| Probable cause affidavit: | SUBMITTED BY: ELMORE, PATRICK 1755/3948 (AR16-20987) On September 15, 2016, at approximately 11:21 PM I Trooper P. Elmore ID number 1755/3948 was sitting in my marked patrol car on U.S. 19 (S. Suncoast Blvd) in the area of W. Atlas Dr in the center median running stationary radar traffic enforcement. During that time, I observed a dark colored passenger car traveling southbound on U.S. 19 (S. Suncoast Blvd) in the outside lane at a high rate of speed. I Tpr. P. Elmore released Xmit/hold on my front antenna and got an actual speed of 80 mph and a Doppler tone consistent with the speed. I then at that time left the center median and performed a traffic stop. Upon approaching the vehicle, I spoke with the driver identified as Bobby Joe Osborne (by his Florida identification card) and explained that I stopped him for speeding (80 mph in 55 mph zone). The driver handed me his Florida Identification card and informed me that he did not have a license and that it was suspended for failing to pay traffic fines. At that point I returned to my patrol car and ran Mr. Osborne through FCIC/NCIC and DAVID along with the Tampa Regional Communication Center. It showed Mr. Osborne had 4 previous convictions for Driving with a license Suspended/Revoked. At Approximately 11:30 PM myself and Deputy Laborda (0735) of the Citrus County Sheriffâs Office asked the driver and passengers if there would consent to a vehicle search, they agreed and stepped out of the vehicle. After conducting the vehicle search nothing illegal was found inside the vehicle. At 11:51 PM I informed the driver Mr. Osborne that he was being placed under arrest for Driving with a license suspended/revoked. Mr. Osborne was handcuffed behind his back and double locked and placed into the back of my marked patrol car. Mr. Osborne was transported to the Citrus County Jail for driving with a license suspended/revoked 322.34(2)b without incident and booked for the above charges. |
