Probable cause affidavit: submitted by: CHENOWETH, JACOB 0708 (AR12-1550) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A); AND DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: OXYCODONE 30 MILLIGRAMS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A); DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WALMART, TO WIT: FOUR PIECES OF BATHING SUIT SEPARATES AND THREE PAIRS OF SHORTS. CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.014(3)(A). ON 061211 AT APPROXIMATELY 0406 HOURS, I WAS DISPATCHED TO 6885 SOUTH SUNCOAST BOULEVARD (WALMART), IN HOMOSASSA, IN REFERENCE TO A THEFT IN PROGRESS. WHILE EN ROUTE TO WALMART, I WAS ADVISED THAT THE SUSPECT WAS A WHITE FEMALE APPROXIMATELY 5’8” 150 POUNDS WITH DARK HAIR AND BLUE JEANS. DISPATCH ALSO ADVISED THAT THE FEMALE HAD GOTTEN INTO A WHITE DODGE PICKUP BEARING FLORIDA TAG 7792JS AND HAD LEFT THE STORE. UPON ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT/WITNESS, LOSS PREVENTION OFFICER CASEY CLARKSON, WHO ADVISED THAT HE WITNESSED A FEMALE SUBJECT SHOWING SUSPICIOUS BEHAVIOR. CLARKSON STARTED TO WATCH THE FEMALE SUBJECT, AT WHICH TIME, HE WITNESSED THE FEMALE SUBJECT SELECT MULTIPLE CLOTHING ITEMS. THE FEMALE SUBJECT THEN MADE HER WAY TO THE WOMAN’S UNDERWEAR SECTION WHERE SHE THEN CONCEALED THE CLOTHING ITEMS IN HER BLACK AND WHITE ZEBRA PURSE. THE FEMALE SUBJECT THEN CONTINUED SHOPPING AND PAID FOR THE OTHER MERCHANDISE IN HER CART. THE FEMALE SUBJECT THEN PASSED THROUGH THE EAS SYSTEM MAKING NO ATTEMPT TO PAY FOR THE MERCHANDISE CONCEALED IN HER PURSE. AT WHICH TIME, MR CLARKSON CONTACTED THIS AGENCY. MR CLARKSON COMPLETED A SWORN WRITTEN STATEMENT, WHICH WILL BE TURNED IN TO RECORDS. I REQUESTED MR CLARKSON TO ALLOW ME TO SEE THE VIDEO SURVEILLANCE OF THE STORE, AT WHICH TIME, HE ADVISED THEY WERE HAVING COMPUTER PROBLEMS AND WOULD BE ABLE TO PRODUCE A COPY OF THE SURVEILLANCE FOOTAGE WHEN HIS MANAGER RESPONDED TO WORK. MR CLARKSON ADVISED THAT HE WOULD BE ABLE TO POSITIVELY IDENTIFY THE FEMALE SUBJECT IF HE SAW HER AGAIN. DEPUTY VICK THEN CONDUCTED A TRAFFIC STOP ON A WHITE DODGE PICKUP BEARING FLORIDA TAG 7792JS, AT THE INTERSECTION OF SOUTH SUNCOAST BOULEVARD AND WEST YULEE DRIVE. I ADVISED DEPUTY VICK OF THE CLOTHING MR CLARKSON HAD DESCRIBED TO THIS DEPUTY THAT the FEMALE SUBJECT HAD TAKEN. A SHORT TIME LATER DEPUTY VICK ADVISED THAT HE HAD RECOVERED THE FOUR PIECES OF BATHING SUIT AND THREE PAIRS OF SHORTS FROM INSIDE THE VEHICLE. I THEN ESCORTED MR CLARKSON TO THE TRAFFIC STOP WHERE HE POSITIVELY IDENTIFIED THE FEMALE SUBJECT/DEFENDANT, MS BONITA HARDER, AS THE SUBJECT THAT STOLE THE CLOTHING FROM THE STORE. I THEN MADE CONTACT WITH DEPUTY VICK WHO ADVISED HE CONDUCTED A TRAFFIC STOP ON THE VEHICLE MATCHING THE DESCRIPTION AT SOUTH SUNCOAST BOULEVARD AND WEST YULEE DRIVE. DEPUTY VICK MADE CONTACT WITH THE DEFENDANT AND ASKED HER IF SHE HAD PREVIOUSLY LEFT WALMART, TO WHICH THE DEFENDANT REPLIED YES. DEPUTY VICK THEN ASKED THE DEFENDANT IF SHE HAD STOLEN ANY ITEMS, TO WHICH THE DEFENDANT STATED NO. DEPUTY VICK ASKED TO SEARCH THE VEHICLE, TO WHICH THE DEFENDANT PROVIDED CONSENT TO DEPUTY VICK TO SEARCH THE VEHICLE. DEPUTY VICK ADVISED WHILE SEARCHING THE VEHICLE HE LOCATED THE CLOTHING ITEMS WHICH THIS DEPUTY HAD DESCRIBED. DEPUTY VICK THEN READ THE DEFENDANT MIRANDA VIA PREPRINTED AGENCY CARD, TO WHICH THE DEFENDANT ADVISED SHE UNDERSTOOD HER RIGHTS AND WISHED TO SPEAK TO DEPUTY VICK. DEPUTY VICK ADVISED WHILE QUESTIONING THE DEFENDANT SHE STATED THAT SHE HAD STOLEN THE BATHING SUIT PIECES AND THE THREE PAIRS OF SHORTS BECAUSE SHE WAS “HARD FOR MONEY.” DEPUTY VICK ADVISED WHILE ALSO SEARCHING THE TRUCK HE LOCATED A TWO INCH BY TWO INCH CLEAR PLASTIC BAGGIE CONTAINING METHAMPHETAMINES LOCATED ON THE SEAT WHERE THE DEFENDANT WAS SITTING WHILE DRIVING THE VEHICLE. DEPUTY VICK ASKED THE DEFENDANT WHAT WAS IN THE CLEAR PLASTIC BAGGIE TO WHICH THE DEFENDANT STATED IT WAS METH AND IT BELONGED TO HER. DEPUTY VICK PROVIDED ME with the BAG, which I OBSERVED TO HAVE APPROXIMATELY 0.1 GRAMS OF METHAMPHETAMINES, WHICH I COULD POSITIVELY IDENTIFIED THROUGH MY TRAINING AND EXPERIENCE. DEPUTY VICK ALSO ADVISED THAT HE HAD FIELD TESTED THE CONTENTS OF THE BAGGIE WHICH TESTED POSITIVE FOR METHAMPHETAMINES. DEPUTY VICK ADVISED WHILE SEARCHING THE DEFENDANT’S PURSE INSIDE HER PURSE HE LOCATED A PILL BOTTLE WHICH HAD THE DEFENDANT’S NAME ON IT FOR A PRESCRIPTION OF OXYCODONE 10 MILLIGRAMS. INSIDE THE PILL BOTTLE WAS A ROUND BLUE PILL. THE PILL WAS IDENTIFIED AS AN OXYCODONE 30 MILLIGRAMS. THE DEFENDANT WAS ASKED IF SHE HAD A PRESCRIPTION FOR THE OXYCODONE 30 MILLIGRAMS, TO WHICH SHE STATED SHE DID NOT. AT THAT TIME, THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK, AND SECURED IN THE REAR SEAT OF DEPUTY VICK’S PATROL VEHICLE. DEPUTY VICK TRANSPORTED THE DEFENDANT TO THE COUNTY DETENTION FACILITY. A PROPERTY RECEIPT WAS COMPLETED FOR THE STOLEN ITEMS WHICH WAS SIGNED BY MR CLARKSON AND WILL BE TURNED IN TO RECORDS AT A LATER DATE. ALL STOLEN ITEMS WITH A TOTAL VALUE OF $72.64 WERE RETURNED TO MR CLARKSON. DEPUTY HINDERHOFER STOOD BY THE WITH THE VEHICLE UNTIL ADAM’S TOWING ARRIVED ON SCENE TO TOW THE VEHICLE. I CONTACTED POISON CONTROL AND SPOKE WITH KATHY WHO ADVISED THE ROUND BLUE PILL WAS AN OXYCODONE 30 MILLIGRAM. THE BAGGIE OF METHAMPHETAMINES AND THE OXYCODONE 30 MILLIGRAMS WERE COLLECTED, PACKAGED, AND WILL BE TURNED IN TO EVIDENCE. THE DEFENDANT’S BOND WAS SET AT $10,250.00 PER THE BOND SCHEDULE.
