SUBMITTED BY: WEATHERFORD, D KEAGON 0710 (12-65208) THE DEFENDANT DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: COCAINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A) AND THE DEFENDANT DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT UNDER TWENTY GRAMS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B) AND THE DEFENDANT DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: COCAINE, SAID OBJECT BEING A PARTIAL STRAW WITH RESIDUE, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1) ON 040612 AT APPROXIMATELY 2049 HOURS, I OBSERVED A GREEN FORD RANGER TRAVELING EASTBOUND ON WEST GULF TO LAKE HIGHWAY IN THE AREA OF NORTH GANNETT PLACE. I OBSERVED THE GREEN FORD RANGER TO HAVE A BROKEN LEFT TAIL LIGHT LENS, LEAVING A HOLE APPROXIMATELY FOUR INCHES IN DIAMETER WHICH WAS EMITTING WHITE LIGHT FROM THE REAR OF THE VEHICLE. I INITIATED MY OVERHEAD EMERGENCY EQUIPMENT AND CONDUCTED A TRAFFIC STOP AT THE INTERSECTION OF WEST CURLEW PLACE AND WEST GULF TO LAKE HIGHWAY IN CRYSTAL RIVER. UPON APPROACHING THE VEHICLE, I OBSERVED THE VEHICLE TO BE OCCUPIED BY TWO MALE SUBJECTS. THE DRIVER WAS LATER IDENTIFIED AS MR RICHARD HULL. THE PASSENGER WAS LATER IDENTIFIED AS THE DEFENDANT, MR ANTHONY DABNEY. I MADE CONTACT WITH DRIVER HULL AND REQUESTED HIS DRIVERâS LICENSE, THE VEHICLE REGISTRATION AND PROOF OF INSURANCE. DRIVER HULL STATED HE DID NOT HAVE THE REGISTRATION OR HIS INSURANCE CARD BUT HE DID PROVIDE A VALID FLORIDA DRIVERâS LICENSE. WHILE SPEAKING WITH DRIVER HULL, CANINE DEPUTY VIGGIANO ARRIVED ON SCENE AT 2049 HOURS. AS I RETURNED TO MY PATROL VEHICLE, CANINE DEPUTY VIGGIANO DEPLOYED CANINE CONAN FOR AN EXTERIOR SNIFF ON THE VEHICLE. CANINE DEPUTY VIGGIANO ADVISED THAT CANINE CONAN HAD ALERTED. I RETURNED TO THE VEHICLE AND REQUESTED THAT DRIVER HULL STEP OUT OF THE VEHICLE WHERE I CONDUCTED A CONSENSUAL PAT DOWN SEARCH OF HIS PERSON WHICH WAS MET WITH NEGATIVE RESULTS FOR LOCATING ANY CONTRABAND. UPON APPROACHING THE PASSENGER SIDE OF THE VEHICLE, TO ASK DEFENDANT DABNEY TO STEP OUT OF THE VEHICLE, CANINE DEPUTY VIGGIANO ADVISED THAT HE SAW DEFENDANT DABNEY PUT A CLEAR PLASTIC BAG BETWEEN HIS LEGS. I ASKED DEFENDANT DABNEY TO STEP OUT OF THE VEHICLE, AT WHICH TIME I OBSERVED DEFENDANT DABNEY TO HAVE A CLEAR PLASTIC BAG IN HIS RIGHT HAND. I REQUESTED THAT DEFENDANT DABNEY HAND ME THE BAGGIE HE HAD IN HIS HAND, WHICH HE DID. WHEN I ASKED DEFENDANT DABNEY WHAT WAS IN THE BAG, HE ADVISED HE DID NOT KNOW, THAT HE HAD FOUND IT ON THE GROUND AND just STUCK IT IN HIS POCKET. UPON LOOKING INSIDE THE CLEAR PLASTIC BAG, I OBSERVED A CIGARETTE CELLOPHANE WRAPPER CONTAINING APPROXIMATELY 1.5 GRAMS OF CANNABIS. ALSO, THERE WERE TWO SMALL CLEAR BAGGIES WHICH CONTAINED APPROXIMATELY ONE GRAM EACH OF CANNABIS. I OBSERVED TWO MORE CLEAR BAGGIES CONTAINING A WHITE POWDERY SUBSTANCE WHICH WAS LATER FIELD TESTED, USING AN AGENCY FIELD TEST KIT, AND YIELDED A POSITIVE RESULT FOR COCAINE. ALSO INSIDE THE BAG, I OBSERVED A SMALL BLUE BAGGIE CONTAINING COCAINE RESIDUE ALONG WITH A PARTIAL STRAW. THE PARTIAL STRAW WAS COVERED IN COCAINE RESIDUE. I OBSERVED A FOLDED PIECE OF YELLOW NOTEBOOK PAPER INSIDE OF THE BAG WHICH CONTAINED A WHITE POWDERY SUBSTANCE WHICH WAS LATER FIELD TESTED AND YIELDED A POSITIVE RESULT FOR COCAINE. THE COCAINE WAS WEIGHED WITH THE YELLOW NOTEBOOK PAPER AND WEIGHED APPROXIMATELY 1.5 GRAMS. DEFENDANT DABNEY WAS ADVISED HE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF COCAINE, POSSESSION OF CANNABIS IN AN AMOUNT UNDER TWENTY GRAMS AND POSSESSION OF DRUG PARAPHERNALIA. HE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK, SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. PRIOR TO LEAVING THE SCENE, DRIVER HULL WAS ISSUED A WRITTEN WARNING FOR FAULTY EQUIPMENT, BROKEN TAIL LIGHT LENS, AND RELEASED. DEFENDANT DABNEY WAS THEN TRANSPORTED TO THE DETENTION FACILITY AND UPON ARRIVAL, DEFENDANT DABNEY WAS BOOKED AND HELD ON A TOTAL BOND OF $3,000.00, IN ACCORDANCE WITH THE BOND SCHEDULE. |
