SUBMITTED BY: CALLAHAN, CRAIG 0643 (AR12124437) THE DEFENDANT DID OPERATE A VEHICLE IN THE STATE OF FLORIDA AND, HAVING KNOWLEDGE THAT HE HAD BEEN DIRECTED TO STOP SUCH VEHICLE BY A DULY AUTHORIZED LAW ENFORCEMENT OFFICER, DID WILLFULLY REFUSE OR FAIL TO STOP SUCH VEHICLE IN COMPLIANCE WITH SUCH DIRECTIVE, IN VIOLATION OF FLORIDA STATE STATUTE 316.1935(3)(A) AND THE DEFENDANT DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY CRAIG CALLAHAN OF THE CITRUS COUNTY SHERIFF'S OFFICE, WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: ATTEMPTING TO CONDUCT A TRAFFIC STOP, WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02 AND THE DEFENDANT DID KNOWINGLY OPERATE, ON THE ROADS OF THIS STATE, A VEHICLE THAT HAD NOT BEEN REGISTERED, IN VIOLATION OF FLORIDA STATE STATUTE 320.02(1) AND THE DEFENDANT DID DRIVE A MOTOR VEHICLE UPON A HIGHWAY IN THE STATE OF FLORIDA WITHOUT HAVING A VALID DRIVER'S LICENSE AUTHORIZING HIM TO DO SO, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 322.03(1). ON 011812 AT APPROXIMATELY 2040 HOURS, I WAS TRAVELING EASTBOUND ON SOUTH ROSE AVENUE, APPROACHING THE INTERSECTION OF SOUTH BARBOUR STREET IN BEVERLY HILLS IN MY MARKED AGENCY PATROL VEHICLE. I OBSERVED A TAN IN COLOR BUICK FOUR DOOR VEHICLE TRAVELING WESTBOUND ON SOUTH ROSE AVENUE. I NOTICED THAT THE VEHICLE TURNED NORTHBOUND ON TO SOUTH BARBOUR STREET IN AN ABRUPT MANNER AND THAT THE VEHICLE FAILED TO USE ITS TURN SIGNAL. I TURNED ON TO SOUTH BARBOUR STREET AND ATTEMPTED TO CATCH UP TO THE TAN BUICK. I OBSERVED THAT THERE WAS NO TAG/LICENSE PLATE ATTACHED TO THE REAR OF THE VEHICLE. PRIOR TO BEING ABLE TO ACTIVATE MY OVERHEAD EMERGENCY EQUIPMENT, THE TAN BUICK ACCELERATED AND TURNED IN BETWEEN THE TWO RESIDENCES LOCATED AT 30 SOUTH BARBOUR AND 28 SOUTH BARBOUR STREET, AT WHICH TIME I ACTIVATED MY EMERGENCY EQUIPMENT IN AN ATTEMPT TO GET THE DRIVER, LATER IDENTIFIED AS DEFENDANT MR ANTHONY BRAITHWAITE, TO STOP HIS TAN BUICK. HOWEVER, THE DRIVER/DEFENDANT FAILED TO DO SO AND CONTINUED TO DRIVE AROUND THE RESIDENCE AT 30 SOUTH BARBOUR STREET. AS I CONTINUED TO PURSUE THE TAN BUICK, THE VEHICLE TURNED IN BETWEEN THE RESIDENCES AT 28 AND 30 SOUTH BARBOUR STREET AND CONTINUED WESTBOUND BETWEEN 29 AND 27 SOUTH WADSWORTH AVENUE IN AN INCREASINGLY RECKLESS MANNER. AFTER PURSUING THE TAN BUICK IN BETWEEN THESE RESIDENCES, THE VEHICLE TURNED IN A SOUTHBOUND DIRECTION ON SOUTH WADSWORTH AVENUE, COMPLETELY RUNNING THE STOP SIGN AT THE INTERSECTION OF SOUTH WADSWORTH AVENUE AND SOUTH ROSE AVENUE. THE TAN BUICK THEN CONTINUED THROUGH THE INTERSECTION, IN BETWEEN ANOTHER SET OF RESIDENCES AT 10 AND 8 SOUTH ROSE AVENUE, DRIVING BEHIND 10 SOUTH ROSE AVENUE WHERE THE VEHICLE SUBSEQUENTLY CRASHED IN TO A TREE BEHIND 10 SOUTH ROSE AVENUE. THE DEFENDANT THEN FLED THE VEHICLE ON FOOT IN A SOUTHBOUND DIRECTION TOWARD HOOVER STREET. AT THAT TIME, I EXITED MY PATROL VEHICLE AND CHASED THE DEFENDANT ON FOOT. I PASSED THE TAN BUICK AND OBSERVED AN HISPANIC MALE, LATER IDENTIFIED AS MR DENNIS PERRY-FRANCIS, SITTING IN THE PASSENGER SEAT. I ORDERED THIS MALE SUBJECT TO REMAIN IN THE TAN BUICK. I CONTINUED PURSUING THE DEFENDANT ON FOOT AND GAVE HIM MULTIPLE COMMANDS TO STOP RUNNING AS WELL AS announcing "sheriff's office" as we continued southbound through the yards of multiple residences. after a short time, i got within feet of the defendant while still yelling at him to stop running. the defendant finally slowed and was then tackled to the ground. when the defendant went to the ground, i pointed my agency issued taser at his back until the arrival of sergeant smith who secured the defendant in handcuffs (double locked) behind his back. i escorted the defendant to my patrol vehicle and advised him he was being placed under arrest. i read the defendant his miranda warnings from a preprinted aGENCY CArd aND ASKED THE DEFENDANT IF HE UNDERSTOOD HIS RIGHTS, TO WHICH HE STATE HE DID. I ASKED THE DEFENDANT IF HE WISHED TO SPEAK TO ME And he stated he did. i asked the defendant why he ran from me and he advised it was because he had purchased the vehicle approximately three months ago and had not yet registered the vehicle in his name. the defendant also stated he did not have a valid driver's license and THAT HE was scared. prior to leaving the scene, the defendant was medically cleared by emergency medical services. the defendant's vehicle was towed from the scene by advanced towing. contact was made with THE witness, ms brenda johnson the resident at 29 SOUTH WADSWORTH AVENUE. SHE PROVIDED A SWORN WRITTEN STATEMENT DESCRIBING HOW SHE HAD OBSERVED ME PURSUING THE DEFENDANT AROUND HER NEIGHBOR'S RESIDENCE AND THROUGH HER YARD. THE DEFENDANT WAS THEN SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. UPON ARRIVAL, THE DEFENDANT WAS BOOKED AND HELD ON A TOTAL BOND OF $6,500.00, IN ACCORDANCE WITH THE BOND SCHEDULE.
