Probable cause affidavit: | SUBMITTED BY: WEAKS, DANIEL 0553 (AR07100184) did unlawfully and intentionally touch or strike THE VICTIM against HIS will or intentionally cause bodily harm to said person, and in the commission of said battery did intentionally or knowingly cause great bodily harm, permanent disability or permanent disfigurement to said person, and during the commission of said offense THE DEFENDANT did carry, display, use, threaten or attempt to use a weapon or firearm, in violation of Florida Statutes 784.045(1)(a)1 and 775.087(1). ON 110307, I WAS DISPATCHED TO 5515 SOUTH WITHLAPOKA DRIVE, FLORAL CITY IN REFERENCE TO A STABBING INCIDENT. UPON ARRIVAL, I MADE CONTACT with THE VICTIM, WHO WAS LYING ON THE FLOOR JUST INSIDE HIS RESIDENCE HOLDING A BLOOD SOAKED SHIRT OVER HIS ABDOMEN. I ASKED THE VICTIM HOW DEEP THE WOUND WAS, TO which HE STATED APPROXIMATELY FOUR INCHES. THE VICTIM ADVISED THAT THE DEFENDANT, MR ANTHONY GHIGLIOTTY HAD STABBED HIM IN THE STOMACH WHILE THEY WERE BOTH AT the LOCATION OF 11570 EAST SALMON DRIVE. THE VICTIM ADVISED THAT AFTER BEING STABBED HE GOT INTO HIS VEHICLE AND DROVE HOME. SEVERAL BYSTANDERS AT THE VICTIM'S RESIDENCE ADVISED THAT the DEFENDANT WAS STILL AT THE INCIDENT ADDRESS. THE VICTIM WAS TRANSPORTED TO CITRUS MEMORIAL HOSPITAL BY MEDIC FIVE. DEPUTY BRIGGS and MYSELF THEN RESPONDED TO THE INCIDENT LOCATION AND MADE CONTACT WITH SEVERAL BYSTANDERS IN THE FRONT YARD WHO POINTED OUT THE DEFENDANT. THE DEFENDANT WAS STANDING WITH HIS SON IN THE DRIVEWAY CLOSE TO THE RESIDENCE. DEPUTY BRIGGS AND MYSELF APPROACHED THE DEFENDANT, AT WHICH TIME, DEPUTY BRIGGS ASKED HIM WHERE THE KNIFE WAS LOCATED THAT HE HAD USED. THE DEFENDANT ADVISED THAT THE KNIFE WAS IN HIS FRONT RIGHT POCKET. THE DEFENDANT WAS THEN SECURED IN HANDCUFFS and SEARCHED, AT WHICH TIME, THE KNIFE WHICH WAS A WINCHESTER FOLDING KNIFE WITH A METAL AND WOOD ACCENTED HANDLE WAS REMOVED FROM HIS FRONT POCKET. THE BLADE ON THE KNIFE WAS APPROXIMATELY FOUR INCHES LONG AND WAS PARTIALLY SERRATED. UPON INSPECTION OF the KNIFE BLADE, I DID OBSERVE A SMALL AMOUNT OF BLOOD and TISSUE IN THE SERRATIONS. AT that TIME, THE DEFENDANT WAS PLACED UNDER ARREST, SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND READ HIS MIRANDA RIGHTS VIA PRE PRINTED CARD. THE DEFENDANT ADVISED THAT HE UNDERSTOOD HIS RIGHTS AND WISHED TO SPEAK WITH LAWYER. THE DEFENDANT'S WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HIS BOND WAS SET AT $5,000.00 PER THE BOND SCHEDULE. PRIOR TO LEAVING THE SCENE DEPUTY BRIGGS TALKED WITH THE DEFENDANT'S SON, WHO WOULD NOT PROVIDE A WRITTEN STATEMENT BUT DID STATE TO DEPUTY BRIGGS THAT HE SAW HIS FATHER EXIT the RESIDENCE, REACH INTO HIS POCKET, PULL SOMETHING OUT AND APPEARED TO BE MAKING MOTION AS UNFOLDING THE KNIFE AND THEN THRUST THE KNIFE ONE TIME INTO THE ABDOMEN OF THE VICTIM. IT SHOULD BE NOTED THAT WHILE REMOVING THE DEFENDANT FROM MY PATROL VEHICLE AFTER TRANSPORT TO THE DETENTION FACILITY HE STATED "THE GUY I STABBED IS A DRUG DEALER" AND "THIS IS WRONG TO DO THIS TO ME IT WAS ONLY A PINCH." THE DEFENDANT ALSO STATED THAT THE VICTIM WAS A DRUG DEALER AND HAD RAN OVER TWO OF HIS BICYCLES and LAUGHED ABOUT IT. THE DEFENDANT ADVISED THAT HE WAS JUST TRYING TO PROTECT HIS SON. *NOT-EXEMPT* |
