Probable cause affidavit: | SUBMITTED BY: SETTLES, KATHERINE 0113 (AR08102236) DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY SETTLES, WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: INVESTIGATING A REPORTED STOLEN VEHICLE, WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. ON 031808 UPON MY ARRIVAL, I OBSERVED A BLACK TOW TRUCK WITH A GREY PICKUP IN TOW PARKED IN THE PARKING LOT OF THE KANGAROO STATION AT THE CORNER OF GULF TO LAKE HIGHWAY AND ROCK CRUSHER ROAD. THIS DEPUTY MADE CONTACT WITH THE REPOSSESSION AGENT WHO ADVISED THEY HAD PICKED UP THIS SPECIFIC VEHICLE OFF ROCK CRUSHER ROAD AT THE RESIDENCE. THEY ADVISED THE REGISTERED OWNER IT WAS BEING REPOSSESSED. SHE ASKED TO REMOVE HER PERSONAL PROPERTY FROM THE VEHICLE WHICH THEY ALLOWED HER TO DO. THEY HOOKED THE VEHICLE IN TOW AND STOPPED AT THE CORNER STORE TO PUT LIGHTS ON IT AND SECURED IT DOWN. UPON MY ARRIVAL, I HAD OBSERVED A BLOND FEMALE INSIDE THE CAB OF THE VEHICLE IN TOW SCREAMING INTO A TELEPHONE. WHEN I ASKED THE AGENTS WHO THE SUBJECT IN THE VEHICLE WAS, THEY ADVISED THEY WERE NOT SURE. THEY STATED WHEN THEY PULLED IN AND BRIEFLY STOPPED A RED PICKUP PULLED IN BEHIND THEM, AT WHICH TIME, THE BLOND HAIRED FEMALE CAME OUT OF THE RED VEHICLE AND CLIMBED INTO THE VEHICLE IN TOW. THE SUBJECT INSIDE THE VEHICLE WAS LATER IDENTIFIED AS THE REGISTERED OWNER'S MOTHER AND THE DEFENDANT, MS BETTY HARLESS. THIS DEPUTY AFTER SPEAKING WITH THE REPOSSESSION AGENT AND THEM PROVIDING ME WITH THEIR PAPERWORK FROM AMERICAN FINANCE ADJUSTERS OF OCALA, CASE NUMBER 2009-652278, WITH AN ORDER TO REPOSSESS A 2007 DODGE RAM 1500. THIS DEPUTY ATTEMPTED TO SPEAK WITH THE DEFENDANT WHO WAS SCREAMING INTO HER TELEPHONE. I ASKED HER TO SPEAK IN A NORMAL TONE AND STOP SCREAMING WHICH SHE DID NOT DO. THE DEFENDANT CONTINUED TO SCREAM TO THE POINT SHE WAS NOT MAKING ANY SENSE AND WAS NOT BEING UNDERSTOOD. I DID HOWEVER MAKE OUT BY PARTS OF HER CONVERSATION ON HER TELEPHONE, SHE WAS HAVING HER DAUGHTER, THE REGISTERED OWNER OF THE VEHICLE, AND HER HUSBAND RESPOND TO OUR LOCATION. AT THIS TIME, I REQUESTED A BACK-UP OFFICER TO RESPOND TO MY LOCATION. UPON THE ARRIVAL OF LIEUTENANT VITT, I ADVISED HIM OF THE SITUATION AND AS HE ACCOMPANIED ME TO THE VEHICLE WHERE THE DEFENDANT WAS SITTING INSIDE AND SHE WAS ASKED TO STEP OUT OF THE VEHICLE. AT THAT TIME, SHE STATED NO. AT THAT TIME, SHE WAS INFORMED SHE WAS BEING GIVEN A VERBAL ORDER TO REMOVE HERSELF FROM THE VEHICLE OR SHE WOULD BE PLACED UNDER ARREST. THIS ORDER WAS ISSUED TO HER ONE MORE TIME AS THE DEFENDANT CONTINUED TO RANT AND RAVE SHE SPOUTED OUT "GO AHEAD AND TAKE ME TO JAIL." SINCE THE DEFENDANT HAD BEEN ASKED SEVERAL TIMES TO REMOVE HERSELF FROM THE VEHICLE PRIOR TO BEING PLACED UNDER ARREST, SHE WAS HANDCUFFED (DOUBLE LOCKED) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WITHOUT FURTHER INCIDENT. *NOT-EXEMPT* |
