Probable cause affidavit: SUBMITTED BY: BYRD, JEDIDIAH 0737 (AR15-14659) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: TOOK MULTIPLE HOUSEHOLD ITEMS FROM THE KEY TRAINING CENTER DONATION AREA, OF THE VALUE OF $100.00 OR MORE BUT LESS THAN $300.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS/HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, AND THE PROPERTY WAS TAKEN FROM A DWELLING OR FROM THE UNENCLOSED CURTILAGE OF A DWELLING, IN VIOLATION OF FLORIDA STATUTES 812.014(2)(E). ON 041915, I WAS DISPATCHED TO 1625 WEST MAIN STREET, IN INVERNESS, TO THE KEY TRAINING CENTER, IN REFERENCE TO A TIP ON A POSSIBLE THEFT ABOUT TO OCCUR. I RECEIVED A TIP FROM MR TRAVIS JONES, WHO LIVES IN LAKE PANASOFFKEE. HE ADVISED ME THAT HE WAS AT HOME AND OVERHEARD HIS MOTHER AND HER BOYFRIEND TALKING TO ANOTHER ONE OF THERE FRIENDS, NAMED COREY. HE SAID THAT HE HEARD THEM TALKING ABOUT GOING TO THE KEY TRAINING CENTER IN INVERNESS AND STEALING ITEMS FROM THE DONATION AREA SO THAT THEY COULD SELL IT IN HIS MOTHER’S THRIFT STORE. HE ADVISED ME THAT THEY GO TO INVERNESS QUITE OFTEN LATE AT NIGHT, AND THEY RETURN HOME WITH ODD ITEMS. HE ADVISED ME OF THE VEHICLE DESCRIPTION, WHICH WAS A GREEN FORD EXPLORER AND THE FRONT LICENSE PLATE TAG, PHILLIPS BUICK, AND THAT THE REAR LICENSE PLATE WAS A MARINE CORP TAG, UNKNOWN NUMBER AT THE TIME. I ARRIVED ON SCENE AND PARKED MY VEHICLE AROUND THE CORNER ON TUTTLE STREET. LIEUTENANT VITT MADE CONTACT ME AND ADVISED HE IS GOING TO PARK HIS UNMARKED VEHICLE IN A POSITION TO WHERE HE CAN OBSERVE THE DONATION AREA OF THE KEY TRAINING CENTER AND TO BE ON THE LOOK OUT FOR A SUSPECT VEHICLE. HE HAD RADIO CONTACT WITH ME AND ADVISED ME THAT THE DEFENDANT’S VEHICLE HAD ARRIVED AND PARKED IN FRONT OF THE DONATION AREA. HE ADVISED ME THAT THEY HAD FLASH LIGHTS AND THEY WERE LOOKING THROUGH ALL OF THE ITEMS IN THE DONATION AREA. HE STATED THAT ONLY DOOR THAT WAS OPEN ON THE VEHICLE WAS THE PASSENGER DOORS AND HE COULD NOT OBSERVE IF THEY WERE REMOVING ITEMS FROM THE DONATION AREA, OR PLACING THEM THERE. LIEUTENANT VITT ADVISED ME OVER THE RADIO THAT THE SUSPECTS HAD OPENED THE REAR DOOR OF THE SUV AND PLACED A LARGE BLACK TRUNK INTO THE REAR. HE ADVISED THAT THERE WAS A CITIZEN WALKING BY, WHILE HE WAS WALKING BY THEY STARTED SHUTTING THE DOORS AND WHEN HE WAS OUT OF SIGHT THEY RE-OPENED THE DOORS. DEPUTY VENTIMIGLIA AND I WERE ON FOOT AND PROCEEDED AROUND THE CORNER TO TRY TO MAKE CONTACT WITH THE DEFENDANTS. AT THAT TIME THE VEHICLE DOORS HAD ALREADY BEEN SHUT AND THE DEFENDANT’S WERE ALREADY IN THE VEHICLE WITH THE WINDOWS UP. I RAN TOWARD THE VEHICLE FLASHING MY FLASHLIGHT, TRYING TO GET THE ATTENTION OF THE DEFENDANTS BUT THEY WERE UNABLE TO HEAR ME, AND LEFT THE AREA GOING A HIGH RATE OF SPEED, EAST BOUND ON MAIN STREET. I RAN BACK TO MY VEHICLE, AND LIEUTENANT VITT CONDUCTED A TRAFFIC STOP ON THE DEFENDANT’S VEHICLE IN THE PARKING LOT OF WITHLACOOCHEE TECHNICAL INSTITUTION (WTI). I ARRIVED ON SCENE OF THE TRAFFIC STOP WITH DEPUTY VENTIMIGLIA AND LIEUTENANT VITT. I OBSERVED A LARGE BLACK TRUNK, FILLED WITH BICYCLE HELMETS, LUGGAGE BAGS, AND OTHER MISCELLANEOUS ITEMS. I ALSO OBSERVED A BOX OF DVD VIDEOS, AND ALSO TWO OR THREE OTHER BOXES FILLED WITH MISCELLANEOUS ITEMS AND ALSO A BLACK ROLLING SHELF. I SPOKE WITH THE FIRST DEFENDANT, MS VICKI ROSENBURG, AND I ASKED HER WHY SHE WAS TAKING ITEMS FROM THE KEY TRAINING CENTER DONATION AREA. SHE ADVISED ME THAT SHE OWNS A SMALL THRIFT STORE IN LAKE PANASOFFKEE AND ONE OF HER WORKERS, BY THE NAME OF COREY(UNKNOWN LAST NAME), HAD DELIVERED SOME UNKNOWN ITEMS THAT SHE DID NOT WANT TO BE GIVEN AWAY TO THE KEY TRAINING CENTER, AND THAT SHE WAS RETRIEVING THE ITEMS HE HAD BROUGHT THERE. I SPOKE WITH DEFENDANT NUMBER TWO, MR BENJAMIN GREER, WHO CORROBORATED WITH THE STORY OF HIS GIRLFRIEND. I ASKED BOTH DEFENDANTS WHAT ITEMS THEY WERE SPECIFICALLY LOOKING FOR, AND THEY WERE UNABLE TO ADVISE ME. THE ITEMS WERE TAKEN BACK TO THE KEY TRAINING CENTER, AND PLACED BACK IN THE DONATION AREA. CONTACT WAS MADE WITH THE KEY TRAINING CENTER MANAGER, MS SUE BURNS, WHO ADVISED SHE WISHES TO PURSUE CHARGES AGAINST THE DEFENDANT. A CRIME SCENE TECHNICIAN REPORT (SEE CST) WAS CONDUCTED BY DEPUTY VENTIMIGLIA. BOTH DEFENDANTS WERE HANDCUFFED (DOUBLE LOCKED) BEHIND THEIR BACK, SEARCHED, AND PLACED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY AND TURNED OVER TO THEIR PERSONNEL FOR BOOKING AND PROCESSING. BOTH DEFENDANT’S WERE CHARGED WITH ONE COUNT OF PETIT THEFT EACH, WITH A BOND SET AT $1,000.00 EACH, PER THE BOND SCHEDULE. CONTACT WAS MADE WITH MS VICKI’S FATHER, MR JAMES ROSENBURG, WHO IS GOING TO PICK UP THE DEFENDANT’S VEHICLE.
