SUBMITTED BY: STOKES, ERIC 0736 (14-34458) (AR14-9445) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WALMART PASSING ALL POINTS OF SALE MAKING NO ATTEMPT TO PAY FOR THE ITEMS, TO WIT: GENERAL MERCHANDISE, CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTE 812.014(3)(A). ON 031114, I WAS DISPATCH TO WALMART IN LECANTO IN REFERENCE TO A RETAIL THEFT. UPON ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT, MR BRIAN ELAM, WHO IS THE LOSS PREVENTION OFFICER FOR WALMART. MR ELAM ADVISED THAT HE OBSERVED A WHITE MALE/DEFENDANT, MR ANTHONY GOSACK, ENTER THE STORE AND WALK INTO THE AUTOMOTIVE DEPARTMENT WHERE HE SELECTED A FEW ITEMS FROM THE SHELF. THE DEFENDANT THEN BEGAN PACING UP AND DOWN THE AISLES LOOKING FOR SECURITY CAMERAS. HE ADVISED AS THE DEFENDANT WAS WALKING THE AISLES, HE WAS OPENING AND CONCEALING THE MERCHANDISE ON HIS PERSON. HE ADVISED HE CONTINUED TO FOLLOW THE DEFENDANT INTO THE HOUSE WARES DEPARTMENT, AT WHICH TIME HE OBSERVED HIM OPEN ANOTHER PACKAGE AND PLACE THE CONTENTS INTO HIS POCKET. HE ADVISED THE DEFENDANT THEN SELECTED SOME CANDY AND OTHER ITEMS, WENT TO THE POINT OF SALE IN THE GARDEN DEPARTMENT AND PAID FOR THE CANDY AND A FEW OTHER ITEMS. THE DEFENDANT HOWEVER MADE NO ATTEMPT TO PAY FOR THE ITEMS CONCEALED ON HIS PERSON. AS THE DEFENDANT EXITED THE STORE, THE COMPLAINANT APPROACHED HIM, IDENTIFIED HIMSELF AS LOSS PREVENTION AND ESCORTED HIM TO THE LOSS PREVENTION OFFICE WITHOUT FURTHER INCIDENT. LOSS PREVENTION OFFICER ELAM PROVIDED THIS DEPUTY WITH A SWORN WRITTEN STATEMENT AND A REGISTER RECEIPT FOR THE ITEMS TAKEN AND RECOVERED WHICH WILL BE TURNED IN TO RECORDS. I SPOKE WITH THE DEFENDANT WHO ADVISED THAT HE WAS GOING INTO FORECLOSURE AND WAS UNABLE TO PAY FOR ALL OF THE ITEMS HE HAD SELECTED TODAY. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED, BEHIND HIS BACK, (DOUBLE LOCKED), SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANTâS BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. THE ITEMS THE DEFENDANT DID PURCHASE WERE BAGGED IN A WALMART BAG ALONG WITH HIS PERSONAL ITEMS AND WERE TURNED IN TO HIS PROPERTY AT THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANT WAS TRESPASSED FROM THE WALMART IN LECANTO AS WELL AS ANOTHER WALMART IN OCALA WHERE THE DEFENDANT HAD BEEN CAUGHT SHOPLIFTING PREVIOUSLY, HOWEVER WAS NOT CHARGED AT THAT TIME DUE TO THE FACT THAT THE AMOUNT WAS LESS THAN $20.00. |
