SUBMITTED BY: CROSNOE, ROBERT 0234 (AR16-18899) DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: PUNCHED AND ELBOWED THE VICTIM IN THE FACE, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). DID UNLAWFULLY, WILLFULLY AND MALICIOUSLY INJURE OR DAMAGE CERTAIN PROPERTY OF TERRI'S TAXI, TO-WIT: GRABBED THE REARVIEW MIRROR AND RIPPED IT OFF THE WINDSHIELD CAUSING THE WINDSHIELD TO CRACK, SAID DAMAGE BEING OF A VALUE OF $200.00 OR MORE BUT LESS THAN $1,000.00, IN VIOLATION OF FLORIDA STATUTE 806.13(1)(B)(2). ON 040316 AT APPROXIMATELY 0113 HOURS, I WAS DISPATCHED TO THE INTERSECTION OF SOUTH APOPKA AVENUE AND EAST HILL STREET, IN REFERENCE TO A BATTERY IN PROGRESS. DISPATCH INFORMED ME THAT THE VICTIM WAS GOING TO BE TERRI'S TAXI AND THE DRIVER HAD BEEN ATTACKED BY A HISPANIC FEMALE. WHEN I ARRIVED AT THE INTERSECTION, I IMMEDIATELY OBSERVED A HISPANIC FEMALE WEARING A BLUE TANK TOP AND KHAKI PANTS PUSHING A WHITE MALE WHO WAS TRYING TO KEEP HER FROM GOING TOWARDS THE TAXI. I IMMEDIATELY WAS ABLE TO CALM THE SCENE DOWN AND HAD THE HISPANIC FEMALE, LATER IDENTIFIED AS THE DEFENDANT, MS APRIL SOTO, SIT ON THE GROUND NEXT TO THE INTERSECTION. AT THAT TIME, I MADE CONTACT WITH THE VICTIM, MR RICHARD ROBINSON, WHO IS A TAXI DRIVER FOR TERRI'S TAXI. THE VICTIM INFORMED ME THAT HE PICKED THE DEFENDANT, ALONG WITH THREE OF HER FRIENDS, UP AT A LOCAL BAR AND WAS TAKING THEM TO AN ADDRESS IN THE HIGHLANDS. THE VICTIM INFORMED ME THAT THE THREE FEMALES WHO WERE SITTING IN THE BACK SEAT STARTED GETTING VERY VERBALLY ABUSIVE TOWARDS HIM AND STARTED TO GET OUT OF HAND. THE VICTIM STATED THAT HE STOPPED THE TAXI ON SOUTH APOPKA AVENUE AT THE INTERSECTION OF EAST HILL STREET. WHEN HE STOPPED THE TAXI, THE VICTIM ASKED ALL FOUR PASSENGERS TO GET OUT OF HIS TAXI. IMMEDIATELY, THE HISPANIC FEMALE ATTACKED HIM FROM THE REAR SEAT AND STARTED PUNCHING HIM AND ELBOWING HIM IN THE FACE. THE MALE PASSENGER WAS ATTEMPTING TO STOP THE HISPANIC FEMALE FROM ATTACKING THE VICTIM AND IN THE PROCESS ALSO STRUCK THE VICTIM IN THE FACE. THE VICTIM WAS VERY ADAMANT ABOUT PRESSING CHARGES, DUE TO HIM BEING ATTACKED FROM THE REAR SEAT. THE VICTIM'S HAIR WAS EXTREMELY MESSED UP AND HIS FACE WAS RED, BUT I WAS UNABLE VIEW ANY DISTINGUISHING BRUISES OR SCRATCHES. AT THAT TIME, I MADE CONTACT WITH THE DEFENDANT, WHO WAS EXTREMELY INTOXICATED AND ONLY TOLD ME THAT SHE DID IT, JUST ASK THE TAXI DRIVER. I ASKED THE DEFENDANT IF SHE WOULD PROVIDE A SWORN WRITTEN STATEMENT, TO WHICH SHE REFUSED. I PLACED THE DEFENDANT UNDER ARREST FOR BATTERY AND PLACED HER IN THE REAR OF MY PATROL VEHICLE. AS I DID THIS, THE VICTIM APPROACHED ME AND INFORMED ME THAT THE DEFENDANT HAD GRABBED THE REARVIEW MIRROR AND RIPPED IT OFF OF THE WINDSHIELD, CAUSING THE WINDSHIELD TO CRACK. WITH THAT INFORMATION, I INFORMED THE DEFENDANT THAT SHE WAS BEING CHARGED WITH SIMPLE BATTERY AND CRIMINAL MISCHIEF. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANT WAS CHARGED WITH BATTERY WITH A BOND OF $1,000.00 AND CRIMINAL MISCHIEF WITH A BOND OF $1,000.00, FOR A TOTAL BOND AMOUNT OF $2,000.00, PER THE BOND SCHEDULE. |
