SUBMITTED BY: CREEL, JUSTIN 0661 (AR13-6204) did knowingly, actually and intentionally touch or strike OFFICER CRUZ, a LAW ENFORCEMENT OFFICER, against the will of that person while knowing that the said OFFICER was engaged in a lawful performance of HIS legal duties, in violation of Florida Statute 784.07(2); ON 062313, AT APPROXIMATELY 2330 HOURS, I RESPONDED TO CITRUS MEMORIAL HOSPITAL, LOCATED AT 502 WEST HIGHLAND BOULEVARD, INVERNESS, IN REFERENCE TO A BATTERY ON A LAW ENFORCEMENT OFFICER WHICH HAD ALREADY OCCURRED. UPON MY ARRIVAL, I MADE CONTACT WITH THE VICTIM, MR RENE CRUZ, WHO WORKS AT CYPRESS CREEK ACADEMY, WHICH IS A CORRECTIONAL JUVENILE OFFENDER CENTER, AS A CORRECTIONS OFFICER. THE VICTIM ADVISED THAT WHILE HE WAS ATTEMPTING TO SECURE THE DEFENDANTS IN THEIR CELLS FOR THE EVENING, HE HAD BEEN PUNCHED IN THE FACE BY DEFENDANT, MR JEFFREY ORYS. THE VICTIM STATED THAT HE THEN DIRECTED DEFENDANT MR ORYS TO THE GROUND, AND THAT DEFENDANT MR ARTEUS SMITH HAD THEN GRABBED HIM FROM BEHIND, HOLDING HIM BACK AWAY FROM DEFENDANT MR ORYS. THE VICTIM STATED THAT WHILE DEFENDANT MR SMITH HELD HIM BACK, DEFENDANT MR ORYS THEN PUNCHED HIM IN THE MOUTH, BUSTING HIS TOP AND BOTTOM LIP. I THEN RESPONDED TO CYPRESS CREEK ACADEMY, LOCATED AT 2855 W WOODLAND RIDGE DRIVE, LECANTO. I MADE CONTACT WITH BOTH DEFENDANTS, AND PRIOR TO INTERVIEWING THEM SEPARATELY, I READ BOTH DEFENDANTS THEIR MIRANDA RIGHTS, VIA A PREPRINTED AGENCY ISSUED CARD, AND ASKED THEM IF THEY UNDERSTOOD THEIR RIGHTS, AND WISHED TO CONTINUE SPEAKING WITH ME. BOTH DEFENDANTS STATED THAT THEY DID UNDERSTAND THEIR RIGHTS, BUT DID NOT WISH TO SPEAK WITH ME. BOTH DEFENDANTS WERE THEN ADVISED THAT THEY WERE BEING PLACED UNDER ARREST, FOR BATTERY ON A LAW ENFORCEMENT OFFICER. THEY WERE EACH HANDCUFFED, DOUBLE LOCKED BEHIND THEIR BACKS, AND SECURED IN THE REAR OF MY PATROL VEHICLE. I THEN TRANSPORTED THE DEFENDANTS TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL, THEY WERE RELEASED TO DETENTION FACILITY STAFF, FOR BOOKING AND PROCESSING. EACH DEFENDANT WAS CHARGED WITH ONE COUNT OF BATTERY ON A LAW ENFORCEMENT OFFICER, WITH THEIR BOND SET AT , PER THE BOND SCHEDULE. |
