SUBMITTED BY: CLARK, SHELLEY 0401 (AR11119683) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: AN AIR CONDITIONING UNIT OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN TWENTY THOUSAND DOLLARS ($20,000.00), TO WIT: $2,000.00 WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)(C)(1). ON 052510 THE VICTIM, MS KATHIE ATKINSON, REPORTED THAT THE AIR CONDITIONING (AC) UNIT ATTACHED TO THE RESIDENCE HAD BEEN REMOVED AS REPORTED IN CASE 10051057. THE AC UNIT HAD BEEN FORCIBLY REMOVED AS A WHOLE UNIT BY CUTTING THE COPPER TUBING AND ELECTRICAL WIRES. ON 022811 THE DEFENDANT WAS ARRESTED IN REFERENCE TO CASE 11020966. WHILE INVESTIGATORS WERE SERVING A SEARCH WARRANT OF THE DEFENDANT'S RESIDENCE THAT HE FORMERLY SHARED WITH HIS DECEASED FATHER, AN AC UNIT WAS OBSERVED IN THE GARAGE OF THE RESIDENCE THAT MATCHED THE AC UNIT STOLEN IN THIS CASE, BY THE MODEL AND SERIAL NUMBERS. THE AC UNIT WAS FULLY INTACT EXCEPT FOR THE COPPER AND ELECTRICAL WIRES BEING CUT. ON 030711, CONTACT WAS MADE WITH THE EXECUTOR OF THE ESTATE, WHO COMPLETED A PERMISSION TO SEARCH FORM, GIVING THIS DETECTIVE PERMISSION TO REMOVE THE AC UNIT FROM THE GARAGE. ON 030811 THIS DETECTIVE MET WITH VICTIM TWO, MR STEVE ATKINSON, AT THE RESIDENCE, TO RETRIEVE THE UNIT. THE DEFENDANT IS CURRENTLY INCARCERATED AT THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANT WAS CHARGED WITH GRAND THEFT AND HIS BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE.
