Probable cause affidavit: SUBMITTED BY: HRYC, CHRISTOPHER 0701 (AR10115631) DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: PUNCHED THE VICTIM WITH HIS LEFT CLOSED FIST IN the FACE, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 070210, WHILE PERFORMING A SECURITY check OF TUGG'S AS IT CLOSED AT 0200 HOURS, I WITNESSED THE DEFENDANT, MR ANTHONY SOLOMON, COME OUT OF THE ESTABLISHMENT AND HE WAS OBVIOUSLY INTOXICATED. I KNEW THIS BECAUSE I OBSERVED HIM SHOUTING AND BEING OBNOXIOUS. THE DEFENDANT BEGAN TO SPEAK WITH DEPUTY ANSTEAD, AND SHE ADVISED THE DEFENDANT THAT IT would BE IN HIS BEST INTEREST IF HE LEFT. I THEN WATCHED THE DEFENDANT WALK AWAY TO AN UNKNOWN LOCATION, RETURNING A SHORT TIME LATER. HE THEN BEGAN TO VERBALLY ARGUE with the VICTIM, AT WHICH TIME MYSELF and DEPUTY ANSTEAD WITNESSED THE DEFENDANT STRIKE THE VICTIM with HIS CLOSED LEFT FIST IN the FACE. AT THAT TIME THE DEFENDANT WAS HANDCUFFED (DOUBLE- LOCKED) AND SECURED IN the REAR OF MY PATROL VEHICLE. I THEN SPOKE WITH THE VICTIM AND ASKED HIM IF HE KNEW the DEFENDANT OR WHY HE WOULD PUNCH HIM. THE VICTIM STATED THAT HE DID NOT KNOW the DEFENDANT, AND THAT the ARGUMENT WAS OVER The VICTIM ASKING THE DEFENDANT TO LEAVE DUE TO THE DEFENDANT INVADING HIS PERSONAL SPACE, AT WHICH TIME the DEFENDANT DISAGREED WITH THE VICTIM. THE DEFENDANT BECAME VERY CONFRONTATIONAL, AT WHICH TIME HE STRUCK THE VICTIM IN THE FACE. AT NO TIME DID THE VICTIM ATTEMPT TO STRIKE THE DEFENDANT. I DID NOT OBSERVE ANY VISIBLE INJURIES TO THE VICTIM. THE VICTIM WAS OFFERED EMERGENCY MEDICAL SERVICES (EMS), WHICH HE DECLINED. I ISSUED THE VICTIM AN AGENCY CASE CARD BEARING THE CASE NUMBER AND MY NAME. THE DEFENDANT WAS TRESPASSED FROM TUGG'S BY TELETYPE OPERATOR 0610. I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. WHILE EN ROUTE TO THE DETENTION FACILITY, I COULD SMELL THE ODOR OF AN ALCOHOLIC BEVERAGE COMING FROM THE DEFENDANT, AND THE DEFENDANT PASSED OUT IN MY BACK SEAT. UPON ARRIVAL AT THE DETENTION FACILITY, I OPENED THE DOOR AND ASKED THE DEFENDANT TO STEP OUT. THE DEFENDANT GAVE THIS DEPUTY A VERY HARD TIME AND WOULD NOT EXIT MY PATROL VEHICLE. AS HE BEGAN TO ATTEMPT TO STAND UP HE VOMITED ON HIMSELF. HE WAS THEN TURNED OVER TO THE DETENTION FACILITY PERSONNEL FOR PROCESSING. THE DEFENDANT'S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. *NOT-EXEMPT*
