DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: A FLAT SCREEN TELEVISION AND JEWELRY, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN TWENTY THOUSAND DOLLARS ($20,000.00), TO WIT: THE WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)(C)(3). did unlawfully traffic in or endeavor to traffic in property that THE DEFENDANT knew or should have known was stolen, to-wit: THE DEFENDANT SOLD THE VICTIM'S JEWELRY AND PROPERTY, in violation of Florida Statute 812.019(1). did unlawfully enter or remain in a certain conveyance, without said person's consent, with the intent to commit an offense therein, to-wit: PETIT THEFT, THE DEFENDANT DID REMOVE THE VICTIM'S PURSE, in violation of Florida Statute 810.02(4)(B). DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: THE VICTIM'S PURSE AND MISCELLANEOUS ITEMS, OF THE VALUE OF $100.00 OR MORE BUT LESS THAN $300.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, AND THE PROPERTY WAS TAKEN FROM A DWELLING OR FROM THE UNENCLOSED CURTILAGE OF A DWELLING, IN VIOLATION OF FLORIDA STATUTE 812.014(2)(E). ON 060711 A BURGLARY WAS REPORTED ALONG WITH A GRAND THEFT, CASE 11060267 AT 8849 NORTH IRA MARTIN IN CRYSTAL RIVER. THE VICTIM, MS ELIZABETH HUGHES, REPORTED AN UNKNOWN PERSON OR PERSONS ENTERED HER RESIDENCE AND REMOVED JEWELRY AND A FLAT SCREEN TELEVISION withOUT HER CONSENT. THE VICTIM STATED THE TOTAL LOSS WAS IN EXCESS OF $10,000.00. ON 080511, A POST MIRANDA DIGITALLY RECORDED INTERVIEW WAS CONDUCTED AT THE CITRUS COUNTY SHERIFF'S DETENTION FACILITY. DURING THE INTERVIEW, THE DEFENDANT ADMITTED THAT CO-DEFENDANT ASHLEY PHELPS AND HIMSELF DID, IN FACT, GO THE VICTIM'S RESIDENCE AND REMOVE THE JEWELRY AND THE TELEVISION. DURING THE INTERVIEW BOTH DEFENDANTS ACCUSED EACH OTHER OF COMMITTING THE GRAND THEFT AND THE BURGLARY BUT DID ADMIT TO BEING PRESENT AT THE TIME OF THE GRAND THEFT AND THE BURGLARY. BOTH THE DEFENDANTS STATED THAT THE TELEVISION WAS SOLD AT AN UNKNOWN PAWN SHOP IN LEVY COUNTY TO HELP PAY THE COURT COSTS FOR DEFENDANT PHELPS. THE JEWELRY WAS SOLD TO AN UNKNOWN GOLD BUYER IN THE CITRUS COUNTY AREA. ON 073111 THE DEFENDANT DID IN FACT COMMIT THE OFFENSE OF BURGLARY AT 1449 SOUTH SKYWAY AVENUE IN HOMOSASSA. SEE CASE 11071264. the DEFENDANT WAS PREVIOUSLY CHARGED WITH the BURGLARY ON 080511. DURING A POST MIRANDA INTERVIEW, IT WAS LEARNED SOME OF THE STOLEN JEWELRY WAS SOLD TO A WALTER BALDWIN. THE ITEMS WERE LATER RECOVERED FOR MR BALDWIN WHO STATED THAT BARNEY HUNTER ADVISED THAT THE ITEMS HE WAS SELLING WERE HIS OWN. THE JEWELRY WAS IDENTIFIED BY THE VICTIM, MS DORIS HAMILTON. ACCORDING TO THE STATEMENT BY MR BALDWIN, THE DEFENDANT SOLD THE JEWELRY FOR THE PRICE OF $300.00. DUE TO THE FACT THE DEFENDANT SOLD THE JEWELRY, HE WAS BEING CHARGED WITH DEALING IN STOLEN PROPERTY. ON 073111 A BURGLARY OF A CONVEYANCE AND A PETIT THEFT WAS REPORTED AT 6760 WEST GULF TO LAKE HIGHWAY IN CRYSTAL RIVER. SEE CASE 11071260. THE VICTIM, VIRGINIA HAWE, ADVISED THAT AN UNKNOWN PERSON BROKE THE SIDE WINDOW TO HER 1994 TOYOTA. SHE STATED THAT WITHOUT HER PERMISSION THEY THEN ENTERED HER PURSE WHICH CONTAINED $50.00 IN CASH, CREDIT CARDS AND OTHER MISCELLANEOUS ITEMS, ALONG WITH TWO BAGS OF PUBLIX SPECIAL ROAST COFFEE. THE DEFENDANT, ALONG WITH THE CO-DEFENDANT, ASHLEY PHELPS, DURING THE POST MIRANDA DIGITALLY RECORDED INTERVIEW, ADVISED THEY WENT TO THE PUBLIX PARKING LOT AND BROKE THE WINDOW OUT OF THE VICTIM'S VEHICLE. BIRTH DEFENDANTS AGAIN ADMITTED TO BEING PRESENT, BUT ACCUSED ONE ANOTHER OF ACTUALLY COMMITTING THE BURGLARY. AFTER THE BURGLARY, THE DEFENDANT ATTEMPTED TO USE THE VICTIM'S CREDIT CARD AT THE KANGAROO GAS STATION AT HIGHWAY 44 AND ROCK CRUSHER, BUT WAS DENIED DUE TO NOT HAVING THE CORRECT ZIP CODE. ON 082411 CONTACT WAS MADE WITH THE DEFENDANT VIA TELEPHONE AND ARRANGEMENTS WERE MADE FOR THE DEFENDANT TO MEET THIS DEPUTY AT THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS BOOKED IN AND HELD ON A COMBINED BOND OF $17,500.00.
