Probable cause affidavit: | SUBMITTED BY: WEATHERFORD, D KEAGON 0710 (AR12-2277) THE DEFENDANT DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS IN AN AMOUNT OF MORE THAN TWENTY GRAMS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 080712, I WAS TRAVELING EASTBOUND ON NORTHEAST 5TH STREET JUST EAST OF THE INTERSECTION WITH NORTH SUNCOAST BOULEVARD IN CRYSTAL RIVER WHEN I OBSERVED A BLUE FOUR DOOR VEHICLE, ALSO TRAVELING EASTBOUND IN FRONT OF MY PATROL VEHICLE, WITH AN INOPERABLE TAG LIGHT. I INITIATED BY EMERGENCY EQUIPMENT TO CONDUCT A TRAFFIC STOP AND THE DRIVER/DEFENDANT CAME TO A STOP AT THE INTERSECTION OF NORTHEAST 5TH STREET AND NORTH SUNCOAST BOULEVARD. UPON APPROACHING THE VEHICLE AND MAKING CONTACT WITH THE DRIVER/DEFENDANT, I IMMEDIATELY SMELLED A STRONG ODOR OF CANNABIS. I ASKED THE DRIVER/DEFENDANT FOR HIS DRIVER’S LICENSE, THE VEHICLE REGISTRATION AND PROOF OF VEHICLE INSURANCE. THE DRIVER/DEFENDANT, IDENTIFIED AS MR ANTHONY FRANCIS GIUNTA, THEN HANDED ME HIS DRIVER’S LICENSE. I ADVISED THE DEFENDANT I COULD SMELL A STRONG ODOR OF CANNABIS EMITTING FROM THE VEHICLE AND ASKED HIM IF THERE WAS ANYTHING ILLEGAL IN THE VEHICLE. THE DEFENDANT ADVISED HE HAD JUST PURCHASED THREE OUNCES OF CANNABIS AND THAT IT WAS ON THE PASSENGER SIDE FLOORBOARD OF THE VEHICLE. AT THAT TIME, CANINE DEPUTY VIGGIANO ARRIVED ON SCENE. I ADVISED the DEFENDANT TO ROLL UP HIS WINDOWS AND TURN OFF THE VEHICLE’S ENGINE. CANINE DEPUTY VIGGIANO THEN WALKED CANINE CONAN AROUND THE EXTERIOR OF THE VEHICLE. CANINE DEPUTY VIGGIANO ADVISED THAT CANINE CONAN HAD ALERTED. I HAD THE DEFENDANT STEP OUT OF THE VEHICLE AND THE CANNABIS FROM THE FLOORBOARD WAS RETRIEVED FROM THE VEHICLE. I READ THE DEFENDANT HIS MIRANDA WARNINGS FROM A PREPRINTED AGENCY CARD. THE DEFENDANT STATED HE UNDERSTOOD HIS RIGHTS AND AGREED TO SPEAK WITH ME. I ASKED THE DEFENDANT IF THE CANNABIS BELONGED TO HIM, TO WHICH HE STATED “WHAT CAN I TELL YOU, YOU GOT ME.” I THEN ASKED THE DEFENDANT WHERE HE HAD PURCHASED THE CANNABIS AND HE STATED HE NO LONGER WANTED TO TALK TO ME IF HE WAS GOING TO JAIL. THE DEFENDANT WAS ADVISED HE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF A CONTROLLED SUBSTANCE, CANNABIS IN AN AMOUNT OF MORE THAN TWENTY GRAMS. HE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK, SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. PRIOR TO LEAVING THE SCENE, THE VEHICLE WAS SECURED AND LEFT ON SCENE, PER THE DEFENDANT’S REQUEST. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT WAS BOOKED AND HELD ON A BOND OF $5,000.00, IN ACCORDANCE WITH THE BOND SCHEDULE. WHILE AT THE DETENTION FACILITY, THE DEFENDANT SIGNED A PROPERTY RECEIPT, ACKNOWLEDGING THAT THE CANNABIS HAD BEEN TAKEN FROM HIS POSSESSION. THE CANNABIS WAS WEIGHED AND WEIGHED APPROXIMATELY 84 GRAMS. THE CANNABIS WAS PACKAGED AND LATER TURNED IN TO EVIDENCE. THE DEFENDANT WAS ISSUED WRITTEN WARNING NUMBER 353553B, FOR FAULTY EQUIPMENT, INOPERABLE TAG LIGHT. |
