SUBMITTED BY: CULBERTSON, CHRIS 0439 (AR10118112) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, SWEET BAY SUPERMARKET, TO WIT: GLADE OIL REFILLS, SAID PROPERTY BEING OF A VALUE OF $6.76 INCLUDING TAX, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA'S STATE STATUTES 812.014(3)(a). ON 112610 I RESPONDED TO SWEET BAY SUPERMARKET LOCATED AT 1202 WEST MAIN STREET IN INVERNESS, IN REFERENCE TO A THEFT THAT HAD ALREADY OCCURRED. UPON ARRIVAL, I MADE CONTACT WITH DEPUTY HOWARD WHO WAS ALREADY ON SCENE. DEPUTY HOWARD ADVISED THAT THE STORE MANAGER, MR DONALD ZENN, HAD OBSERVED THE DEFENDANT, MS ASHLEY HAMILTON, REMOVE TWO BOXES OF GLADE PLUG-IN OILS AND STUFF THE BOXES IN THE VERY BACK OF THE SHELF. MR ZENN OBSERVED THE DEFENDANT AT THE REGISTER AND WAS BAGGING HER GROCERIES. AFTER HE WAS FINISHED, HE INTRODUCED HIMSELF AND ASKED HER TO STEP INTO HIS OFFICE AT WHICH TIME SHE ADMITTED TO TAKING THE ITEMS. I OBSERVED THE BOXES WHICH WERE TORN OPEN AND THE REFILLS REMOVED. DEPUTY HOWARD ADVISED THAT HE HAD READ MS HAMILTON HER MIRANDA RIGHTS AND SHE HAD ADMITTED TO HIM THAT SHE TOOK THE ITEMS. I RECEIVED A STATEMENT FROM MR ZENN AND A COPY OF THE STORE SECURITY FOOTAGE WHICH WILL BE TURNED IN TO EVIDENCE. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED, BEHIND HER BACK, (DOUBLE LOCKED), SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT WAS CHARGED WITH RETAIL PETIT THEFT AND RELEASED ON HER OWN RECOGNIZANCE.
