Charge description: | Bobie Milton Dubose was convicted of Driving While Intoxicated on August 13, 2015 by a jury of his peers. The 24 year-old Stafford man was arrested in October 2013 after a police officer found him stopped in the middle of the roadway. According to Assistant District Attorney Caroline Kim, Stafford Police Officer B. Bolin found Duboses car stopped in the middle of the S. Kirkwood and Greenbriar Road intersection around 2:30 a.m. on October 26, 2013. The defendant was sitting in the driver seat with the engine running but said the car just stopped. Officer Bolin could smell the odor of an alcoholic beverage emanating from Dubose and also noticed his speech was slurred. The defendant performed poorly on the field sobriety tests and gave a breath sample that registered 0.11 breath alcohol content. Dubose also admitted having had two to three drinks at a Houston nightclub around midnight. The defense argued that the evidence was insufficient to prove that Dubose actually operated his vehicle while intoxicated and that his breath sample given an hour after the officer found him didnt prove he was over the legal limit of 0.08 at the time he was driving. The State reminded the jury to use common sense and reason to make reasonable deductions from the evidence, which they did in finding the defendant guilty. Dubose was tried in County Court at Law No. 1 before Presiding Judge Christopher G. Morales. Driving While Intoxicated is a Class B Misdemeanor punishable by up to 180 days in county jail and/or a fine up to $2,000. The defendant was sentenced to 18 months probation during which he must attend a DWI education program and a victim impact panel. Dubose must also complete 72 hours of community service. Assistant District Attorneys Caroline Kim and Grayson Miller prosecuted the case. Attorney Eduardo Franco represented the defendant. |
