Probable cause affidavit: | SUBMITTED BY: LAHERA, ANDRES 0673 (16-121146) (AR16-20962) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: PRESCRIPTION MEDICATION 14 OXYCODONE WHICH ARE CLASSIFIED AS A SCHEDULE II NARCOTIC, OF THE VALUE OF $100.00 OR MORE BUT LESS THAN $300.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, AND THE PROPERTY WAS TAKEN FROM A DWELLING OR FROM THE UNENCLOSED CURTILAGE OF A DWELLING, IN VIOLATION OF FLORIDA STATUTE 812.014(2)(C)(13) ON 090616, I WAS ASSIGNED CASE NUMBER 16-121146 IN REFERENCE TO A THEFT OF MEDICATION. I WAS ABLE TO MEET WITH THE COMPLAINANT, MS CARMEN DOCKHAM, WHO IS THE SUPERVISOR OF CITRUS HEALTH AND REHAB. THE COMPLAINANT ADVISED ON 090316 THE DEFENDANT, MS BEATRICE SHREWBURY, HAD BEEN SENT HOME AS SHE APPEARED TO BE UNDER THE INFLUENCE OF SOME TYPE OF NARCOTIC OR ALCOHOL. WHEN THEY QUESTIONED HER ABOUT THE MEDICATION COUNT SHE INFORMED THEM SHE HAD LOST THE SHEET AND DID NOT KNOW WHERE IT WAS. THEY THEN REQUESTED THE DEFENDANT TO TAKE A DRUG TEST WHICH WAS PERFORMED. THE COMPLAINANT ADVISED SHE WAS CALLING THE POLICE AND SHE WANTED THE DEFENDANT TO WAIT SO THAT THIS INCIDENT COULD BE REPORTED. THE COMPLAINANT ADVISED THE DEFENDANT JUST LEFT PRIOR TO OUR ARRIVAL. ON 091216 WHILE CONDUCTING A FOLLOW-UP, THE COMPLAINANT ADVISED THEY HAD CAPTURED THE THEFT OF MEDICATION ON VIDEO AND IT CLEARLY SHOWS THE DEFENDANT GOING THROUGH THE MEDICATION DRAWER AND HAD STOPPED, ONLY LOOKING IN ONE AREA OF THE MEDICATIONS AND IT APPEARS SHE IS POPPING OUT PILLS FROM THE BLISTER PACKS. THE DEFENDANT THEN APPEARS TO BE SCOOPING SOMETHING FROM THE BOTTOM OF THE DRAWER AND PLACES IT IN HER LEFT HAND. I REVIEWED THE VIDEO AND WAS ABLE TO SEE WHAT WAS DESCRIBED TO ME. WHILE WATCHING THE VIDEO, IT IS CLEAR THE DEFENDANT HAS SOMETHING CLENCHED IN HER LEFT HAND AS SHE IS WALKING AROUND. THE COMPLAINANT WENT ON TO EXPLAIN THAT THE DEFENDANT WAS THE ONLY ONE WITH THE KEY OR ACCESS TO THE MEDICATION DRAWER. BEFORE THE DEFENDANTâS SHIFT THE MEDICATION COUNT WAS CORRECT. ON 091416, I MET WITH THE DEFENDANT AND INTRODUCED MYSELF. I ADVISED HER THAT SHE WAS LISTED AS A SUSPECT IN THIS REPORT AND I THEN READ THE DEFENDANT MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD IN THE DRIVEWAY OF HER RESIDENCE. I ASKED IF SHE COULD TELL ME WHAT HAD HAPPENED. SHE EXPLAINED THAT SHE WORKED A BUNCH OF DOUBLE SHIFTS AND CAN NOT TELL ME EXACTLY BUT THINKS SHE WENT IN TO WORK AT 0645 HOURS AND HER BOSS/COMPLAINANT CAME UP TO HER AND TOLD HER SHE NEEDED TO GO HOME. I QUESTIONED THE DEFENDANT IF SHE TAKES PRESCRIPTION MEDICATIONS AND SHE ADVISED SHE DOES AND HAS SOME FOR HIGH BLOOD PRESSURE AND HAS TAKEN PAIN MEDICATION IN THE PAST TO INCLUDE PERCOCET AND CODEINE. I QUESTIONED IF SHE EVER HAD A PRESCRIPTION FOR OXYCODONE AND SHE ADVISED SHE HAD HURT HER HIP AND SHE DID BELIEVE SHE HAS A PRESCRIPTION FOR OXYCODONE SOME TIME BACK. I THEN QUESTIONED IF SHE COULD TELL ME THE LAST TIME SHE TOOK AN OXYCODONE AND SHE STATED AT LEAST TWO WEEKS AGO. I ADVISED HER THAT ALL OF THIS WAS CAPTURED ON VIDEO SURVEILLANCE AND I WOULD BE PLACING HER UNDER ARREST FOR THEFT OF MEDICATION AND HER HONEST WOULD GO A LONG WAY. SHE ADVISED SHE DOES NOT KNOW WHAT HAPPENED OR WHY SHE TOOK THE PILLS. I THEN ASKED IF SHE TOOK THEM ALL AT ONE TIME AND SHE SAID NO, SHE WOULD HAVE BEEN DEAD. I THEN QUESTIONED HOW MANY PILLS SHE TOOK AND SHE STATED SHE DID NOT KNOW AND COULD NOT RECALL. THE DEFENDANT WAS HANDCUFFED, (DOUBLE LOCKED), IN FRONT, AND THEN REQUESTED HER ATTORNEY. THE DEFENDANT WAS SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED. TO THE CITRUS COUNTY DETENTION FACILITY. ON THE WAY TO THE CITRUS COUNTY DETENTION FACILITY SHE ADVISED SHE TOOK A MUSCLE RELAXER THE NIGHT BEFORE THE INCIDENT AND IT MUST HAVE DONE SOMETHING TO HER AS SHE COULD NOT REMEMBER ANYTHING THAT HAPPENED. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WITHOUT INCIDENT. THE DEFENDANTâS BOND WAS SET AT $2,000.00, PER THE BOND SCHEDULE. |
