| Probable cause affidavit: | SUBMITTED BY: HUGHES, JAMES 0500 (14-173968) (AR15-13608) did unlawfully and knowingly obtain, use or endeavor to obtain or use the property of (A), THE VICTIM, to-wit: 2007 SILVER IN COLOR JEEP, by exercising control over said property with the intent to either temporarily or permanently deprive the VICTIM of a right to the property or a benefit thereof, or did appropriate the property to HER own use or the use of any person not entitled thereto, and knew or should have known that said property was stolen, in violation of Florida Statute 812.014(2)(c)(6) ON 122214, AT APPROXIMATELY 1350 HOURS, A THEFT OF AN AUTOMOBILE WAS REPORTED TO this AGENCY. THE AUTOMOBILE WAS DESCRIBED AS A 2007 JEEP, SILVER IN COLOR, WITH AFTER MARKET WHEELS AND BUMPERS. WHEN THE JEEP WAS STOLEN, A SILVER IN COLOR HONDA 4-DOOR WAS LEFT AT THE SCENE OF THE THEFT. A WITNESS DESCRIBED A BLONDE FEMALE GET OUT OF the DRIVERâS SEAT AND WALK TOWARDS THE VICTIMâS RESIDENCE. THE WITNESS ADVISED A SHORT TIME LATER, HE OBSERVED THE JEEP PULL OUT OF the VICTIMâS RESIDENCE. THE WITNESS ADVISED THAT HE IS AN ACQUAINTANCE OF THE VICTIM AND IMMEDIATELY CONTACTED HIM. THE VICTIM NOTIFIED THIS AGENCY. the SILVER IN COLOR HONDA WAS IMPOUNDED AND LATENT PRINTS WERE OBTAINED FROM THE VEHICLE WHICH BELONGED TO the DEFENDANT, MS BEVERLY CARNEY. I RESPONDED TO the DEFENDANTâS LOCATION. I ASKED THE DEFENDANT IF SHE KNEW ANYTHING ABOUT ANY STOLEN VEHICLES AND SHE ADVISED THAT IF SHE WAS NOT UNDER ARREST, SHE DID NOT WISH TO TALK TO ME. THE DEFENDANT WAS ADVISED SHE WAS BEING PLACED UNDER ARREST FOR GRAND THEFT AUTO, HANDCUFFED, BEHIND HER BACK, (DOUBLE LOCKED), SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL AT THE CITRUS COUNTY DETENTION FACILITY, A DIGITALLY RECORDED INTERVIEW WAS CONDUCTED WITH THE DEFENDANT. I READ THE DEFENDANT HER MIRANDA WARNING VIA AGENCY PREPRINTED CARD. the DEFENDANT ADVISED THAT SHE UNDERSTOOD HER RIGHTS and STATED THAT SHE WOULD SPEAK WITH ME AT THIS TIME. UPON TALKING WITH THE DEFENDANT, I ADVISED HER THAT HER FINGERPRINTS WERE FOUND ON A VEHICLE THAT WAS LEFT AT THE SCENE OF A VEHICLE THEFT. SHE ADVISED THAT SHE DID NOT KNOW ANYTHING ABOUT IT. I ASKED HER IF SHE HAS EVER DRIVEN A SILVER IN COLOR HONDA 4-DOOR. THE DEFENDANT ADVISED THAT SHE HAS. BUT WAS ON THE WAY TO PICK A FRIEND UP AND THE VEHICLE BROKE DOWN ON AN UNKNOWN ROAD. THE DEFENDANT ADVISED THAT NO ONE WAS WITH HER AND SHE DOES NOT RECALL HER LOCATION, JUST THAT SHE TOOK OFF WALKING. I ASKED HER IF SHE HAD BORROWED OR TAKEN WITHOUT PERMISSION ANYONE ELSEâS VEHICLE AND SHE ADVISED THAT SHE DID NOT. I CONCLUDED OUR INTERVIEW AND ADVISED THE DEFENDANT THAT SHE WAS BEING ARRESTED FOR GRAND THEFT AND THE BOND would BE SET AT $2,000.00, PER THE BOND SCHEDULE. |
