SUBMITTED BY: REYNOLDS, CONNARY 1267 (AR14-8932) DID, KNOWING HIS DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(10)(A). ON 020214 AT APPROXIMATELY 1911 HOURS WHILE DRIVING MY MARKED PATROL VEHICLE AT THE INTERSECTION ON NORTH TURKEY OAK DRIVE AND NORTH CITRUS AVENUE, I OBSERVED A 1998 CHRYSLER SEBRING CONVERTIBLE, TAN IN COLOR, BEARING FLORIDA LICENSE PLATE NUMBER R251RN WITH AN INOPERABLE TAG LIGHT. THIS VEHICLE WAS OPERATING ON TURKEY OAK DRIVE AND TURNING RIGHT ON NORTH CITRUS AVENUE. UPON TURNING BEHIND THE VEHICLE, I TURNED OFF MY HEADLIGHTS TO OBSERVE THAT TAG LIGHT WHICH HAD NO ILLUMINATION AND WAS NOT AN OPERABLE LIGHT. PHOTOGRAPHS WERE LATER TAKEN OF THE TAG; SEE MY CRIME SCENE TECHNICIAN (CST) REPORT FOR FURTHER DETAILS. AT THIS TIME, I ACTIVATED MY EMERGENCY EQUIPMENT, AND CONDUCTED A TRAFFIC STOP ON THE VEHICLE AT THE INTERSECTION ON NORTH CITRUS AVENUE AND WEST TALL PINES COURT. UPON APPROACHING THE VEHICLE AND MAKING CONTACT WITH THE DRIVER, LATER IDENTIFIED AS THE DEFENDANT MR BENJAMIN LEVI KEECH, I ASKED FOR HIS DRIVER'S LICENSE, VEHICLE REGISTRATION AND PROOF OF INSURANCE. THE DEFENDANT PROVIDED ME WITH A UTAH DRIVER'S LICENSE, FLORIDA VEHICLE REGISTRATION CARD AND A FLORIDA INSURANCE CARD WHICH HE ADVISED BELONGED TO ONE OF HIS FRIENDS WHO WAS THE OWNER OF THE VEHICLE. I ASKED THE DEFENDANT WHERE HE WAS GOING, TO WHICH HE ADVISED THAT HE HAD JUST LEFT A FRIENDâS RESIDENCE AND WAS NOW HEADING TO ANOTHER FRIENDâS RESIDENCE. I INSTRUCTED THE DEFENDANT TO REMAIN IN THE VEHICLE AS I CHECKED HIS DRIVER'S LICENSE, VEHICLE REGISTRATION AND PROOF OF INSURANCE. I ASKED THE DEFENDANT IF HE HAD A FLORIDA DRIVER'S LICENSE, TO WHICH HE ADVISED THAT HE DID NOT. UPON RETURNING TO MY PATROL VEHICLE AND RUNNING THE DEFENDANTâS UTAH DRIVER'S LICENSE THROUGH TELETYPE, I WAS ADVISED THAT THIS WAS SUSPENDED WITH A STATUS OF NONCOMMERCIAL DRIVER'S LICENSE STATUS DENIED. TELETYPE OPERATOR 1191 FURTHER ADVISED THAT THE DEFENDANTâS FLORIDA DRIVER'S LICENSE WAS SUSPENDED FOR FINANCIAL RESPONSIBILITIES. UPON RESEARCHING THE DEFENDANTâS FLORIDA DRIVER'S LICENSE HISTORY IN D.A.V.I.D., I OBSERVED MULTIPLE SUSPENSIONS FOR FAILURE TO PAY TRAFFIC FINES, WITH NOTICES GIVEN ON 041513, 060413 AND 061213. I ALSO OBSERVED THAT THE DEFENDANTâS MOST RECENT SUSPENSION WAS FOR FINANCIAL RESPONSIBILITIES, FOR A VEHICLE ACCIDENT WITHOUT INSURANCE, WITH NOTICE GIVEN ON 050613. I THEN RETURNED TO THE DEFENDANTâS VEHICLE AND MADE CONTACT WITH HIM ONCE MORE. I ASKED HIM ABOUT HIS FLORIDA DRIVER'S LICENSE AND UTAH DRIVER'S LICENSE, AND WHETHER HE HAD RECEIVED ANY TICKETS OR KNEW ABOUT ANY PROBLEMS WITH HIS INSURANCE. THE DEFENDANT ADVISED THAT HE HAD TWO TICKETS WHICH HE PAID FOR; ALTHOUGH HE DID NOT HAVE DOCUMENTATION AT THIS TIME. I ASKED THE DEFENDANT ABOUT HIS VEHICLE INSURANCE, TO WHICH HE ADVISED THAT PRIOR TO LEAVING FOR UTAH, HE HAD A VEHICLE WHICH HE HAD SOLD THAT HE HAD INSURANCE ON IT, ALTHOUGH HE HAD NOT ADVISED THE FLORIDA DEPARTMENT OF MOTOR VEHICLES OF THIS. I ASKED THE DEFENDANT WHEN HE LEFT FOR UTAH, TO WHICH HE ADVISED THAT HE LEFT ON 050913 WHICH WAS AFTER THE MOST RECENT NOTICE WAS GIVEN FOR HIS DRIVER'S LICENSE BEING SUSPENDED. I ADVISED THE DEFENDANT THAT HE COULD NOT BE OPERATING A MOTOR VEHICLE IN THE STATE OF FLORIDA WITH A SUSPENDED DRIVER'S LICENSE. I ASKED HIM IF HE HAD ANYONE TO COME PICK UP THE VEHICLE, TO WHICH HE ADVISED THAT HIS FRIEND, MS CORRINNA CAMILLERI, WHO OWNED THE VEHICLE, COULD BE EN ROUTE TO PICK UP THE VEHICLE. THE VEHICLE WAS LEFT ON SCENE, AND DEPUTY POLLIARD STAYED ON SCENE UNTIL IT WAS PICKED UP. I ADVISED THE DEFENDANT TO STEP FROM THE VEHICLE, AND THAT HE WAS BEING PLACED UNDER ARREST FOR KNOWINGLY DRIVING WHILE LICENSE SUSPENDED. THE DEFENDANT WAS SECURED IN HANDCUFFS, DOUBLE LOCKED BEHIND HIS BACK, AND SEARCHED AND SECURED IN THE REAR OF MY PATROL VEHICLE. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL, HE WAS RELEASED TO DETENTION FACILITY STAFF FOR BOOKING AND PROCESSING. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF DRIVING WHILE LICENSE SUSPENDED, KNOWINGLY, DUE TO FINANCIAL RESPONSIBILITIES, AND RELEASED ON HIS OWN RECOGNIZANCE DUE TO HIS LEVEL OF COOPERATION. THE DEFENDANT WAS ALSO ISSUED FLORIDA UNIFORM CRIMINAL TRAFFIC CITATION, BEARING NUMBER 4307GJX2, FOR DRIVING WHILE LICENSE SUSPENDED KNOWINGLY, DUE TO FINANCIAL RESPONSIBILITIES, WITH A MANDATORY COURT APPEARANCE OF 022714 AT 1300 HOURS. THE DEFENDANT WAS ALSO WRITTEN CITRUS COUNTY SHERIFF'S OFFICE WRITTEN WARNING, NUMBER WW378187B, FOR THE INOPERABLE TAG LIGHT. |
