIL PETIT THEFT. SHE WAS HANDCUFFED, DOUBLE LOCKED BEHIND HER BACK, AND SECURED IN THE REAR OF MY PATROL VEHICLE. I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL, SHE WAS RELEASED TO DETENTION FACILITY STAFF, FOR BOOKING AND PROCESSING. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF RETAIL PETIT THEFT, WITH HER BOND SET AT $250.00, PER THE BOND SCHEDULE. |
