Probable cause affidavit: | SUBMITTED BY: LAHERA, ANDRES 0673 (AR10117104) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, K MART, TO WIT: I-POD SHIELD CASE, SAID PROPERTY BEING OF A VALUE OF $29.99 WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTES 812.014(1) and 812.014(3)(a). ON 092810, I WAS DISPATCHED TO K-MART IN INVERNESS IN REFERENCE TO A PETIT THEFT WHERE I MET LOSS PREVENTION OFFICER. THE DEFENDANT WAS OBSERVED PICKING UP A CASE, CUT IT OPEN AND THEN PLACE MERCHANDISE IN HIS FRONT POCKET AND THEN ATTEMPTED TO EXIT THE STORE WITHOUT PAYING. I THEN MET the DEFENDANT, WHO WAS BEING HELD in the K-MART LOSS PREVENTION ROOM. I ASKED HIM HIS NAME, TO WHICH HE INFORMED ME HIS NAME WAS BRADLEY EDWARDS. I THEN ASKED THE DEFENDANT IF HE HAD IDENTIFICATION ON HIM, TO WHICH HE ADVISED ME HE HAS NEVER HAD FLORIDA IDENTIFICATION and DOES NOT HAVE ANYTHING TO IDENTIFY HIMSELF ON HIS PERSON. I THEN ASKED THE DEFENDANT TO STAND UP WHERE HE WAS SEARCHED. I RECOVERED A RAZOR BLADE THAT HE USED TO CUT the MERCHANDISE OPEN. I ASKED HIM WHAT THE RAZOR BLADE WAS FOR. HE INFORMED ME THAT HE USES THE RAZOR BLADE TO CUT THE PACKAGES OPEN. I THEN READ the DEFENDANT HIS MIRANDA RIGHTS VIA CARD. I THEN INFORMED THE DEFENDANT HAVING HIS RIGHTS IN MIND IF HE WISHED TO TALK TO ME, TO WHICH HE ANSWERED YES. I ASKED HIM IF HE TOOK THE ITEM IN QUESTION AND HE SAID YES. I ASKED HIM WHY AND HE INFORMED ME HE DID NOT FEEL like PAYING FOR IT AND JUST DECIDED TO STEAL IT. AT THAT TIME HE WAS ADVISED HE WAS BEING PLACED UNDER ARREST FOR PETIT THEFT. HE WAS HANDCUFFED BEHIND HIS BACK (DOUBLE-LOCKED). I COLLECTED A STATEMENT FROM the LOSS PREVENTION OFFICER. A PROPERTY RECEIPT FOR THE SHIELD CASE WAS FILLED OUT AND GIVEN BACK TO THE LOSS PREVENTION OFFICER. the DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING. BOND WAS SET AT $250.00.
