Probable cause affidavit: SUBMITTED BY: BERGEN, JOHN 0519 (AR11123887) On 121011, Your Affiant was working an off duty detail at the Rock Crusher Canyon Concert. I was working with Detective Pruitt and was clearly identifiable in my agency uniform. At approximately 2230 hours, a female concert attendee approached Detective Pruitt and I and told us that there was a fight going on and that the event security guards were trying to break it up. She then pointed to the area where the fight was OCCURRING. Detective Pruitt and I responded to the area where there was a crowd of twenty to thirty people AND as I got about five feet away, I observed an event security guard get shoved out of the crowd by an unknown subject. I then made my way to the center of the crowd where I observed a female, later identified as MS April Kohler CRISWELL (defendant ONE) AGGRESSIVELY reaching out toward other subjects who were being held back by the crowd. I used both of my arms to separate them and stated that they better stop fighting if they did nOt want to go to THE DETENTION FACILITY. Detective Pruitt was announcing "Sheriff's Office, break it up." After being SEPARATED, defendant one looked right at me and then struck me with an open hand on the left side of my face near my temple. I then grabbed defendant one's jacket and told her she was under arrest and she began pulling away from me and screaming. I then relayed over the radio that we needed assistance. Detective Pruitt then assisted me in grabbing defendant one. Defendant one and Detective Pruitt began struggling. with defendant one, Detective Pruitt continually ordered her "Sheriff's Office get on the ground". they then fell to the ground where the defendant was fighting with Detective Pruitt and pulling her hair. At that time defendant two, MR Fred Criswell, who is defendant one's husband, ripped off his coat and began to advance toward me in an aggressive manner stating "that's my wife and you got no right to put your hands on her". When he was within two feet of me, I drew my agency issued taser and turned it on. I then ordered him to "get back". He did step back a few feet, however, he was becoming increasingly enraged and was screaming at me to get off his wife. I then turned my attention toward Detective Pruitt who was still wrestling with defendant one. At that time, defendant two advanced on me again causing me to not be able to assist Detective Pruitt for fear of being attacked. At that time, Detective Callahan was arriving and I looked back to see Detective Pruitt still on the ground. When I looked back, Detective Callahan had a hold of defendant two and I assisted him in taking him to thE ground. Defendant two went to his knees, however, would not respond to repeated commands to "get down and give us your hands". I then used my right leg and my left hand three times to try to push the defendant over. All my attempts to gain his compliance to lie on the ground were unsuccessful. Detective Callahan and I were able to get his hands behind his back and get him handcuffed. Defendant one was taken into custody by other deputies and both defendants were escorted out of the concert. At the front gate area, they were searched and I made sure that the handcuffs were double locked and they were placed in the rear of a waiting patrol VEHICLE and transported to the Citrus County Detention Facility. DEFENDANT ONE'S BOND WAS SET AT $5,000.00 FOR BATTERY ON A LAW ENFORCEMENT OFFICER AND $500.00 FOR RESISTING A LAW ENFORCEMENT OFFICER WITHOUT VIOLENCE PER THE BOND SCHEDULE. DEFENDANT TWO'S BOND WAS SET AT $500.00 FOR RESISTING A LAW ENFORCEMENT OFFICER WITHOUT VIOLENCE PER THE BOND SCHEDULE.
