SUBMITTED BY: MARSHALL, AIDAN 0453 (AR08102688) DID UNLAWFULLY AND WILLFULLY ENTER OR REMAIN IN A STRUCTURE OR BUSINESS, TO WIT: GABBY'S BAR, THE PROPERTY OF THE VICTIM, WITHOUT BEING AUTHORIZED, LICENSED, OR INVITED TO DO SO BY THE OWNER, LESSEE, OR THEIR AGENT, AND AFTER HAVING BEEN ADVISED OF THE TRESPASS, IN VIOLATION OF FLORIDA STATE STATUTE 810.09(2)(B) AND DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY AIDAN MARSHALL, A DEPUTY SHERIFF WITH THE CITRUS COUNTY SHERIFF'S OFFICE, WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: TRESPASSING THE DEFENDANT FROM THE PROPERTY, WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. ON 041308 AT APPROXIMATELY 0200 HOURS, I WAS ON A SECURITY CHECK AT GABBY'S BAR LOCATED AT 1801 NORTHWEST HIGHWAY 19 IN CRYSTAL RIVER, IN THE CRYSTAL RIVER MALL. THE BUSINESS HAD CLOSED AND PATRONS WERE MAKING THEIR WAY THROUGH THE PARKING LOT TO THEIR VEHICLES. I OBSERVED A GROUP OF APPROXIMATELY TEN PEOPLE ENGAGED IN A VERBAL ALTERCATION NEAR THE ENTRANCE. I OBSERVED THE SECURITY PERSONAL ATTEMPTING TO RESOLVE THE SITUATION, AT WHICH TIME THEY CALLED FOR THE ASSISTANCE OF THE SHERIFF'S OFFICE. DEPUTY LAMBERT AND I APPROACHED THE GROUP. DEPUTY LAMBERT STATED SEVERAL LOUD VERBAL COMMANDS TO THE GROUP TO DISPERSE AND GO TO THEIR VEHICLES. APPROXIMATELY FIVE TO SIX PEOPLE IN THE GROUP REFUSED TO LEAVE AND AT THAT TIME AN INDIVIDUAL BY THE NAME OF MR BENJAMIN JOHNSON BEGAN YELLING AT DEPUTY LAMBERT. DEPUTY LAMBERT AGAIN ADVISED MR JOHNSON TO LEAVE, TO WHICH MR JOHNSON IGNORED DEPUTY LAMBERT'S COMMAND. IT WAS AT THAT TIME, THE STAFF OF GABBY'S REQUESTED THAT MR JOHNSON BE TRESPASSED FROM THE PREMISES. DEPUTY LAMBERT THEN ADVISED MR JOHNSON THAT HE WAS TRESPASSED AND THAT IF HE DID NOT LEAVE HE WOULD BE SUBJECT TO ARREST. DURING THIS TIME, THE DEFENDANT, LATER IDENTIFIED AS MR AYODELE BAJOMO, BEGAN SHOUTING AT DEPUTY LAMBERT, MAKING STATEMENTS THAT HE HAD BEEN TO JAIL AND DID NOT CARE IF HE GOES BACK. THE STAFF OF GABBY'S ADVISED ME THEY WISHED TO HAVE MR BAJOMO TRESPASSED ALSO. I ADVISED MR BAJOMO TO LEAVE THE PREMISES AND THAT HE WAS TRESPASSED, TO WHICH HE IGNORED MY COMMANDS. AT THAT POINT, MR JOHNSON APPROACHED ME AND BEGAN YELLING CLOSE TO MY FACE WHERE I ADVISED HIM TO STEP BACK OR HE WOULD GO TO JAIL. MR BAJOMO AND MR JOHNSON CONTINUED TO YELL AT BOTH DEPUTY LAMBERT AND I WHILE REFUSING NUMEROUS COMMANDS TO LEAVE THE PREMISES DUE TO THE FACT THEY WERE BOTH TRESPASSED. IT WAS AT THAT TIME THAT DEPUTY LAMBERT ADVISED MR JOHNSON HE WAS BEING PLACED UNDER ARREST. WHILE ATTEMPTING TO HANDCUFF MR JOHNSON, MR BAJOMO REACHED TOWARD MR JOHNSON'S HANDS WHERE DEPUTY LAMBERT WAS UTILIZING HIS HANDCUFFS. I ADVISED MR BAJOMO THAT HE WAS UNDER ARREST. I PLACED HIS RIGHT HAND IN HANDCUFFS AND IMMEDIATELY BEGAN TO PULL HIS LEFT ARM AWAY FROM DEPUTY LAMBERT IN ORDER TO COMPLETE HANDCUFFING MR BAJOMO BEHIND HIS BACK. MR BAJOMO TENSED BOTH HIS ARMS IN AN ATTEMPT TO HINDER MY ABILITY TO HANDCUFF BOTH OF HIS WRISTS. I CONTINUED TO HOLD MR BAJOMO'S LEFT ARM AND ADVISED HIM AGAIN TO PLACE IT BEHIND HIS BACK, TO WHICH HE CONTINUED TO RESIST. I ADVISED MR BAJOMO THAT IF HE DID NOT PLACE HIS HANDS BEHIND HIS BACK, HE WOULD BE TASERED, TO WHICH HE IMMEDIATELY COOPERATED AND PLACED HIS HAND BEHIND HIS BACK WHERE I COMPLETED HANDCUFFING HIM (DOUBLE LOCKED) BEHIND HIS BACK . MR BAJOMO WAS SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND ADVISED HE WAS BEING ARRESTED FOR TRESPASS AFTER WARNING AND RESISTING ARREST WITHOUT VIOLENCE. I ALSO OBSERVED DEPUTY LAMBERT PLACE MR JOHNSON IN THE REAR SEAT OF HIS PATROL VEHICLE. MR BAJOMO WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL, HIS BOND WAS SET AT A TOTAL OF $1,000.00, PER THE BOND SCHEDULE. *NOT-EXEMPT* |
